THE TAXICAB REGULATIONS 1939, AMENDMENT NO. 1.

C. L. N. NEWALL, Governor-General. ORDER IN COUNCIL. At the Government House at Wellington, this 12th day of March, 1941. Present: His Excellency the Governor-General in Council. Pursuant to the Transport Licensing Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS. 1. These regulations may be cited as the Taxicab Regulations 1939, Amendment No. 1. 2. These regulations shall be read together with and form part of the Taxicab Regulations 1939* (hereinafter called the principal regulations). 3. Regulation 8 of the principal regulations is amended by adding thereto the following clause : “ (5) Notwithstanding anything hereinbefore contained to the contrary, the whole or any portion of any fee payable under these regulations may, on the certificate of the Commissioner, be refunded or remitted on any of the following grounds, namely:— “ (a) That the application in respect of which the fee is payable has been withdrawn, or that other action in respect of the application has been nullified or curtailed, and that in consequence the work and expense of the Department or Minister or Authority has been reduced to an extent justifying the refund or remission : or * Statutory Regulations 1939, Seria number 1939/218, page 875.

“( b That the passenger-service or the vehicle in respect of which the fee is payable is used for only the occasional carriage of passengers, or is used for the carriage of passengers to such a limited extent that the full fee payable under these regulations would be disproportionate having regard to the amount of the passenger business ; or “ (c) That the licensee has paid fees to a local authority on account of a vehicle for a period which corresponds wholly or in part to the period of a license for use of the vehicle issued in terms of the principal Act.” 4. The principal regulations are amended by inserting, next after Regulation 9 thereof, the following additional regulation : “10. (1) Every person who—- “ (a) Knowingly supplies any false or misleading information in or concerning any application made in terms of these regulations ; or “ (6) Omits or refuses to supply any information herein required,— commits a breach of these regulations* “ (2) Every person who—- “ i a ) Fails to comply with any condition, duty, or obligation imposed by these regulations, or imposed in any license under these regulations ; or “ (6) Offends against or fails to comply with or otherwise commits or permits a breach of any of these regulations,— shall be liable for every such breach to a fine not exceeding £10.” 5. The form numbered T.L. 30 in the Second Schedule to the principal regulations is amended by deleting the words “ vehicle authorities ” therein, and substituting the words “ cab authorities ”. C. A.
