John McGntl", alias Kelleher, was charged with stealing five fowls, the property of * <Jeorge U. Martin, of the Junction Hotel, •' Epsom, on the lotii inst. >' He pleaded not guilty. ' James Galvin said he lived with the 1 prisoner at Xewmarket ; lie was at tin; ■' Junction Hotel on the night of the 10th ' inst., in company with the accuse.! and * another fellow lodger named McL'rori.s. They lift together, but the accused went a i different way directly after. ile went home. lie afterwards saw the prisoner comt ing along with three fowls in his pos-session t . one alive and two dead, lie asked him where he got the fowls, and he said fi Hold your tongue." He took the fowls away from prisoner, and a man named Robinson coming to his assistance, they tried to seize . him, hut he got away, and threatened to stick a knife into the first man that laid a . hand on him. They secured him at last, and took him to Newmarket, and gave him over to Sergeant Jackson. Tile fowls produced were those found in prisoner's possession, lie had previously known prisoner bring home fowls, and he suspected they weie stolen. He brought some home the night before, and he (witness) helped to cat them. When he had asked him once hefoiv where he got the fowls lie had replied "What the is that to do with yon V" The witness was cross-examined at some length by the Bench. He said he and the prisoaerh 'd lived together for some two months. He had been in .Mr Hesketh's employ, and prisoner had been in .Mr Perkins' employ. Win. Croris deposed that the previous witness, himself, and the prisoner left the hotel together. Prisoner afterwards vent a different way, and came home later with the fowls in his possession. They tried to got him to come with them to the police, when lie drew a knife and threatened to stab them. He had known the other witness a long time, but did not know much of the accused. : .Serjeant-Jackson deposed to taking the accused into custody from the witnesses. The accused said he had found the fowls in a paddock. He went, to prisoner's house and under it he had found the fowls skins. produced. George Baxter Martin, landlord of the Junction Hotel, identified the fowls pro- , duccd as his property. The prisoner lxid no right to take them. They were worth about 10s. ' Prisoner, in defence, said that he had picked up the fowls on the roadside, and while lie was carrying them along, he was seized by the witness Galvin who said, '\I have you now," and nearly clicked him beI fore he could explain how he came by the I fowls. Galvin had said he would have revenge on him for his brother being sent to the stockade. They all had a down on him, and wanted to get rid of him. { The Bench said they were satisfied of the ; prisoner's guilt, and sentenced him to one month's imprisonment witli hard labour. This was all the business.
