Memorandum.] / Offenders Released on Probation under the Provisions of the Offenders Probation Act, 1920. Section 14, Offenders Probation Act, 1920, provides for the arrest without warrant of any person who commits a breach of the conditions of his probationary license, and, therefore, he is liable to be charged with such breach at any time within six months after the period of his probation has expired. If, however, under the conditions of his probationary license, he is required to pay any moneys his probationary license remains in force until such moneys have been paid (Offenders Probation Amendment Act, 1930, section 4 (2)). If no conditions requiring him to pay any moneys have been imposed by the Court, and it appears possible that he will not be located within six months after the expiration of his period of probation, an information should be laid charging him with the offence. When a Probation Officer reports to the police that he desires the arrest of a person for a breach of his probation the police should insist on the Probation Officer giving in writing the full details, including the original charge on which he was released, whether or not any moneys were ordered by the Court to be paid, and, if any money was ordered by the Court to be paid, whether or not such money or any portion thereof remains unpaid, and the date on which his probationary license expires. These particulars should be entered on all crime reports forwarded for publication in the Police Gazette in regard to defaulting probationers. W. G. Wohlmann, Commissioner of Police. Referring to memorandum in the above regard, dated 13th November (Police Gazette, 1935, page 684), the Government Statistician now advises that it has been decided the remuneration, per schedule collected, will be 3d. instead of the amount indicated in the above-mentioned memorandum.
