POLICE COURT.-This Day.

(Before Messrs Hurst and H. lie Martelli, Justices.)

Drunkenness. —Five persons were fined 5s each ; four others 10s each, and Maria Price, a very old offender, 20s or seven days.

Alleged Embezzlement.—John Louis Thompson, of the North Shore, surrendered bis bail, and appeared in answer to a charge of larceny of £1, on tho Oth of June, 18S1 ; also, with embezzling tho sum of £14 on tho Oth July last, at luglowood, tho property of Andrew Ncilson.—Mr Napier for the defence.—Serjeant Whito explained the circumstances, and said tho description of the accused was so accurate and seemed to point directly to Thompson asthc offender.— Mr Napior said, had the police made diligent enquiries, thoy would havo been convinced that his client was not the man. Ho had been tho keeper of a respectable restaurant at Hawcra, and had all. along held responsible positions in socioty. Ho thought the police in their over zeal in this c;iso had interfered with tho liberty of the subject.—Sergeant Whito replied.—Tho Bench considered that the police had simply dono their duty ; it had turned out a mistake, and it was to bo deplored that a respectable man should have been arrested under such circumstances.— The accused was at once discharged.

A Dangerous Lbap.—Roderick Lorenzen was charged with leaping into a railway train on tho Aucklanel and Helensvillo line while tho train was in motion.—Sergeant Whito asked to withdraw this charge, owing to circumstances which had since come under his notice.—Withdrawn.

The Waiheke Case.—Henry Trace and John Phillips, charged with demolishing a house on the 26th July, tho proporty of Robert McLcod, of tho island of Waiheke, was adjourned until Friday next on the application of Mr E. Cooper. Impoke Water.—Ellon E. Ellis appeared to answer a charge of allowing impure water to remain on ber premises in Hope-town-streot on the 22nd inst.—Mrs Ellis said she would plead guilty under the circumstances, but it was not her fault as she had given orders to have the nuisance removed ; the work was now in progress.—Mr Goldie said this was a very flagrant case, or he should not havo taken action in the matter. Ho visited Mrs Ellis's premises on Saturday, and he could assure the Bench that this was a very aggravated case, and ho was only doing bis duty in bringing the case before the Court. Ho had nino witnesses to prove that the condition of the place was detrimental to tho health of the neighbourhood. — Tho Bench said as Mrs Ellis had pleaded guilty, a fino must be imposed, but did Mr Goldio intend to ask for the expenses of the nino ?—Mr Goldio then called the witnesses forward, butonly four claimed payment.—Tho Bench therefore ordered a fine of 2s (id, and costs £1 7s Od.—Mrs Ellis wished to address the Bench, but was told it was unnecessary, as tho decision had been given.
