DISTRICT COURT.—This Day.
(Before His Honor Judge Beokham.) The following cases were heard before the Court this morning, and disposed ot as under :— GEORGE W. BINNEY V. 0. INNES. Claim £20 12s. 2d, goods. Mr Rees, who appeared for defendant, asked for an adjournment as defendant was not there. , ~,. ~ Mr Weston, on the part of the plamtitt, strongly objected to this, as defendant, .who is engaged in the brewery business in the Waikato,hadbeendulyservedwithasummons on the 14th of March ; and he (Mr Weston) had come fully prepared to prove plamtitt s claim, and he thought with all due deference to his learned friend that as a month had elapsed the defendant should have been here. He would not object to an adjournment if defendant would consent to pay the costs and find security for the debt. ' His Honor said that the counsel for the defence was not to blame in asking for an adjournment under the circumstances ; the 1 fault was with the defendant, who had neglected to appear. Mr Weston pressed for the case to go on ' unless security be given. , , His Honor said that as defendant had been very tardy in this matter, he thought that security shoald be forthcoming within forty- eight hours for the amount to. Costs must be.paid. George Harper, clerk to plaintiff, proved the debt. He had served the hops and malt upon defendant's written order. Innes found fault with the malt, and returned fourteen bags out of twenty, which were not charged for. His Honor said that Mr Innes could find no fault wibh his counsel, who had done every thing he could for him. The case was adjourned until 28th. April.
WILSON AND PETERKON V. W. PERSTOX AND CO. Claim £23 Is. 3d.
Mr Beveridge appeared for plaintiffs. Peter Peterson proved the claim, which was for fish and other things. Judgment for plaintiff, with his expenses from the Thames since Monday, £6 14.
" THOMAS DUDER V. JAS. HAMMOND. Claim £45.
Mr Eees appeared for plaintiff, and stated the nature of the claim, which arose out of expenses in connection with the building of wharf at the North Shore.
Thomas Duder was examined, and stated that he was one of the defendants in a recent action in connection with the Devonport wharf at the suit of George Beddoeg, he naw claimed a sixth of the expenses of the action from MrHammond. The case was adjourned until next Court day. ■ : • IREI.ANI> BEOS. V. W. M. SANSOM. Claim £21 lls. 6d. This was a claim on a joint promissory note. . : Barton Ireland proved the claim. The defendant considered that as he had withdrawn several year ago from the connection, although he signed the note, he was not re&poßsible1 His Honor said Mr Sansom was .certainly responsible, aa he had signed the note, I but he had his remedy. Judgment must be for the plaintiff. The following cases were adjourned:— Jakins and Willcox y. Michael Brown. Claim, £28 2s 3d. John Lunolon v. Katati, £92 13s 6d. CoromandeL Beach Gold Mining Company v. Joseph Bennett, £100. Defended Cases. Mercury Bay Saw Mill Company v. C. B. Taylor, £sGlls sd. M. Henderson v. A. K. Taylor, £99 3s. Taurus Gold Mining Company v. Goldwater. WITNESSES EXPENSES. Mr Devore applied on behalf of witnesses' expenses in the late case of G. H. Layers. The Court reserved judgment until next Court day. LIQUIDATORS. The Court sanctioned the appointment of liquidators in the winding up of the Murphy's Hill and Lucky Diggers Gold Mining Companies. The Court then adjourned until to-morrow at half-past ten.
