Mary Jane Smith; for a first offence of drunkenness, was fined ss. and costs, or to be imprisoned for 24 boars with hard labour. Bridget Hawkey and Ellen McLean, for second offences, were fined each 10s. and costs, or to be imprisoned 48 hours, and Henry Naysmith, for a third, offence, was fined 20s. and costsj or 48 hours, w|th seven days' additional. : •'■ I
Thomas Brown was charged with having been drunk and disorderly.
Constable* R. M. Daly deposed : I arrested prisoner last night at 10 o'clock in Q.ueenstreefc. He was drank and fighting. Sentence d to a fine of 20)3. a?>d costs, or 48 hours' imprisonment.
IAECENY,
Joseph Smith was charged with having stolen, within the past thr- c months, various articles of furniture from Messrs. Winks and Hall, to the value of £50 or £100, and from Henry Probert furnishing wares to the value of £100.
On the request of Mr. Broham, the case was remanded till Monday.
MERCHANT SHIPPING ACT, 1854.
John B. Carey was charged with a breach of the above Act in destroying ship's stores on board the Schiehallion.
Mr. Ritchie . for the prosecution. Mr ■Bennett for the defence.
■ John Lee Black deposed : I -am master of the barque Schiehallion. I know the prisoner; he is an articled seaman. Articles produced. He was employed as cook; saw him yesterday on board at half past eight; he came to me requesting liis discharge, which I refused ; he said he would put me to the cost of £200 or £300 before he was done with me. It was reported to me by the mate that he had thrown Jungs overboard.
To Mr. Bennett: Do not recollect if he said he wanted to go ashore and see a magistrate. The present charge was not read over to him as he was dead drunk, but it was entered in the log book.
George Robertson deposed: lam a carpenter on board ; "was on board the vessel yesterday morning ; saw prisoner throwing over ship's stores, one wooden chopper belonging to the galley; it was between eight and nine in the morning; he looked aft and then forward to see if the coast was clear, remarking that Scotch people only saw with one eye. It was valued at 2s. I informed the mate.
To the Court : Prisoner was half drunk at the time. It was apparently done designedly.
Alexander Farquarson deposed : I am third mate on board the Schiehallion. I was on board yesterday morning working. A pudding tin and a potatoe masher came over the side. I was outside, under the fore rigging. I picked them up. Ido not know who threw them. -■ j :
David McPherson deposed : I am chief mate on board the Schiehallion. Remember the carpenter coming to me yesterday and telling me that the cook had hove the mS3her overboard. It might be worth 3s. Informed the captain what he had done.
To the Court : Ten minutes after this I observed him quite drunk.
Sentenced to seven days' imprisonment, with hard labour.
