Esq , J.P's). ON THE SPREE
Thomas Wasbburn alias Russell Martin Kelly, Thomas McCarthy, Patrick Mahoney and Nicholas Fosstepen were all charged with being drunk and disorderly last evening, and were each fined 53 and costs or 24 hours imprisonment.
UNRTJjY SEAMEN. Edward English,iof the same vessel, whose ease was remanded from yesterday, when he was charged with refusing to do duty on board the British Empire, and being drunk, was again brought up. He pleaded guilty to both charges. The mate stated that previously he bore a good character, and he did not wish to press the charge of refusing to do duty. The prisoner was fined ss. and costs for drunkenness, or 24 hours imprisonment, after the expiration of the 24 hours to be again sent on beard the British Empire. George Roil", Benjamin Genister, Michael McCarthy and Henry Matilado were brought before the Court for refusing to obey the commands of the officers of the British Empire yesterday. The prisoners, who were all lads, pleaded not guilty. Henry Dixon the mate, stated that the boys had got drink by some means and refused to do what they were told, threatening to thrash the midshipman; they did no work after four o'clock. They were passing coals when they refused to v, rork.
Thomas Wren, a midshipman on board, deposed that 5 esterday they refused to work, and that when he went to other work than passing coals, by order of the mate, the prisoners abused him and afterwards knocked him down.
The piieoners stated there would have been no row had not the mate ordered them on shore to fight their battle out. The Bench stated that in view of the youth of the prisoners they would pass the lenient sentence of of one week's hard lobour. OBTAINING MONEY UKBER FALSE PRETENCES. James Simpson on remand from the Thames, was charged with obtaining a sum of £G0 by means of false pretences ac Auckland on the 21fat November 18G5. Mr. Hesketh appeared on behalf of the prosecution, but would offer no evidence. The case was therefore discharged.
