I have the honour to present herewith the forty-second annual report of this Department, for the information of His Excellency the Governor-General, and to be laid before Parliament, in compliance with the Labour Department Act, 1908, and the Factories Act, 1921-22. The report covers the financial year Ist April, 1932, to 31st March, 1933. Owing to the continued need for economy the report has again been made as brief as possible. I have, &c., Henry E. UNEMPLOYMENT. Since the establishment of the Unemployment Fund and the setting-up of the Unemployment Board the activities of this Department, so far as unemployment is concerned, are mainly restricted to the registration of unemployed men and the placing of such men in employment, and the unemployment figures given below are therefore confined to " registrations " and " placements." Details as to the total number of men employed under the various schemes of the Unemployment Board or being assisted from the Unemployment Fund and other information on the question of unemployment may be obtained from the Annual Report of the Commissioner of Unemployment. On the 28th March, 1932, there were 45,383 applicants registered at the Department's employment offices throughout the Dominion. With slight fluctuations the number gradually increased to 56,498 on the 12th September, 1932, thereafter decreasing steadily until the 25th February, 1933, when it stood at 49,971. The number on the Department's registers on the Ist April, 1933, was 51,529. This number is 6,146 in excess of the number on the registers at the close of the previous year. (Note.— Since the Ist April the number of registered unemployed has continued to increase, the maximum figure up to the present being 57,352 on the 22nd July, 1933—i.e., 854 in excess of the peak figure for last year.) During the year 29,942 men were placed in employment, 2,041 on Government works (being mainly relief works under arrangement with the Unemployment Board), and the balance in private employment, inclusive of those placed under the Unemployment Board's schemes (but apart from those employed on the Unemployment Board's No. 5 Scheme). In addition, 746 were assisted by advances of railway fares or otherwise. (Figures for the previous year were 3,403 Government works, 14,925 otherwise : total, 18,328.)

Of the 51,529 men on the Department's registers at the Ist April, 46,290 were employed under No. 5 Scheme, which provides temporary employment according to each man's circumstances. This figure varies slightly from week to week, the maximum number securing relief during the year being 49,487 on the 12th September, 1932, when the total number of unemployed on the register was 56,498. } 6 The men employed under No. 5 Scheme are not regarded as " placements," and are not therefore included in the figure 29,942 (supra).

FACTORIES ACT.

The figures as to the number of factories and workers employed therein do not purport to coincide with those of the Government Statistician (Census of Industrial Manufactures), as his returns, which are drawn up purely for statistical purposes, do not cover various small establishments that are included as factories under the Factories Act. As might be expected, the most notable decreases in the number of factory workers occurred in the figures for the trades connected with building operations—viz., joinery, plumbing, &c.—while the engineering, cycle and motor, furniture, printing, and bespoke tailoring trades also showed substantial decreases. The reduction in the number of factory workers in the bespoke tailoring trade was offset by a corresponding increase in the number of workers employed in the manufacture of ready-made clothing, while an increase was observed in the number of workers employed in the woollen-mills and in freezing and related trades. It might be explained that the above figures are those ascertained at registration-time (April in each year), except that in order to include factories in seasonal industries which might be closed in April any new establishments opened during the year are added. The figures shown for 1932-33, therefore, chiefly represent the numbers in April, 1932. Accidents. In order that the accident statistics may be comparable with the statistics of other countries, as urged by the International Conference of Labour Statisticians in 1923, the figures cover the calendar year instead of the financial year. The total number of reported accidents to workers in factories is 2,414 (2,349 males and 65 females). Of the total number, 40 of the accidents occurred to workers under sixteen years of age, 373 to those between sixteen and twenty, and the remaining 2,001 to those above that age. Of the 5 fatal accidents none was caused by or was due to machinery. Of the total accidents, 307 were caused by or were due to machinery. The other principal causes of accidents were found to be as follows : Falls of persons (from stairs, ladders, platforms, &c.), 237 ; stepping on or striking against fixed objects, 97 ; faulty handling of tools, 808 ; handling of other objects—viz., objects dropped or tipped over, objects falling, or strain due to handling, 592 ; handling of poisonous, hot, and corrosive substances, 89 *• others (miscellaneous), 284 : total, 2,414. Disability caused : Temporary disability, 2,339 ; permanent partial disability, 70 ; fatalities, 5. The time lost by workers as a result of accidents is 47,170 days, or an average of 19-54 days for each worker. In cases where the amount of compensation paid is known—viz., in 2,398 out of the total of 2,414 —the total amount paid is £35,910 2s. 2d. The following particulars are given of the fatal accidents that occurred during the year :— A worker in a brewery, while closing some outside ventilating-doors on the second floor of the building, overbalanced and fell to the ground, sustaining fatal head injuries. A car-examiner in a tram depot received fatal injuries through being crushed between a moving tram-car and a wall. An electrician employed at a freezing-works accidentally touched a high-tension wire and was electrocuted. A worker received fatal injuries as a result of an explosion which occurred while he was lighting the jet of an oil-fuel plant used to fire a boiler.

