W. G. Wohlmann, Commissioner of Police. Wellington, 22nd May, 1934. —/j (P. 30/360.) Memorandum.]

Sly-grog Selling.—Breaches of Licensing Acts, being also Breaches of Part 111, Finance Act, 1915.

In all cases where offences are disclosed under the Licensing Acts which are also offences or breaches under Part 111 of the Finance Act, 1915, the nearest Collector of Customs is to be informed in writing of the facts and afforded an opportunity of considering whether an information should be laid under the latter Act under which the minimum penalty is more severe than under the Licensing Acts. If the Collector of Customs desires to take proceedings under the Finance Act the Police are to co-operate. Any action initiated by the Customs Department, however, is not to be regarded as in substitution of any proceedings the Police consider should be taken under the Licensing Acts. If thought desirable, informations may be laid under both statutes. W. G. Wohlmann, Commissioner of Police. Wellington, 15th May, 1934. (P. 33/416.)
