S.M COURT.
In the B.M. Court at Patea this morning, before Messrs H, E. Deane and E. O. Horner, J’s.P., John Hurley was charged with being drunk in a public place, to wit Egraont-streot, whilst in charge of a horse. Mr EL O. Clarke appeared for the accused who pleaded not guilty. Constable O’Brien on oath, deposed that early on Sunday morning he was awakened by unearthly yells. Ho got up and went down the street, He saw ; accused on horseback going up the road to the Hospital, Ho went back and endeavored to stop accused, but tho latter put his horse at a gallop and passed him. Accused was wobbling on tho horse and muttering incoherently. Dane Baxter, nightwatohman, do posed seeing accused, on Sunday morning. Ffe advised accused to go home. Accused had a little too mud; liquor in him. To Mr Clarke ; Would not like to say ho was drunk. Ho was noisy and rowdy. Mr Clarke contended the police had utterly failed to establish a charge ot drunkenness. The accused on oath, deposed thruon the night in question ho was riding up the road when a dog flow at oi* horse. The horse went up the rotffi to , the Hospital. On his return it shied at Constable O’Brien. Ho had not ( had any drink that night- j Tiie Bench said they were of tho ( opinion that the man was urunjr. Ho , would be fined £1 and costs 14s, or in j default 48 hours’ in Wanganui gaol. . i A further charge of riding a horrd ( fiuiously along Egmont street was withdrawn. 1