A female worker in an unregistered factory was heating over an open fire a benzine tin containing wax for the manufacture of floor polish when her clothing became ignited, causing fatal burns. The following fatal accident to a person other than a worker was reported : — A member of a firm of sawmillers was assisting in " fleeting " logs by winch at the mill when the hook of the tackle flew out and struck him, inflicting fatal head injuries. Inspections, etc. During the year visits of inspection to the number of 5,406 were made in the course of which wages-books were examined to see that the provisions of the Unemployment Act, 1930, and its amendments had been complied with in respect of the deduction of the emergency unemployment charge. Prosecutions numbered 9, in 8 of which convictions were obtained ; the fines totalled £11 10s. ; no case calls for comment. Complaints were received respecting 139 alleged breaches of the Act, resulting in 4 prosecutions and 91 warnings. In 32 cases investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary. Five prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. There were 311 requisitions served to comply with various requirements of the Act, such as for liinewashing ; safeguards for workers employed on machinery, &c. ; sanitary conveniences ; fireescapes ; renovations and structural alterations ; heating-appliances ; ventilation ; first-aid appliances ; and dining-rooms in the case of establishments employing over six women and girls and boys under sixteen.

SHOPS AND OFFICES ACT. The records show 26,025 shops throughout New Zealand, of which 13,759 (approximately onehalf) were carried on without assistants. In the shops with assistants there were employed 18,503 males and 17,211 females. During the year visits of inspection to the number of 9,955 were made, in the course of which wages-books were examined to see that the provisions of the Unemployment Act, 1930, and its amendments had been complied with in respect of the deduction of the emergency unemployment charge. Prosecutions numbered 45, in which 41 convictions were obtained ; fines, £59. Complaints were received respecting 442 alleged breaches of the Act, resulting in 32 prosecutions and 270 warnings. In 117 cases investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary. Thirteen prosecutions were instituted for breaches which were discoverd by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. Thirty requisitions were served on occupiers of shops to comply with various requirements of the Act, such as for sanitary conveniences, heating-appliances, seating accommodation, and ventilation. Consequent on the Amendment Act, which came into force in April, 1932, the review of awards and agreements involved considerable extra work for Conciliation Commissioners and the Department's officers, it being found necessary to appoint temporary Commissioners to cope with disputes created. Section 7 (4) of the 1932 Amendment Act provides that where a settlement of the dispute has not been arrived at by the Council of Conciliation appointed for the hearing thereof every award or industrial agreement theretofore binding on the parties to the dispute in connection with the industry to which the dispute relates shall cease to be in force on the expiration of one month from the date of the Commissioner's notification to the Clerk of Awards that no settlement of the dispute was arrived at. Under this provision failure to reach a settlement in the 97 cases mentioned above resulted in the cancellation of 69 awards and industrial agreements and the partial cancellation of 6. The dispute over wages was the principal cause of failure to reach an agreement. It could hardly be expected that complete agreements would be reached in all cases ; however, in the majority of cases where no agreement was reached the discussions in the Conciliation Councils disclosed a strong desire on the part of both workers and employers to regulate the conditions of employment in the industry. The following summary shows the wage-rates fixed by awards and agreements made under the Industrial Conciliation and Arbitration Amendment Act, 1932, in a number of the principal industries, as compared with the rates fixed by the awards and agreements that were in operation immediately prior thereto. (Except where otherwise indicated, Wellington rates have been taken.)

