THE ELECTRICITY CONTROL ORDER 1945 Pursuant to the Supply Control Emergency Regulations 1939* and the Electricity Emergency Regulations 1939 f, the Electricity Controller doth hereby order and direct as follows : : . L'. •. Part I. — Preliminary 1. (1) This Order may be cited as the Electricity Control Order 1945. * ' ... _l. (2) This Order shall come into force on the seventh day following the day on which notification of the making thereof is published in the Gazette. 2. This Order shall operate only in the North Island of the Dominion of New Zealand. 3. (1) The Electricity Control Order 1943 J, the Electricity Control Order 1943, Amendment No. 1, the Electricity Control Order 1943, Amendment No. 2, and the Electricity Control Order 1943, Amendment No. 3, are hereby revoked. (2) All acts of authority that originated under the Electricity Control Order 1942, or under any of the Orders hereby revoked, and are subsisting or in force on the commencement of this Order shall enure for the purposes of this Order as if they had originated under this Order, and accordingly shall, where necessary, be deemed to have so originated. 4. In this Order, unless the context otherwise requires,— “ Community lighting ” means a system of road or street frontage lighting, principally by under-veranda lights, provided by a supply authority to meet the requirements of a shopping centre: “ Hospital ” includes any institution, private hospital, Or separate institution within the meaning of the Hospitals and Charitable " : Institutions Act, 1926 ; and also includes any Red Cross, Plunket, or first-aid rooms or other premises used by any organization for the purpose of giving medical or surgical advice or treatment: ; • ' * Statutory Regulations 1939, Serial number 1939/131, page 599. t Statutory Regulations 1939, Serial number 1939/149, page 664. “ Hours of darkness ” means — (a) Any period of time between half an hour after sunset , on one day and half an hour before sunrise on the next day ; or ( b ) Any other time when there is not sufficient daylight to render clearly visible a person or vehicle at a distance of 150 ft. : “ Public supply of electricity means any system of electric lines for the distribution of electricity which is connected whether directly or indirectly and whether continuously or not with any Government system of supply : “ Supply authority ” means the licensee in respect of a public supply of electricity : “ Theatre ” includes a cinematograph theatre : “ Utility sign ’’ means a sign indicating or giving the direction ,of an exit or entrance or any part of any premises.
Part II. — Space-heating 5. This Part of this Order shall apply to all premises of any of the following classes : - ! r (а) Shops, offices, factories, warehouses, and other business ' ; premises : (6) Public and private hotels : (c) Halls, theatres, and other places of amusement: (d) Premises occupied by any of His Majesty’s Naval, Military, or Air Forces, or by any other Armed Force that is for the , - time being lawfully present in New Zealand : (e) Premises occupied by any Government Department or office: : r Provided that this Part of this Order shall not apply to any hospital. 6. During the months of April, May, June, July, August, and September in any year no person shall, in any premises to which this Part of this Order applies, use or cause to be used any electric radiator or ; other electric space-heating appliance or equipment at any time between 4 p.m. and 6 p.m. on any day of the week except Sunday. •■''V'-Part lll.—Lighting 7. (1) Except as provided in this clause, no person shall at any time of the day or night use or cause to be used electricity from any public supply of electricity to operate any appliance or equipment for „ 7 (a) Exterior sign lighting : \ . , (b) Interior sign lighting other than utility sign lighting : (c) Interior or exterior outline or ornamental lighting : ( d) - Floodlighting any exterior part of any building : (e) Under-veranda lighting other than community lighting : (/) Community lighting, except on the statutory late night during the period between half an hour after sunset and 9 p.m. : ( g) Shop-window lighting in excess of an average of 10 watts for each foot of window frontage, or outside the period between half an hour after sunset and 9 p.m. on any day, or during that period at any time (except while the window is being dressed or cleared) after the shop is closed for the remainder of the day : (h) The interior lighting of island or wall or counter showcases : i ) The interior lighting of any theatre, concert-hall, dance-hall, cabaret, skating-rink, public or private hotel lounge, or hotel bar in excess of 60 watts for each 100 square feet of floor area in any case where the lighting appliance or equipment was in operation before the 27th day of May, 1943 (being the date of the commencement of the Electricity - Control Order 1943), or in excess of 40 watts for each 100 square feet of floor area in' any other case : . (j) The interior lighting of any shop, milk-bar, restaurant, or dining-room either in excess of 100 watts for each 100 square " feet of floor area or on any day at any time (except while persons employed on the premises are working overtime) after the shop, milk-bar, restaurant, or dining-room, as the case may be, is closed for the remainder of the day. (2) Nothing in subclause (1) of this clause shall apply to the use of electricity for—- . (a) The provision of such lighting as may be required for safety • . at any entrance or exit of any premises : ( b ) Under-veranda lighting (other than sign lighting) at any theatre, concert-hall, dance-hall, or cabaret either in excess of 1 watt for each square foot of area of the veranda or during the hours of darkness for the period of thirty minutes - - immediately before and the period of fifteen minutes immediately after any programme of entertainment. ; ?
