SUPREME COURT.-This Day.

IN BANKRUPTCY,

(Before His Honor Sir G. A. Arney, Knight, Chief Justice.) Re J. AND J. SOPPETT.

Mr:J. B. Russell applied for an order for complete execution of a deed of arrangement in this case.

In making the application Mr Russell stated that the total amount of liabilities in the estate was £10,901 8s 4d, and the number of creditors 31. Of these 18, representing £9,409, had assented to the proposed deed, a proportion exceeding the threefourths of liabilities required by the 263 rd section of-the Act. Mr Russell put, in affidavits from the bankrupts in lieu of the certificate of the trustee, who was unavoidably absent.

His Honor, observing that the evidence of complete execution was perfectly satisfactory, made the order asked for.

Re JONATHAN WARRAL HINES,

Mr Brookfield, on behalf of the trustee in this estate, applied for an order for a summons against the bankrupt requiring him to appear and shew cause why he had not fulfilled the conditions of his discharge. Mr Brookfield said the application was made under the 2S6th section of the Act.

The bankrupt, who was described as a gentleman of Parnell, was adjudicated on the 12th April, 1873. On the 29th May he came up for his final examination. On that occasion several creditors appeared to oppose, and the trustee's report was also unfavourable. "The examination was adjourned to the sth of June to admit of / composition being made. Russell on his behalf that it had k. arranged with the creditors that he ahnu pay the trustee £5 per month as long M iT received his allowance from his father until he had paid 10s in the £ on the «i« of liabilities. All opposition was then with drawn, and the bankrupt received his d charge. Since that time the bankrupt Wi* only paid LlB instead of LSO. The truatT had made repeated applications but had r ceived no response. " c

The learned counsel put in an affidavit of the trustee. He had every reason to heW that bankrupt had received his allowance regularly. '* His Honor granted the order for a sum mons requiring the bankrupt to appear next Court diy.
