(J)cfore His Honor Mr Justice Gillies.) RE MCLEOD. IgJn this case, Mr George, solicitor, applied for the bankrupts discharge, onbchalfofthe trustees under the deed. An amended list had been made, showing that the bankrupt* assets, when recovered, would be ill excess of the liabilities and approved by the creditors, and a resolution passed recammendiug the execution of the deed. His Honor granted the application in accordance with the creditors resolution. HE MCLENNAN. Mr Alexander appeared for the bankrupt, James McLennan, builder, of Auckland, andaskcil for bankrupt's discharge, in accordance with the terms of the Act. There being no opposition, and the provisions of the Act having been complied, with, His Honor granted the bankrupt's discharge, WAITAKA STEAM NAVIGATION COMPANY (LIMITED.) Mr A. E. Whitakor made an application for the appointment of a second liquidator in winding up the affairs of this Company, ' Mr E. llcskcth opposed, the application, as there was no'reason stated in tho affidavit for a second appointment, and such application was not in accordance with the will of the majority of the shareholders. His Honor asked the reason for the appliaction.
Mr Whitakei slated that no special reason was assigned, but lie was instructed to say tlmt tho appointment of a second person would in no way interfere with Mr HaniiltflD, the present liquidator of the company. ifis Honor said Jjome reason should certainly hllv° ljecn etatcd tn support of the application; and as no reason had been stated, he mustrofuse to comply. Application refused,
