THE TROTTING MARE MAGGIE.
CHARGES AGAINST MESSRS. WOODFIELD AND ROBERTSON DISMISSED.
[by wire.] Palmerston North, October 29. The trotting case re the ownership of the trotting mare Maggie was resumed in the Court here to-day. The charges preferred against H. Woodfield and Robertson Bros, for stealing the mare, after a lengthy hearing, was dismissed, the magistrate stating that there was noteven a prima facie case made out against the accused. It transpired in the evidence that the mare had been leased for two months to Michael Ryan, and should have been returned to Gordon, of Sydney, by August 12th last, but the latter stated he had heard nothing of the mare since until arriving at Palmerston North last week. Robertson had informed him that he had purchased the mare from Ryan. It has transpired that a warrant has been issued for the apprehension of the latter, but he cannot be found. The magistrate, in dismissing the cash against the Robertson, Bros., said he w r as satisfied from the evidence produced in Court that Gordon was the rightful owner of the marc, but he did not think he had power to issue an order for the restoration of the mare to Mr Gordon. It was arranged that the latter should bring a civil action against the Robertson Bros, for the recovery of the mare, and the case was set down for Friday. After the dismissal of his case Woodfield issued a writ against Mr Gordon claiming £5OO damages for false imprisonment.
