Regulations for Trout-fishing, Auckland Acclimatisation

District. RANFURLY, Governor. ORDER IN COUNCIL

At the Government Buildings, at Wellington, this eighteenth day of September, 1903. Present:

The Right Honourable R. J. Seddon presiding in Council. IN pursuance of the powers and authorities vested in him by “ The Fisheries Conservation Act, 1884,” and the Acts amending the same (hereinafter called “the said Acts”), His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for all that part of the colony known as “the Auckland Acclimatisation District,” as the same is defined in the said regulations, and the waters thereof; and doth hereby declare that these regulations shall, as from the date of publication thereof in the New Zealand Gazette, supersede all regulations at variance therewith.

Regulations,

1. Licenses to fish for trout in all waters within that district or part of the North Island known as “the Auckland Acclimatisation District,” which includes the Counties of Rodney, Waitemata, Eden, Manukau, Coromandel, Thames, Ohinemuri, Raglan, Waikato, Waipa, Piako, Rotorua, Kawhia, and Taupo West, shall be issued under the hand of the secretary of the Auckland Acclimatisation Society (hereinafter termed “the said society”), or anyone authorised by the said secretary in that behalf, and such license shall entitle the person named therein to fish in every acclimatisation district from the first day of October in any one year to the fifteenth day of April in the year following, subject to the said Acts, and any special regulations made thereunder in force in any such district affecting any particular stream, river, or water therein : Provided that the secretary may refuse to issue a license to any person who within the previous two years has been convicted of any breach of the provisions of any Act relating to fishing for trout, or any regulations made thereunder. 2. Licenses available in any acclimatisation district throughout New Zealand may be issued at the following rates :

Licenses for men : Twenty shillings for the whole season; five shillings for one month; and two shillings and sixpence for one week. Licenses for women, and for boys attending school or under the age of sixteen years: Ten shillings for the whole season; three shillings for one month; or one shilling and sixpence for one week. 3. Any holder of a iicense may fish with rod and line for trout, and may use a landing-net or gaff to secure any trout caught with such rod and line, from the first day of October in any one year to the fifteenth day of April in the year following, both inclusive. 4. No license shall authorise any person other than the person named therein to fish, and that with natural or artificial fly, insect, worm, or fish only.

5. No person shall have in his possession any of the Salmonidce or trout between the eighteenth day of April and the thirtieth day of September, which period is hereby appointed a close season for all such fish: Provided always that this regulation shall not apply to fish caught by the officers of the said society for purposes of acclimatisation. 6. No person shall put, throw, or place, or allow to he put, thrown, or placed, into any river or stream, or at the mouth or entrance of any such river or stream, any dynamite or other explosive substance, or any sawdust or sawmill refuse, or refuse from a flax-mill, or anything of any kind or description whatever poisonous, deleterious, or noxious to fish.

7. No person shall fish for trout without a license ; and every person fishing shall, on demand of any Ranger, constable, member of the said society, or person producing a license, produce and show to such Ranger, member, constable, or person his license, and the contents of his creel or bag, and the bait used by him for taking, catching, or killing such trout.

8. Every trout not exceeding 9 in. in length from nose to tip of tail taken or caught by any person shall immediately be returned alive into the v'ater from which the same is taken.

9. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout; nor shall any of the above-men-tioned baits be used with any medicated or chemical preparation whatever.

10. Except as aforesaid, no person shall fish with or use any net or other engine, instrument, or device for taking fish in any river or stream within the district aforesaid, or at the mouth or entrance of any such river or stream. 11. For the purposes of these regulations, the mouth of every such river or stream shall be deemed to include every outlet of the same and the sea-shore between such outlets, and shall extend over a radius of one-quarter of a mile from the point or line where the waters of such river or stream meet those of the sea or of any harbour at low water. 12. No person shall buy, sell, or expose or offer for sale, or shall fish for the purpose of obtaining for sale, any trout, or any part thereof. 13. The penalty for the breach of any of these regulations shall not be less than forty shillings or more than fifty pounds. 14. If any person shall be convicted of any offence against these regulations the license (if any) held by the offender shall thereupon become void.

