THE HERALD GAIRIOCH COL LISION.
Captain Savory'a Certificate Suspended, Tms afternoon, Mr H. G. Soth Smith, R.M., delivered a lengthy judgment h this caso. Ho exonerates the master and crow of the Gairloch, and attributes the collision to tho default of the master of tie Herald. Ho concluded that the Galrloch'* lights were burning^nd ought tohavebeen visible to the Horald, if they were not in fact soon by them. He also thoughtthat tbeforesail was not sot so as to afreet tho navigation of the Gairloch or to bring the master within tho terms of the harbour regulatiohl It seemed clear, both from the general' tenor of the evidence and from the nature of the damage sustained by the Gairloch that the Herald ranintotho Gairloch. andnot the Gairloch into the Herald. The matter of the Gairloch gave a consistent acconnt of the occurrence from the beginning , k_ shewed that he ported, then hard-portedailhe ran his vessel ashore in his effort! to avoid collision. Turning to the erfl-; ! once of the Herald, the Court found those elements which made the evidence of the Gairloch trustworthy entirely wanting. The Court were oi that the master of the Herald did not know his proper course after rounding tie black buoy. Tho judgment concluded: lam cf opinion that the evidence disclosed great want of care on the part of the master of the Herald, Captain Savor's certificate is suspended for three months, and he is ordered to pay the costs of all ■ witnesses subpamned nt his requeßt, The.'■. other certificates will be returned.■ •'■■-'■'",' A
