Ho made up tho bundle, and, as it was his own property, ho considered ho was doing no wrong.—Robert Parf ons. mastor at arms on tho Diamond, deposed ho receivod tha report from a previous witness, Southgate. Prisoner had no authority to tako tho tobacco from tho ship. Prisoner said ho came from England in tho Fornglen. and when ho rccoived tho bundle, he had no idea that it oontalnod tobacco. ' Tho' Benoh asked for furthur evidence in respect of prisoners knowledge of tho tobacco', but counsel considered this had boen proved. The Bench said prisoner's plea was ignorance, but no seaman could bo ignorant of tho fact that giving out tobacco or other dutialtdo goods was a Broach of tho Act, and consequently the flno would bo £2 6s, ot, in default, one month's imprisonment. - John LttUo, seaihan,' pleaded guilty to' giving the 3 lbs. tobacco to tho former prisoner.—Mr I/aishldy having made a few remarks, would not preßS for a heavy penalty In this caso, as tho man would be punished on board.—Pined 15s and costs. !
