(Copy) Downing Street 2nd. July 1846. Sir, Having received Capt. Fitzroy's Despatch marked Separate, on the 29th. October last, enclosing a copy of a letter addressed to the Colonial Secretary, by the principal Agent of the New Zealand Company, - Capt. Fitzroy states that letter to have been forwarded by him, as it might be required for reference in connection with the arrangements made at New Plymouth. From that letter it appears that Colonel Wakefield, adverting to the arrangement entered into by the Company with the Government in the year 1840, for the purchase of land at New Plymouth, and to the award of Mr. Commissioner Spain, which had been over-ruled by Capt. Fitzroy, had refused to accept on the part of the Company the Title Deeds to 3500 acres of land at that settlement. I cannot but express my great surprise and regret at not having been placed by Capt. Fitzroy in possession of a full report of the course which he pursued in this case, and of his reasons for that course. I however, indulge the hope that you may have found yourself in a condition to give effect to the award of Mr. Spain in the case of the Company's claims at New Plymouth; and in any case I rely on your endeavours to gain that end, so far as you may have found it practicable, unless indeed, which I can hardly think probable, you may have reason to believe that the reversal of the Commissioner's judgment was a wise and just measure.
