MISCELLANEOUS INFORMATION.

Circular No. 1/1940.] Transport Law Amendment Act, 1939. The attention of all members of the Force is directed to sections 5,6, 7, and 8 of the Transport Law Amendment Act, 1939. Whenever a person arrested by a Constable or Traffic Inspector for being in charge of a motor-vehicle while in a state of intoxication is brought to a Police-station the following provisions are to apply : (1) The Police shall immediately call a doctor to examine the arrested person. This will not be necessary in cases where a Traffic Inspector has had the driver medically examined before bringing him to the Police-station. In any such case the Traffic Inspector will leave the medical certificate with the Police. (2) The doctor shall submit his report on the form provided for that purpose. (3) Should the arrested person refuse to submit to examination, the doctor should state such fact on the medical report form together with such opinion as, in the circumstances, he may be able to form of the arrested person’s condition. No pressure must be used to compel submission to examination. (4) Should the arrested person insist on calling his own doctor, the Police shall call the doctor desired. In any such case the person who requests the examination is to be given to understand clearly that he will be responsible for the fee of the doctor whom he calls, and the doctor when being called is to be informed that his attendance is required by the arrested person, who is solely. responsible for the fee. Any admission by the accused to his doctor in answer to questions by the latter for the purpose of his examination must not be used as evidence on the charge. (5) If the officer or other member of the Force in charge has doubt as to the propriety of locking up the arrested person, the charge must be entered in the charge-book and signed by the person making the arrest. The arrested person should then be released on bail in his own recognizance conditioned for his appearance at Court on the day on which he would have first appeared had he been locked up. (6) In all cases where an intoxicated motorist has been arrested by a Traffic Inspector, the Police will lay the information and conduct the prosecution. Should the information be dismissed, the doctor’s fee will be paid by the Transport Department. In such cases a voucher should be prepared and submitted to that Department for payment. (7) Should a doctor certify that an arrested motorist is not in a state of intoxication and in consequence it is not intended to call the doctor as a witness for the prosecution, the accused or his counsel should be informed at the earliest opportunity of the contents of the medical report and of the intention of the prosecution in regard to the medical witness. If the accused is not represented by counsel, the information contained in the medical report should be conveyed to the Court by the prosecutor. Traffic Inspectors have been instructed by the Transport Department that any motorist arrested by them must be taken to a Police-station at which a member of the Force is present to receive the prisoner. It is to be observed that section 8 of the Amendment is capable of wider application than the repealed subsection (2) of section 28 of the principal Act. It would now seem that, provided there are reasonable and probable grounds for believing that an offence involving intoxication has been committed, the offender may be arrested without warrant notwithstanding that a considerable time has elapsed since the commission of the offence. In so far as section 8 has application to section 28, the Police must not depart from the practice hitherto prevailing. An alleged intoxicated motorist should be arrested only when he is found intoxicated in charge or when, there being evidence of his having recently been in charge of a motor-vehicle while in a state of intoxication, he is found while still showing signs of intoxication. In cases where intoxication only is involved a person must not be taken from his home. It may be that he would consent to be examined at his home by a doctor called by the Police. Pressure should not be used to obtain consent. In such cases the alleged offender can, if the evidence is considered sufficient, be brought up on summons.
