The defendant disputed several of the items, and the plaintiff’s manager ,when put in the box said that the man who had sold the meat from the cart, and also the c erk who had made the entries from the cartman’s book, could not be brought to give evi- ! dence. The magistrate said that in that case there was not an atom of evidence that the goods had been sold or delivered, and he thought the pla’ntiff should accept a non-suit. This course was adopted.