(3) In any case where the enclosed portion of a shop is set back from the street frontage and the space between is occupied by shop windows, island windows, or other enclosed spaces separated by an aisle or aisles, either one, but only one, of the following systems of lighting may be employed, namely : (a) The shop windows, island windows, and enclosed spaces, or ■ any of them, may be lighted as if they were shop windows in accordance with paragraph ( g ) of subclause (1) of this
use; or ( b ) The whole or any part of the space between the enclosed portion of the shop and the street frontage may be lighted as if it were a shop interior in accordance with paragraph ( j ) ot the said subclause (1). 8. No person shall cause or permit the total number of units of electricity consumed during any month by any street-lighting system operated by any local authority or public body to exceed 80 per cent, of the total number of units consumed by that system during the corresponding month of the year 1940.
Part IV. Permits and Connections and Load Control 9. (1) Subject to any special directions given by the Electricity Controller, and subject to compliance with all .lawful requirements and conditions relating to the permit or installation, every supply authority shall issue a permit for every installation to which this clause applies, and when any such installation is duly completed shall connect the installation to its system of supply. (2) This clause shall apply to every electrical installation of any of the following classes : (a) Lighting, heating (other than space-heating), or power installations that are essential for the construction of any defence work, any hospital, any factory, workshop, or industrial plant for an industry that is essential to the prosecution of the war, any cool store or freezing-works, or any new v dwellinghouse, where in any such case no alternative to electricity is reasonably available : (b) Installations, either new or by way of extension, for the purpose of supplying lighting, heating (other than space-heating), or power in and for any defence work, any hospital, any factory, workshop, or industrial plant used for an industry that is essential to the prosecution of the war, or any cool store or freezing-works, where in any such case no alternative to electricity is reasonably available : (c) Installations in any new dwellinghouse that will be continuously occupied ; and, where no alternative to electricity is reasonably available, installations in any existing dwellinghouse or in any addition to an existing dwellinghouse : (d) Heating installations for manufacturing processes in any industry that is essential to the prosecution of the war, where no alternative to electricity is reasonably available : ( e ) Lighting, heating (other than space-heating), or power installations which, in the opinion of the supply authority,' will directly and economically increase primary production, where no alternative to electricity is reasonably available.
10. Notwithstanding anything to the contrary in any other enactment, order, or direction, but subject to the provisions of clause 9 hereof and to any special directions given by the Electricity Controller, no supply authority shall issue any permit for or connect to its system of supply any electrical installation (either new or by way of extension) of any of the following classes : (a) Lighting, heating, or 'power installations for constructional purposes or for any industry or undertaking : ( b ) Heating installations for any shop, office, hotel, public building, commercial building, or warehouse : (c) Installations for floodlighting any building : ( d ) Installations for community lighting or veranda lighting : (e) Installations for interior or exterior outline, ornamental, decorative, or advertising lighting.
11. (1) Every supply authority shall do all such things as may be necessary to control its load so as to keep it always within the limits from time to time directed by the Electricity Controller. (2) In controlling its load as aforesaid the supply authority shall act in accordance with all general or special directions given by the Electricity Controller, and, subject thereto, shall do all such things as it deems necessary to ensure that sufficient electricity is supplied for all essential lighting, heating (other than space-heating), and power installations for defence works, for hospitals, for factories, workshops, and industrial plants used for industries that are essential to the prosecution of the war, for cool stores and freezing-works, and for all installations used for farming purposes.

Part V. Enforcement 12. (1) Any person authorized in writing by the Electricity Controller or his delegate, or any constable, may, subject to the provisions of this Order, enter upon any premises, by force if need be, for the purpose of ascertaining whether or not the requirements of this Order are being complied with. (2) If any such person has reasonable ground for believing that any of such requirements are not being or have not been complied with he may, at the* expense of the owner or occupier, take all necessary steps to ensure adequate compliance with all such requirements, including, if he thinks fit, the disconnection or sealing-up of all equipment in the premises which does not comply with the requirements of this Order. 13. (1) The Electricity Controller hereby requires each supply authority to appoint as many suitable qualified persons as may be necessary to act under the authority of this Order to ensure that the provisions of this Order are complied with, and hereby delegates to every such supply authority the power to execute for each authorized person written evidence of his authority in the form set forth in the Schedule hereto. Every such authorization shall be signed by the appointee as well as by the. chief executive officer of the supply authority. (2) No such authorization shall entitle the person so authorized to enter (a) Any dwellinghouse, flat, apartment, or boardinghouse : (b) Any place where the public is not entitled to enter without the prior permission of the police or of defence- or other authorities. (3) Every supply authority shall make provision for the safe custody, and for the surrender when no longer necessary, of each authority issued by him. 14. Every person (other than a constable) purporting to enter upon premises under the authority of this Order shall, if required so to do by the owner or occupier of the premises concerned or by any other responsible person, produce (before proceeding to exercise his authority) evidence of his identity and written evidence of his authority to act under this Order. 15. (1) Every supply authority shall ensure that at all times its chief executive officer or some other executive officer is immediately available to receive and give effect to all directions given by the Electricity Controller to the supply authority. . (2) The Electricity Controller hereby delegates to the chief executive officer of every supply authority and to every other executive officer for the time being acting under subclause (1) of this clause such of the Controller’s powers and functions as may be required to enable those executive officers to comply with, enforce, and give effect to the provisions of this Order and any directions given by the Controller, including the power of delegation, and including in particular the power to select, as between the installations of different consumers or groups or classes of consumers and as between installations or groups or classes of installations in different parts of the supply authority’s area of supply, which of them shall be disconnected and in what order and for what periods.
