ONEHUNGA POLICE COURT. — This Day.
(From our own Correspondent.)
]BY TELEGRAPH.]
(Before Mr Barstow, Esq., R.M.)
Henry Selfe, engineer, was summoned under the Vagrant Act, with using threatening abusive and insulting names, by calling William Galbraith, on the 22nd instant, on the Onehunga wharf, a liar and a robber, with intent to provoke a breach of the peace. Mr JRees appeared for Mr Galbraith, and stated that the language used by the defendant was such as to provoke a breach of the peace. Mr Galbraith was engaged as a public officer, and it was necessary that while in that capacity he should be protected by the Court. Mr Rees called as evidence the plaintiff, Mr Galbraith, and Messrs Vause, Brain, Blackburn, and Brierly, who deposed that the defendant had used provoking language.
Messrs. Hesketh and Kees each addressed the bench. Henry Patson, James Wilding, and William Robinson gave evidence for defence, and stated that Galbraith provoked Selfe and called him a liar. Each denied that Selfe used other offensive expressions complained of. The Bench considered case not proved and dismissed it. The second case against Selfe will be withdrawn.