Section 7 (5) of the Industrial Conciliation and Arbitration Amendment Act, 1932, provides that where no settlement is arrived at in the case of a dispute in an industry or industries where female workers are employed the Court of Arbitration may, on application, make an order fixing the minimum rates of wages that may be paid to the female workers in the industry or industries concerned, such order to operate and be enforceable as an award, and to continue in force for a period of not less than six or more than twelve months, as may be specified therein. Only one such order—viz., that relating to female employees in private hotels—has so far been made by the Court (see Book of Awards, Vol. XXXII, p. 546).

REGISTRATION OF INDUSTRIAL ASSOCIATIONS AND UNIONS. The usual statutory return (to the 31st December, 1932) of the associations and unions registered under the Act, with their membership at that date< is published herewith as an appendix. Comparison with the previous year shows that the total number of workers' unions has decreased by 5 (to 400), and the total membership has decreased by 11,243 (from 90,526 to 79,283). Inspections, etc. During the year 1,821 complaints of alleged breaches of the Act and of awards and industrial agreements, &c., were received, but it was found on investigation that in 608 cases no breach had been committed, in 105 cases proceedings were taken, and in 974 warnings were given. No action was considered necessary in the remaining cases. Apart from the complaints mentioned above, a large proportion of the inspections of factories, shops, &c., included an inspection to ascertain whether the awards and agreements were being complied with in respect of wages, overtime, &c., and, as a result of these inspections 23 prosecutions were taken and warnings were given in other cases. Of the 128 prosecutions, 118 were against employers and 10 against workers; 98 convictions were recorded, 89 against employers and 9 against workers. Total penalties, £102 2s. Industrial Disturbances during the Year. There were in all thirty industrial disturbances during the year. The following is a summary of the larger disturbances :— Tramway Employees (Christchurch). —The union would not agree with the Tramway Board upon an extension of the system, already in operation, of " rationing " the available work in lieu of dismissing surplus men, and the services of twelve men were therefore terminated. The other employees thereupon ceased work with a view to compelling the Board to reinstate the men who had been dismissed. After a period of two weeks, during which a partial tramway service was maintained, chiefly by " volunteer labour," the recommendations of an arbitrator agreed upon by the parties were adopted and work was resumed. Coal-miners.—The miners in most of the coal-mines in the Dominion ceased work as a protest against the new conditions of employment offered by the mine-owners, the principal point of difference being the question as to whether the mine-managers should have an unrestricted right to engage and dismiss employees. The disturbance involved approximately 3,700 men for periods varying from one to twenty-six days. At a conference arranged by the Hon. the Minister ol' Labour a compromise was reached, and the men subsequently decided to resume work under the conditions agreed upon at that conference. Coal-miners (Denniston). —The miners refused to work under the new terms offered by the owners, and the mine was idle for a period of eighty days before terms satisfactory to both sides were arranged. Coal-miners (Southland). —The owners in five mines in the Nightcaps district jointly proposed reductions in rates of pay, amounting to upwards of 20 per cent. Excepting in the case of one mine where the men effected a compromise with the owners, the mines were idle for one hundred and forty days before work was resumed upon terms which were substantially those which had originally been proposed by the employers. Freezing Workers.—Following upon the cancellation, pursuant to section 7 (4) of the Industrial Conciliation and Arbitration Amendment Act, 1932, of the Freezing Workers' award, the workers in many of the freezing-works throughout the Dominion refused re-engagement upon the terms offered by the employers, which provided for reduced rates of wages. The stoppages were mostly of short duration so far as the works were concerned, as the freezing companies were able to engage sufficient labour and instituted the " chain " system of slaughtering. In the majority of the works affected the newly-engaged workers formed and registered separate unions, and in some cases entered into industrial agreements with their employers. Coal-miners (Southland). —On the termination of the existing agreement the company operating one of the mines in the Nightcaps district proposed wage-reductions of 6d. per ton and claimed the right to engage and dismiss labour. After a lapse of thirty-eight working-days the men resumed work, the company's terms being almost wholly accepted. Coal-miners (Stockton). —The men would not accept the new conditions of employment offered by the company and ceased work. Subsequently work was resumed on the company's terms, the company agreeing to withdraw notices of dismissal which had been served upon ninety-four of the employees. The stoppage lasted for twenty working-days. LABOUR DISPUTES INVESTIGATION ACT, 1913. During the year eleven agreements were filed pursuant to section 8 (1), the agreement in each case being reached without recourse to a conference under the Act or to a Labour Dispute Committee. These agreements were as follows : — Retail butchers, Palmerston North ; Gas Company's Clerical and Showroom employees, Auckland ; Gas Company's employees, Auckland; Transport Board's coach and car builders, Auckland; Tramway omnibus and power-house employees, Christchurch ; Power Board's employees, Wanganui; Dairy-factory Managers, Wellington District; Municipal Labourers and Drivers, Wanganui; Freezing Workers, Patea ; Freezing Workers. Wanganui ; Dairy-produce and Cold-storage Workers, Wellington.

