BREACHES OF AWARD

Proceedings Against Hotel Licensee At the iS.M. Court, Akaroa yesterday, before Hr H. A. Young SjM. R. T. Bailey, Inspector of awards, proceeded against Robert Allan, Licensee of the Hotel Metropole, Akaroa, for the following alleged breaches of the award, under the N.Z. Licensed Hotel Employees Award. Plaintiff failed to pay rate of wages prescribed under the award, failed to pay overtime, to exhibit a time table of working hours for each employee, failed to exhibit the award, failed to keep a time and wages book, and a holiday book, for discharging Mrs Ward and failing to pay travelling expenses to enable her to return to town or place of engagement and dismissal of Mrs Ward from employ without notice under the award Mr K. G. Archer appeared for the Labour Department and Mr Holmes for Defentant. . Mr Bailey, in charge of the Labour Department, Christchurch, gave evidence that he , had visited the Hotel Metro,pole ; on December 16, 1935, with the inspector and had seen Mrs Allan and after questioning her had laid the informations. To Mr Archer—The Hotel Metropol'e was not rated as a country hotel under the award. The employees were working 56 hours per wek. To Mr Holmes —It was more essential to have a timetable in a small hotel rather than a larger one. Mr F. D. Lumsd'en, inspector of awards, Christchurch, gave corrobative evidence. Mrs H. H. Ward gave evidence that she was engaged as cook general by plaintiff from November 16th to November 25th 1935, and detailed the work performed. On November 25th she was dismissed and was not paid full- wages or travelling expenses She was paid the first weeks wages, but had signed no book. jS'he did. the cooking with Mrs Allan besides other work. Mr Archer asked for an amendment of claim of wages as cook at £2 6s Od per week, In regard to overtime plaintiff worked 7days per week and 12 hours per day, .but the claim was for 10

! hours per day only. If plaintiff was strong enough to be kept ten days she was entitled to wages and : notice of dismissal, and travelling expenses. Mrs K. P. Allen gave evidence She had engaged Mrs Ward from the labour office and she. was ill when she arrived and did notwork for two days. Plaintiff did no cooking, worked no overtime, and generally was incapable of work. She advanced 1 £1 15s, but did not pay the. sum as wages. She had been told at the Labour Department's office that the Hotel Metropole was rated as a country hotel under the award. She had a time and wages book. She had applied for a copy of the award in March or April, 1935, but could not obtain one from the Labour Department. She secured' a time, and wages book from the Department. In reply to Mr Bailey, witness said Mrs Ward was not in a fit state to work and she had told her so. The workers had not worked, more than eight hours per day. Evidence was also given by R. Allen, Mrs L. Kotlowski and L. Kotlowski. Judgement was given for plaintiff for 3s and 2s for breaches of the award and witnesses' expenses £3 7s 6d.. In the civil action H. H. Ward v. R, Allen judgement was given for £1 8s wages and costs £1 ss.
