REGULATION UNDER THE REGULATIONS ACT, 1936.

THE UNITED STATES FORCES EMERGENCY REGULATIONS 1943

C. L. N. NEWALL, Governor-General. ORDER IN COUNCIL. At the Government House at Wellington, this 7th day of April, 1943.

Present : His Excellency the Governor-General in Council. Pursuant to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS. 1. These regulations may be cited as the United States Forces Emergency Regulations 1943.

Interpretation. 2. In these regulations, unless the context otherwise requires,— “ Home forces ” means the naval, military, and air forces of His Majesty raised in New Zealand ; and “ home force ” means any body, contingent, or detachment of any of the home forces:

“Member”, in relation to any United States force, includes a member of any other United States force who is attached to the first-mentioned force:

“ Service authorities ” means naval, military, and (in relation to the home forces) air force authorities : “ Service court ” means a naval, military, or (in relation to the home forces) air force court; and includes a service court of inquiry, and any officer who is empowered to review the proceedings of a service court, or to investigate charges, or himself to .dispose of charges; and the expression “ sentence ” shall be construed accordingly : “ United States force ” means any body, contingent, or detachment of the military or naval forces of the United States of America (including the air arms of those forces). 3. (1) For the purposes of these regulations all persons who are by the law of the United States of America for the time being subject to the military or naval law of that country shall be deemed to be members of a United States force : Provided that no person employed in connection with any of the United States forces, not being a citizen or national of the United States of America, shall be deemed to be a member of any of the United States forces unless he entered into that employment outside New Zealand. (2) For the purposes of any proceedings in any New Zealand court a certificate issued by or on behalf of such authority as may be appointed for the purpose by the Government of the United States of America stating that a person of the name and description specified in the certificate is, or was at a time so specified, subject to the military or naval law of the United States of America shall be conclusive evidence of that fact. (3) For the purposes of any proceedings in any New Zealand court in which the question is raised whether a party to the proceedings is or was at any time a member of any of the United States forces, any such certificate as aforesaid relating to a person bearing the name in which that party is charged or appears in the proceedings shall, unless the contrary is proved, be deemed to relate to that party. (4) Any document purporting to be a certificate issued for the purposes of this regulation and to be signed by or on behalf of an authority described as appointed by the Government of the United States of America for the purposes of this regulation shall be received in evidence and shall, unless the contrary is proved, be deemed to be a certificate issued by or on behalf of an authority so appointed.

Law applicable to United States Forces.

4. Where any United States force is present in New Zealand or on board any of His Majesty’s New Zealand ships or aircraft, the service courts and service authorities of the United States of America may, subject to the provisions of these regulations, exercise within New Zealand or on board any such ship or aircraft in relation to members of that force, in matters concerning discipline and internal administration, all such powers as are conferred upon them by the law of the United States of America.

Jurisdiction op New Zealand Courts.

5. (1) Subject as hereinafter provided, no criminal proceedings shall be prosecuted in New Zealand before any New Zealand court against a member of any of the United States forces : Provided that, upon representations made to him on behalf of the Government of the United States of America with respect to any particular case, the Minister of Justice may direct that the provisions of this subclause shall not apply in that case. (2) Subclause (1) of this regulation shall not affect any powers of arrest, search, entry, or custody exercisable under the law of New Zealand with respect to offences committed or believed or suspected to have been committed against that law, but where a person against whom proceedings cannot, by virtue of that subclause, be prosecuted before a New Zealand court is in the custody of any New Zealand authority, he shall, in accordance with such general or special directions as may be given by or under the authority of the Minister of Justice for the purpose of giving effect to any arrangements made by His Majesty’s Government in New Zealand with the Government of the United States of America, be delivered into the custody of the appropriate authorities of the United States forces.

(3) Nothing in these regulations shall render any person subject to any liability, whether civil or criminal, in respect of anything done by him to any member of any of the United States forces in good faith and without knowledge that he was a member of those forces. 6. No proceedings in respect of . the pay, terms of service, or discharge of a member of any United States force shall be entertained by any New Zealand court.

Handing-over of Offenders to United States Authorities.

7. For the purpose of enabling the service courts and service authorities of the United States of America to exercise their powers more effectively, the Minister of Justice, if so requested by the officer commanding any United States force or by the Government of the United States of America, may from time to time, by general or special orders, authorize the arrest and custody of members of any of the United States forces alleged to have been guilty of offences punishable under the law of the United States of America, and the handing-over of any such persons to the appropriate authorities of the United States forces.

