Memorandum.] Service of Civil Summonses by Post. The following copy of a circular issued to Stipendiary Magistrates by the Under-Secretary, Justice Department, relative to the service of civil summonses by post, is published for the information of members of the Force. Department of Justice, Wellington, 23rd March, 1928. J. 1927/821.] Circular No. 125.] Memorandum for Stipendiary Magistrates.] Service of Civil Processes by Registered Letter. Provision having been made by section 4 of the Magistrates’ Courts Amendment Act, 1927, for the service of civil summonses and other processes by registered letter, I am directed by the Minister to request Magistrates to instruct Clerks of Courts that such method of service shall be adopted in all cases where the person to be served resides at such a distance that the mileage, if service were effected by a Bailiff or Constable, would exceed 4s. The procedure in such cases shall be as follows : The Clerk of Court issuing such process, or an officer acting by and under his direction, will enclose the process in a registered letter which should show the addressee’s full name and address, and, if possible, the number of the house in which the addressee resides. Great care must be taken to see that processes are placed in the correct envelopes. Registered letters containing civil processes must be delivered to the addressee only, otherwise the service is bad. Special envelopes superscribed “To be delivered to addressee only,” are being printed. No envelope containing a civil process must be posted without such superscription. Stamps to the value of 6£d. must be affixed to each letter to cover the cost of postage, registration, and of the fee for receipt (advice of delivery) from the person to whom the letter is addressed. To enable the acknowledgment card (or letter) to be readily identified when it is returned, the plaint number should be marked on the card and also on the envelope. It should be shown thus : “ No. / ” (the word “ Plaint ” must not be used). It is suggested that summonses be posted at least twenty-one days before the date of hearing, to avoid the possibility of short service. Where a letter is marked “ Not called for ” a fresh letter may he posted as previously, or service may be effected by the Bailiff if the Stipendiary Magistrate considers advisable. The scale of fees has been amended to provide for a fee of 2s. where service is to be effected by registered letter. Where it becomes necessary to post a summons more than once, no extra Court fee is to be charged. A special form of affidavit of service is being printed. This form may be affixed to the back of the Court copy of summons when service has been effected by post. No voucher for the service after the Ist day of April, 1928, of a civil process will be passed for payment where- the amount claimed exceeds 45., unless the special reasons for such service are set out and certified by a Magistrate. Under no,circumstances may home mileages exceeding 4s. be paid to the Bailiff in cash. Home mileages above 4s. must be treated in the same manner as foreign mileages. These instructions have no application to judgment summonses or orders thereon, or to any summons for the recovery of tenements. This circular shall come into force on the Ist day of April, 1928.
