DISPUTED COMMISSION.

Before Dr. A. McArthur, S.M., in Wellington last week, Macdonald, Wilson and Co. (Mr. Bolton) and Ross and Greenfield (Mr. Gray) each sued George D. McKenzie (Mr. Myers) for £5O, commission on the sale of the Railway Hotel, Waitotara, the two cases being heard together.

• Some years ago the hotel in question ' was placed in the hands of Macdonald, Wilson and Co. for sale. The hotel was not sold for some time , and then defendant put the hotel into Ross and Greenfield’s hands for sale. The latter - firm found a prospective buyer in a Mr. Co1 • hen, .Who; • however, Was ’ unable to‘ raise ■ the ‘necessary money. Later Mr. Cohen came in contact with Macdonald, Wilson and Co.,- who completed arrangements for - the-sale to Cohem • ted liability, but the question, to which plaintiff ? His Worship! held that Macdonald, Wilson and Co. were agents for Cohen, and not for the vendor, in the actual transaction. He therefore nonsuited that firm, and gave judgment for Ross and Greenfield. The question of costs was left over to be argued at a later date.
