Mr Bartholomew for applicants, Mr M 'Kean with Mr Ryan for objectors Evidence dealing with the abandonment was first taken and was of a most contradictory .nature. For the appltcants it was shown that the race was in a bad state of repair, had not been used for the past twelve months, and could not c-»rry water owing to being filled up and broken away. Evidence for the objector M'Carthy was a direct contradiction to that given in support of the application. Counsel having raised their contentions! the warden said that there was a great conflict of evidence as to the condition of the race, and he would visit and inspect the property himself in order to ascertain whether there had been any serious attempt to get water into the race. Regarding the other objectors, they were protected by the Act, and the granting of the application could have no effect on their rights. If their rights were interfered with in any way they had remedy in applying for an injunction. E. F. J. Terry and another, battery site, Ik acres, Conroy's Gully.—Adjourned till March Bth. James Rivers, water race, 2 heads from Shanty Creek. Certificate of abandonment in respect of License 1021 a asked for.—Adjourned till March Bth.