Arising out of the disputes filed under the Act since its inception to date, only six ballots have been necessary, and in none of these cases did a strike take place in pursuance of such a ballot. There were on 31st March, 1933, eleven agreements in force under this Act in the following industries:— Gas-manufacture (including clerical and showroom employees). Tramway and omnibus services (including coach and car building and power-house employees). Electric-power Board employees. Freezing-works employees. Managers in dairy factories. Butchers (retail). Storage workers in dairy-produce and cold stores. APPRENTICES ACT. This Act, which was passed in 1923, places the regulation of apprenticeships in the control of the Court of Arbitration. It also provides for the establishment of Committees representative of employers and workers ; these have such powers as may be delegated to them by the Court. The Committees, of which there are 105 functioning, are chiefly to be found in the main towns, and there is usually one for each industry. The Department has again made available to Committees the services of some of its experienced officers, who undertake inquiry work and in many cases act in a secretarial capacity. These officers made 885 inspections under this Act during 1932-33, the inspections being carried out chiefly in the course of ordinary inspection and investigation work and while visiting factories, &c., in connection with other duties. Complaints were received regarding 228 alleged breaches of the Act, while 41 other breaches were discovered by the Department's Inspectors, 173 warnings being issued. There were 20 prosecutions during the year for various breaches of the Act and the orders made thereunder, convictions being entered in 12 of the cases, and penalties amounting to £14 lis. being imposed. Of the prosecutions, 3 were against employers and 17 against apprentices. The following table gives the approximate number of apprentices in the trades to which the Act applies. As mentioned in last year's report, owing to the great difficulty that was being experienced by employers in finding employment for their apprentices during the present economic crisis, provision was made in section 56 of the Finance Act, 1932, giving Magistrates power, on application by any party concerned, to amend, suspend, or cancel any contract of apprenticeship in force at the date of the passing of the Act. Before cancelling any contract, however, the Magistrate is required to be satisfied that, owing to the economic conditions affecting the industry concerned or the particular business of the employer, the employer cannot reasonably be expected to continue to carry out the terms of the contract, but in the event of his ordering cancellation of the contract he may, if he thinks fit, award compensation to the apprentice.

Amounts totalling £3,655 13s. sd. were collected by the Department's officers on behalf of workers who had been underpaid the wages prescribed by awards and the various Acts, while further amounts of such arrears, totalling £2,404 7s. 2d., were paid by employers, at the instance of the Inspectors, directly to the workers concerned : total, £6,060 os. 7d. WORKERS' COMPENSATION ACT. The following cases have been heard and determined by the Court of Arbitration during the last seven years : 1926, 60 ; 1927, 99 ; 1928, 99 ; 1929, 101 ; 1930, 123 ; 1931, 175 ; 1932, 133. The more important decisions, with a digest thereof, are published in " New Zealand Workers' Compensation Cases," which is issued annually by the Department. SHEARERS' ACCOMMODATION ACT. All necessary inspections under this Act were previously carried out by the Inspectors of the Agriculture Department, but following the report of the National Expenditure Commission set up in 1932 the Government decided that inspection of shearers' accommodation should be suspended during the present economic depression. SCAFFOLDING AND EXCAVATION ACT. During the year 2,509 notices of intention to erect buildings and scaffoldings and to commence excavations were received, and 9,498 inspections were made. There were four prosecutions, convictions being recorded in three cases, the other being withdrawn ; fines, £2. The number of accidents to workers during the year ending 31st December, 1932, is 150 (of which 4 were fatal). Of the 150 accidents 142 were of a minor nature. It should be mentioned that the