Regulations (Amended) for Trout and Perch Fishing, Grey

District Acclimatisation District. RANFURLY. Governor ORDER IN COUNCIL

IN pursuance of the powers and authorities vested in him by “ The Fisheries Conservation Act, 1884,” and the Acts amending the same (hereinafter called “ the said Acts”), His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for the Grey District Acclimatisation District and the waters thereof, and doth hereby declare that these regulations shall, as from the date of the publication thereof in the Neiv Zealand Gazette, supersede all regulations for the said district at variance therewith.

Regulations,

1. Licenses to fish for trout and perch in all waters within that district or part of the South Island known as the Grey District Acclimatisation District, comprising the County of Grey, may be issued under the hand of the secretary of the Grey District Acclimatisation Society (hereinafter termed “the said society”), or any one authorised by the said secretary in that behalf, and such license shall entitle the person named therein to fish in every acclimatisation district from the first day of October in any one year to the fifteenth day of April in the year following, subject to the said Acts, and any special regulations made thereunder in force in any such district affecting any particular stream, river, or water therein: Provided that the secretary may refuse to issue a license to any person who within the previous two years has been convicted of any breach of the provisions of any Act relating to fishing for trout or perch, or of any regulation made thereunder. 2. Licenses available in any acclimatisation district throughout New Zealand may be issued at the following rates :

Licenses for men: Twenty shillings for the whole season ; five shillings for one month; and two shillings and sixpence for one week. No person shall have in his possession any of the salmonidieor trout between the eighteenth day of April and the thirtieth day of September in any year, which period is hereby appointed a close season for all such fish : Provided always that this regulation shall not apply to fish caught by the officers of the said society for purposes of acclimatisation.

6. No person shall put, throw, or place, or allow to be put, thrown, or placed, into any river or stream, or at the mouth or entrance of any such river or stream, any dynamite or other explosive substance, or any sawdust or sawmill refuse, or anything of any kind or description whatever poisonous, deleterious, or noxious to fish.

7. No person shall take, fish for, catch, or kill, in any maimer whatever, or have in his possession, any salmon, salmon-parr, or smolts, or the ova, young, or fry of any salmon in any stage whatever ; and any of the above-named taken by accident or otherwise shall immediately be returned alive into the water from which the same is taken.

8. No person shall fish for trout or perch without a license, and every person fishing shall, on the demand of any Ranger, constable, member of the said society, or person producing a license, produce and show to such Ranger, member, constable, or person his license and the contents of his creel or bag, and the bait used by him for taking, catching, or killing such trout or perch. 9. Every trout not exceeding nine inches in length from nose to tip of tail taken or caught by any person shall immediately be returned alive into the water from which the same is taken.

10. No person shall take, catch, or kill any perch under eight inches in length, nor shall perch be taken, caught, or killed at all, or had in possession of any person, between the sixteenth day of April and the thirtieth day of September in any year.

11. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout or perch, nor shall any of the above-mentioned baits be used with any medicated or chemical preparation whatever. 12. and ninety-one, published in the New Zealand Gazette of the twenty-fourth day of September then instant, and by Order in Council of the third day of September, one thousand eight hundred and ninety-eight, published in the said Gazette of the eighth day of September then instant, certain regulations were made under “ The Fisheries Conservation Act, 1884,” providing for the conditions on which, and the season within which, trout and perch may be taken in the Wellington Acclimatisation District, and also for the issue of licenses within such district, and for the refusal of a license in certain

cases : And whereas it is expedient to amend the said regulations, and to make other provision touching the matters aforesaid :

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the powers conferred upon him by “ The Fisheries Conservation Act, 1884,” and “ The Fisheries Conservation Act Amendment Act, 1902,” acting by and with the advice and consent of the Executive Council of the said colony, Joth hereby make the following regulations for the Wellington Acclimatisation District and the waters thereof, and doth hereby declare that these regulations shall, as from the date of the publication thereof in the New Zealand Gazette, supersede all regulations in force in the said district at variance therewith.

