[Before Thomas Beckham, Esq., District Judge.] Dixon's No. 3 Gold Mining Company v. Conthibi. tohies. —Mr. Rees appeared for the official agent. Mr. Lnsk appeared for My*. Cashel, and urged that she had paid all calls up to the time when the shares were transferred.—Mr. Rees argued that the official agent had only the books to go by. Mr. Creagh, the agent of Mrs. Cashell, was a director when the books were taken from Mr. Saunders and banded over to Mr. Lyle. The books were written up then as they now appeared before the Court. His Honor remarked that if the directors ar'd managers of companies had performed their duties as they ought to have done, many of the companies need not to have been wound up. There had bei-n gross mismanagement, and this had caused all the difficulty. If, however, Mr. Creagh had been a director, and also Mrs. Crashell's agent, he ought to be saddled with the costs of the case.—Mr. Rees finally proposed to abandon the calls on the new scrip, and take up the balance of 7s. 6d. on the old scrip, and get in the unpaid calls as best they could. He would bring up an amended schedule next Court, day. The liabilities would be about four hundred pounds, and the assets would realise fifteen shillings in the pound and all costs. The case of Mrs. Cashell was dismissed without costs. —Mr. James Rus.ell, on behalf of Mr. William Morrin, consented to the new arrangement, but applied for costs which were granted.—Mr. Lnsk applied for costs on behalf of Mr. John Carfrae, who held none of the new shares. Costs granted. Mr. lGs*ling made a similar application on behalf of Mr. Frederick Killing, which was also granted.