Evidence before Service Courts

8. (1) A member of any home force may be ordered by any officer having authority over him to attend before any service court of the United States of America to give evidence and produce documents.

(2) For the purposes of the trial of a member of any United States force by any service court of the United States of America, the Clerk or any Deputy Clerk of any Magistrate’s Court (not'being also a constable), if so requested by any officer of any United States force, may summon any person who is not for the time being rendering full-time service as a member of any home force to attend before the service court to give evidence and produce documents. (3) If any person so summoned neglects or refuses to attend at the time and place appointed by the summons and no just excuse is offered for such neglect or refusal, any such Clerk or Deputy Clerk, if he is satisfied that the summons has been duly served on that person and that a reasonable sum was paid or tendered to him for the expenses of his attendance, may issue a warrant for bringing that person before the service court, at a time and place to be mentioned in the warrant, to give evidence and produce documents. (4) If any such Clerk or Deputy Clerk is satisfied that any person required to attend before any such service court as aforesaid will not attend without being compelled to do so, he may, instead of issuing a summons, issue a warrant in the first instance for bringing that person before the service court, at a time and place to be mentioned in the warrant, to give evidence and produce documents. (5) Any summons issued under this regulation may be served by a constable, by delivering it to the person to whom it is directed personally, or by leaving it for him at his last or most usual place of abode with some inmate of the house appearing to be above the age of fourteen years.

(6) Any warrant issued under this regulation may be directed either to any constable or other person by name, or generally to the constables of New Zealand, or of any division thereof, and may be executed as if it were issued under the Justices of the Peace Act, 1927.*

(7) Every person shall be liable on summary conviction before a, Magistrate to a fine not exceeding £50 A who has been lawfully ordered or summoned to attend before a service court of the United States of America in pursuance of this regulation to give evidence or produce documents and (in the case of a summons) has been paid or tendered the reasonable expenses of his attendance, or who is before the court, and who without just cause (proof whereof shall lie upon him) — (a) Disobeys the order or summons so to attend ; or

( b Refuses to be sworn as a witness ; or (c) Refuses or fails to answer any question relevant to the matter before the court which he is required by the court to answer; or

(d) Refuses or fails to produce any document relevant to the matter before the court which he is required by the court to produce.

(8) Every proceeding that is held before any service court of the United States of America shall be deemed to be a judicial proceeding within the meaning of section 130 of the Crimes Act, 1908 f (which relates to perjury).

Contempt of Court

9. Every person shall be liable on summary conviction before a Magistrate to a fine not exceeding £SO in the case of an individual or £2OO in the case of a company or other corporation who wilfully interrupts or disturbs the proceedings of a service court of the United States of America, or uses insulting language or behaviour towards the court or any member thereof, or who by writing or speech uses words calculated to improperly influence the court or any member thereof or any witness before the court.

Immunities and Privileges op Service Courts and Witnesses

10. The members of any service court of the United States of America exercising jurisdiction in accordance with these regulations, and witnesses appearing before any such court, shall enjoy the like immunities and privileges as are enjoyed by the members of a service court of New Zealand, and by witnesses appearing before such a court.

Validity of Sentences of Service Courts.

11. (1) Where any sentence has, whether within New Zealand or elsewhere, been passed upon a member of any United States force by a service court of the United States of America, then for the purposes of any legal proceedings before- a New Zealand court that service court shall be deemed to have been properly constituted, and its proceedings shall be deemed to have been regularly conducted, and the sentence shall be deemed to be within the jurisdiction of the service court and in accordance with the law of the United States of America, and, if executed according to the tenor thereof, shall be deemed to have been lawfully executed, and any member of a United States force who is detained in custody in pursuance of any such sentence, or pending the determination by such a service court as aforesaid of a charge brought against him, or pending any preliminary examination by the service authorities of the United States of America, shall for the purposes of any such proceedings as aforesaid be deemed to be jn lawful custody. (2) For the purposes of any such proceedings as aforesaid a certificate under the hand of the officer commanding any United States force stating — (a) That a sentence specified in the certificate has been passed upon a person of the name and description so specified by a service court of the United States of America : or ( b) That a person of the name and description specified in the certificate is or was at any time so specified detained in custody in pursuance of any such sentence or pending any such determination or preliminary examination as aforesaid — shall be conclusive evidence of the facts stated therein, and any document purporting to be such a certificate and to be signed by such an officer shall be received in evidence and shall, unless the contrary is proved, be deemed to be a certificate so signed.