Regulations

WHEREAS by “ The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), it is, among other things, enacted that the Governor in Council may from time to time make, alter, and revoke regulations (which shall have force and effect only in any waters or places specified therein) providing for, among other things, the more effectual protection and improvement of “ fish ” as defined by the said Act, and for setting apart any river or other fresh or salt waters for the natural or artificial propagation of fish, and for prohibiting for any period fishing in any 'waters, river, or stream in which young fish or spawn have been placed or deposited : And whereas it is expedient to make the regulations hereinafter set forth with respect to fish liberated, inhabiting, or found in the waters of the Orautaha Stream, in the County of Waimarino :

Now. therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the regulations set forth in the Schedule hereto ; and, with the like advice and consent, doth order that such regulations shall take effect on and after the publication hereof in the New Zealand- Gazette, and shall have force and effect in the Orautaha Stream, in the County of Waimarino.

SCHE D U LE Regulations.

1. The Orautaha Stream, a tributary of the Manganui-o-te-ao River, in the County of Waimarino (the said stream being a stream in which trout have been liberated), is hereby set apart for the natural or artificial propagation of fish.

2. No person shall fish for, take, or catch any fish in the said stream within a period of two years from the date of the publication hereof. 3. Any person committing a breach of the above regulation shall be liable to a penalty of not less than £1 and not exceeding £SO. 4. Every penalty imposed by these regulations may be recovered in a summary manner before any two or more Justices of the Peace.

No person shall fish for trout or perch without a license, and every person fishing shall, on the demand of any Ranger, constable, member of the said society, or person producing a license, produce and show to such Ranger, member, constable, or person, his license and the contents of his creel or bag, and the bait used by him for taking, catching, or killing such trout or perch.

9. Every trout not exceeding nine inches in length from nose to tip of tail taken or caught by any person shall immediately be returned alive into the water from which the same is taken.

10. No person shall take, catch, or kill any perch under eight inches in length, nor shall perch be taken, caught, or killed at all, or had in possession of any person, between the eighteenth day of April and the thirtieth day of September in any year.

11. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall he used for the purpose of taking, catching, or killing trout or perch ; nor shall any of the above-mentioned baits be used with any medicated or chemical preparation whatever. 12. Except as aforesaid, no person shall fish with or use any net or other engine, instrument, or device for taking salmon, or trout, or perch in any river or stream within the district aforesaid, or at the mouth or entrance of any such river or stream.

13. Eor the purposes of these regulations the mouth of every such river or stream shall be deemed to include every outlet of the same and the sea-shore between such outlets, and shall extend over a radius of one-quarter of a mile from the point or line where the waters of such river or stream meet those of the sea or of any harbour at low water.

14. No person shall buy, sell, or expose or offer for sale, or shall fish for the purpose of obtaining for sale, any salmon, trout, or perch, or any part thereof. 15. The penalty for the breach of any of these regulations shall not be less than forty shillings or more than fifty pounds. 16. If any person shall be convicted of any offence against these regulations, the license (if any) held by the offender shall thereupon become void.

Fixing Sittings of the District Court at Pahiatua.

RANFURLY, Governor

IN pursuance and exercise of the power and authority in this behalf enabling me, I, ITchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby fix and appoint that sittings of the District Court of Wairarapa shall be held as follows, in addition to those previously fixed and appointed : In the Courthouse, Pahiatua : For civil and criminal business, on the third Thursday in March and June, and the fourth Thursday in September. Provided that in case any of the days so fixed as aforesaid shall happen to be a holiday, then the Court appointed for that day shall be holden on the first day thereafter not being a holiday.

As witness the hand of His Excellency the Governor, this twenty-eighth day of September, one thousand nine hundred and three.
