His Worship suggested that the matter should stand overfor sixweeks, ag there was no possible chance of getting any money out of him until the receipt of his pension. —Mr George consented, and the case was ad-journed.-John Abbott v. Kichard Madden; claim, £7 Is 7d. In this case, the promise of £3, on the iirsfcof March, wasacceptad: the balance on the Ist of April- It was hinted that defendai.t might " make a fool" of plaintiff on the latter date. The defendant's promise, however, was accepted. . Jjtcfeindkd Cask's. —Hedges v. Lamb; claim £2 Cs, wages. — Mr Tyler for plaintiff, Mr Hesketh for defendant.—Frank Hedges deposed tlint he was a master mariner in the employ of defendant, an master of the 'Scotchman.' (A.t the rcqunst of Mr Hesketh witness left the corns). Witness depoped further that Mr John Lam)) asked him to load the culter. On the <Jth January I'C asked Mr Lamb to pay him. Had asked him several times since. On the last occasion defendant said he could not pay him until ho was saiJfled about Ids, which he fancied witness ovyed him. The claim was for one third of the freight, £2Cs. Mr English took a second for unloading, and Mr Lamb, as the owner, took the ot^er third. '1 lie 10s was for towin-' down a log, giVf-n to witness by Mr Hardy. He considered it was for exti'fl. labour, but s-ud he would refund it to Mr Lamb if it was intended for him. He was not aware that ho owed any rent to Mr Lamb. He was engaged as muster of the Scotchman at £3 10s a wcok and house-rent free, That was the agreement, and Mr Lamb had not previously mado any demand uion him for rent.—Crossoxumined by Mr Hesketh : He might have made a mistake in the dates-!' They were as near as he could possibly g«*t under tho circumstances. He n'iver.iump<-d from t.he Scotchman and said lie would do no more work on her.
