Mackenzie v. Whittingham. (“ New Zealand Law Reports,” Vol. xxiv., p. 620.) Statute Amendment Act, 1895," Section 33, Subsection 6—Prohibited District —Sale of Liquor to be delivered beyond District.

§3223 A brewer carrying on his business in a no-license district, who, on a sale of liquor of his own manufacture, at the request of a purchaser at the time of sale, undertakes

to hand the liquor to a person who undertakes to deliver it outside such district, sells the liquor to be delivered “ beyond the limits of such district,” and comes within subsection 6 of section 33 of “ The Alcoholic Liquors Sale Control Aot 1893 Amendment Act, 1895.” Appeal from the decision of G. Cruickshank, Esq., S.M., at Gore. The facts are sufficiently stated in the judgment. T. M. Macdo?iald, for the appellant. J. S. Neave, for the^respondent. Cur. adv. vult. Denniston, J.: — The respondent is oharged on this information with having sold liquor within the District of Mataura, which is what is known as a “ prohibited district,” contrary to section 33, subsection 6, of ‘‘The Alcoholic Sale Control Act 1893 Amendment Act, 1895.”

The respondent is a brewer carrying on his business at Gore, in the District of Mataura. One Christian Lange wrote requesting him to “ forward one 5-gallon keg of beer by to-morrow’s midday train.” This letter was received by respondent at his brewery in Gore the following day. Immediately upon its receipt the respondent replied, “ Your kind order, viz., 5 gallons beer, duly to hand. Have forwarded as instructed, and hope you will receive the same in good order and condition.” The respondent immediately sent a 5-gallon keg of beer from the brewery to the Gore Railway-station for the midday train. The keg was addressed “C. Lange, Esq., Pukerau.” The defendant made out a consignment note addressed to the Stationmaster at Gore, headed, “ Receive herewith the undermentioned goods for transmission to the consignee, according to particulars stated below and subject to the conditions referred to on the back hereof, by which I agree to be bound in all respects.” Under the heading ‘‘Consignee’s Name and Address” are the words “ C. (Lange, Pukerau.” There is a footnote “ Carriage paid by consignee.” Lange resides and carries on business in Pukerau, which is in the District of Clutha. He does not carry on business within the District of Mataura. He paid the freight and received the beer.

In MacKenzie v. Whittingham (23 N.Z. L.R. 857) I held that in the case of a general request to forward unascertained goods the sale is not completed until unconditional appropriation of specific goods to meet the contract, with the express or implied consent of the purchaser ; and that, in the absense of anything giving authority to the vendor to act as the purchaser’s agent in making such appropriation, the sale was not completed till the unconditional delivery to a carrier for the purpose of transmission to the buyer. (“ The Sale of Goods Aot, 1895,” section 20, rule 5, subsection 2.) Assuming the delivery in the present case to the railway authorities to be an unconditional delivery to a carrier for the purpose of transmission to the buyer, without any reservation of the right of disposal, the sale was in Gore. In MacKenzie v. Whittingham (23 N.Z. L.R. 857) I held there was such an unconditional delivery. If that be so in the present case there would be, in the absence of any further provision, a sale in a prohibited district. But subsection 6 of section 33 of “ The Alcoholic Liquors Sale Control Aot 1893 Amendment Act,

1895,” provides that the section “ shall not apply to sales by brewers of liquor, being their own manufacture, to persons not residing or carrying on business within such district, and to be delivered beyond the limits of such district.” What is the meaning of “a sale of liquor to be delivered beyond the district in which such sale takes place ” ? Assuming the delivery to be unconditional within the meaning of the words I have quoted from the Sale of Goods Aot, so as to constitute a complete sale, so as to pass the entire property in the goods to the purchaser, and therefore to throw on him the risk of their loss in transit, in my opinion they are not therefore necessarily sold to be delivered within the district. The vendor undertakes, as part of the contract, to forward the goods by rail to a point outside the district. In so doing he is, I think, the agent of the purchaser. In Filshie v. Evington ([1892] 2 Q.B. 200), the question was, what was “the place of delivery” of certain milk within section 3 of “The Sale of Poods and Drugs Act Amendment Aot, 1879 ” ? The vendor had there undertaken to deliver the milk at the place where it was seized. The Court held that, notwithstanding the fact that the contract provided the purchaser was to pay for the carriage, it was the vendor’s duty to deliver, and nondelivery in terms of the contract would be an answer to an action for the price. In that case it could not be said that the vendor was merely the agent of the purchaser in the delivery. Nor was it, I think, necessary to decide this question, as both parties had agreed on a place of delivery, which would, I think, clearly he the place of delivery within the Act Subsection 6 of section 33 obviously contemplates a sale in one district for delivery in another. A sale is something which passes the property in the thing sold. The delivery beyond the district where the sale is made, spoken of in the section, must refer to actual physical delivery at a given spot, and not to the mere delivery as a step in the actual transit. The mischief aimed at is the receipt of liquor by a purchaser within a prohibited district. A vendor who, at the request of the purchaser at the time of the sale, undertakes to hand the liquor sold to a person who undertakes to deliver it outside the district in my opinion sells it “to be delivered beyond the limits of such district.” The suggestion that, if the property in the liquor passes absolutely to the purchaser by delivery to the railway authorities, he can obtain it from them while it is still within the prohibited district is entirely fanciful. I doubt whether the railway authorities would be justified in so giving up goods intrusted to them under a contract to deliver at a certain place. In practice they certainly would not do so. In any case the goods would still have been sold for delivery beyond the district. The suggested case of delivery to a carrier or servant of the purchaser and under his control can be dealt with should it arise. It is not the present case. If the case is governed by Filshie v. Evington ([1892] 2 Q.B. 200), then the delivery is equally outside the district, though in that case a question might arise as to the place of sale. The appeal will be dismissed. Being a police prosecution, the usual rule must be followed as to costs.
