The question as to when schnapps are not schnapps was settled by Mr. W. G. Riddell, S.M., in a. reserved judgment at the Magistrate's Court to-day (says the Wellington Evening Post 'of September 25). : The case was the one in which Frederick Dobson was charged with being, in possession of liquor, purporting to be Wolfe's Schnapps, to which a false trade description was applied. On analysis by Dr. McLaurin it was found that the contents of the bottle were much inferior to the liquor in a . bottle of' schnapps procured from a wholesale house for comparison. ■!■ It was also proved that the label on the bottle in question, was a registered J trade- . mark, and should have guaranteed that the bottle contained genuine schnapps-of a quality similar to that of the wholesale sample. The sergeant who procured the sample had been given it without 'remarks as -genuine Wolfe's Schnapps. His Worship held that defendant must be convicted, and he fined Dobson £Q. . Leave to appeal was granted. Mr. A. Gray appeared 'for the defendant.... ■-;. t - % - .-"..V. -.- : ,.■;-■■' - ?