Detention or Imprisonment.

12. (1) Any member of a United States force, if sentenced by a service court of the United States of America to any form of imprisonment or detention, may, under the authority of the Minister of Justice, given at the request of the officer commanding the United States force, be temporarily detained in custody in a prison or detention barracks in New Zealand, or may under the like authority be imprisoned or detained during the whole or any part of the term of his sentence in a prison or detention barracks in New Zealand. (2) The Minister of Justice' may make arrangements with the service authorities of the United States of America with respect to the reception from those authorities of persons who are to be detained or imprisoned as aforesaid and their return to those authorities, and with respect to the circumstances under which any such persons are to be released. (3) The provisions of any enactment relating to the treatment of persons serving sentences of imprisonment in prisons in New Zealand and the manner in which they are to be dealt with in the event of their unsoundness of mind shall apply to any person detained or imprisoned in a prison in New Zealand under this regulation in like manner, as if he were a person sentenced to imprisonment by a New Zealand court for the term of the sentence imposed on him by the service court.

(4) The provisions of any enactment or orders relating to the treatment of members of the home forces detained in detention barracks in New Zealand and the manner in which they are to be dealt with in the event of their unsoundness of mind shall apply in like manner to persons detained in detention barracks in New Zealand under this regulation. - (5) Any costs incurred in the maintenance and return of, or otherwise in connection with, any person dealt with in accordance with the provisions of this regulation shall be defrayed in such manner as may with the approval of the Minister of Finance be agreed between the Minister of Justice and the Government of the United States of America.

Exercise of Functions in relation to United States Forces.

13. (1) Any Government Department, Minister of the Crown, or other person in New Zealand may perform, at the request of the officer commanding any United States force, any function in relation to that force and members thereof which that Department, Minister, or person performs or could perform in relation to a home force of like nature to the United States force or in relation to members of such a force, and for the purpose of the exercise of any such function any power exercisable by virtue of any enactment by the Department, Minister, or person in relation to a home force or members thereof shall be exercisable by it or him in relation to the United States force and members thereof:

Provided that nothing in this subclause shall authorize interference with the United States force in matters relating to discipline or to the internal administration of the force.

(2) For the purposes of this regulation the Naval Board of New Zealand, the Army Board, and the Air Board shall be deemed to be Government Departments.

Application of Enactments to United States Forces. 14. Any enactment in force in New Zealand which—(a) Exempts or provides for the exemption of any vessel, vehicle, aircraft, machine, or apparatus of or employed for the purposes of the. home forces or any of them from the operation of any enactment; or ( b) In virtue of a connection with the home forces or any of them, confers a privilege or immunity on any person ; or

- (c) In virtue of such a connection, excepts any property, trade, or business in whole or in part from the operation of any enactment, or from any tax, rate, imposition, toll, or charge ; or (d) Imposes upon any person or undertaking obligations in relation to the home forces or any of them or any member or service court thereof; or (e) Penalizes misconduct by any person in relation to the home forces or any of them or any member or service court thereof, — shall, with any necessary modifications, apply in relation to any United States force as it would apply in relation to a home force of a like nature to the United States force.

15. All members of any United States force shall be exempt from the provisions of the Aliens Emergency Regulations 1940.* 16. Nothing in the Coroners Act, 1908$, or in the Births and Deaths Registration Act, 1924 J, shall apply with respect to the death or burial of any member of any United States force: Provided that any Coroner, if so requested by the officer commanding any United States force, may hold an inquest under the Coroners Act, 1908, touching the death of any member of that force. 17. Where either of the persons intending marriage is a member of any United States force, a certificate of marriage shall not be issued by any Registrar under the Marriage Act, 1908,§ except upon production of a written approval of the intended marriage given by the Senior Commander of the United States forces stationed in New Zealand.

18. (1) These regulations shall be in force in the Cook Islands and Western Samoa.

(2) The Dependency Emergency Regulations (No. 2) 1939|| shall apply to these regulations.
