Committee Appointed to Regulate Marketing Policy

BY the Hop Marketing Regulations, 1939, which came into force on July 28, and which are enacted under the Primary Products Marketing Act, 1936, and the Agriculture (Emergency Powers) Act, 1934, a Hop Marketing Committee is established. The functions of the committee are to regulate and control in such manner as it thinks fit, but subject to the prior approval of the Minister of Marketing in all matters of marketing policy, the marketing of hops in New Zealand and overseas. The committee may, among other things, but subject to the approval of the Minister, deal with the handling, pooling, and storage of hops, the export of hops, the insurance against loss of hops in New Zealand or in transit from New Zealand, and the sale and disposal of hops on such terms as it thinks advisable. Personnel The committee consists of six persons, namely, one Government representative and five producers’ representatives appointed by the Minister upon election in manner provided in the schedule to the regulations. A producers’ representative holds office for one year or until his successor is appointed and comes into office, and may, if re-elected, be appointed for a further period of office. The first producer members of the committee are to continue to hold office until September 30, 1939. Casual vacancies on the committee which arise on the happening of any one of a series of specified events are to be filled by appointment by the Minister of some fit person in lieu of the member vacating office for the residue of the latter’s term. In the case of a casual vacancy in the office of a producers’ representative the appointment is made on the recommendation of the committee. The regulations provide that the first meeting of the committee shall be. held at a time and . place appointed

and, notified by the Minister, and the Minister may at any time exercise this power in respect of committee meetings other than the first. The regulations deal with the appointment of a chairman of the committee, the number of members who form a quorum at committee meetings, and the grounds on which proceedings of the committee are not to be invalidated. Subject to the provisions of the regulations, the committee may make its own arrangements for holding committee meetings, the procedure of

meetings, and generally for the conduct of its business and the exercise of its functions. Agent of Producer No producer shall sell and no person shall purchase from a producer any hops except through the agency of the committee, which is deemed to be the agent of every producer in respect of the marketing of hops, and the rights and liabilities of the committee and producers are determined according to the law . governing the relations between principal and agent. Not later than August 31 in each year the committee must furnish the Minister with a report and a duly audited statement of accounts showing fully the financial results of its operations for the year ended July 31 immediately preceding.