total includes not only accidents to workers on scaffolding or in connection with gear or excavations, but also all other accidents occurring in connection with building operations. Taking into consideration the hazardous nature of the work and the number of workers involved, the number of accidents due to falls from scaffolds, ladders, or roofs is small —viz., 22. The numbers according to occupations are : Labourers, 76 ; carpenters, 36 ; painters, 2 ; steelworkers, 5 ; plasterers, 2 ; bricklayers, 1 ; plumbers, 1 ; unclassified, 27. The cases in respect of which information as to the time lost and compensation paid is available —viz., 140 and 148 respectively out of the 150 accidents —show that a total of 4,125 days were lost and compensation to the amount of £3,708 Bs. 6d. was paid. The following are particulars of the fatal accidents reported :— While a worker was engaged in excavating a trench for the foundation of a building one side of the trench collapsed, burying him beneath the spoil. Two workers engaged in demolishing a building were killed owing to the collapse of a roof which had been badly constructed. A painter working on a ladder received fatal injuries through the slipping of the ladder, which had not been properly secured. In addition, the following fatal accidents occurred in connection with building or excavating operations, the three persons involved not being employees : — A contractor was engaged in directing the demolition of a building when a jagged piece of timber which was being thrown to the ground cannoned off the wall of the adjoining building and pierced his body. Two men engaged in digging a well on a farm were asphyxiated as a result of inhaling carbonmonoxide gas. SERVANTS' REGISTRY OFFICES ACT. There are sixty-four offices registered in New Zealand, all of which appear to be satisfactorily conducted (last year eighty-one). The decrease in the number of offices registered is due to the fact that very few engagements are being made through these channels. RENT RESTRICTION. There were 278 applications from tenants for inquiry (previous year, 218). The following table shows the results of the investigations (the figures in parentheses are those for the previous year) :— '

From the Ist May, 1928, the Rent Restriction Continuance Act, 1927, provided (1) that the standard rent shall be determined on the basis of 7 per cent, on the capital value of the dwellinghouse as at the date of such determination (instead of on the 1914 value), exclusive of rates, insurance, repairs, and depreciation (as before) ; (2) that the Act shall cease to operate except where, on the application of the tenant, a Magistrate otherwise orders ; in deciding the question the Magistrate shall have regard to the greater hardship that may be caused to either party concerned. Subject to the following paragraph, the provisions do not apply to houses first let after the 9th November, 1920. By the Rent Restriction Extension Act, 1931 (passed 31st July, 1931), the provisions were further continued until the Ist August, 1932, and were extended to cover dwellinghouses in the Hawke's Bay earthquake area let on the 3rd February, 1931 (the date of the earthquake), or since that date at a rental not exceeding £104 per annum. The legislation expired on the 31st October, 1932, but was subsequently revived and continued until the Ist August, 1933, by the Rent Restriction Act, 1932, and further continued until 31st October, 1933, by section 41 of the Finance Act, 1932-33 (No. 2).

FOOTWEAR REGULATION ACT. There were 1,979 inspections made throughout the Dominion under this Act, and stocks of footwear were carefully examined. As most if not all of the footwear required to be branded under the Act is imported, the arrangement made with the Customs Department whereby all imported footwear is examined in the Customs shed before release is still being continued. WEIGHTS AND MEASURES ACT. The regulations under the Act provide for the re verification of weights, measures, and weighing and measuring instruments in use for trade purposes. The net-weight and standard-weight provisions of the regulations also received attention, 549 visits of inspection being made. There were 34 prosecutions for various breaches under this Act, convictions being obtained in 31 cases and fines amounting to £65 10s. being imposed. The other 3 cases were dismissed. Verification fees earned totalled £8,676 17s. 3d. (previous year, £8,817 125.) ; decrease, £140 14s. 9d. Inspections were again made during the year to ensure that the provisions of the Sale of Food and Drugs Act relating to the weight of bread and the provisions of the Weights and Measures Regulations relating to the sale of coal, coke, and firewood were being complied with, resulting in 28 prosecutions (17 in respect of short-weight bread and 11 for breaches in connection with the sale of coal, coke, and firewood). These prosecutions are included in the figures given in the second paragraph above. LEAD PROCESS REGULATIONS. These regulations were issued in 1925 to protect workers from the danger of lead poisoning in factories where lead paints are manufactured or prepared, and also in places where painting operations are carried on. No complaints regarding non-compliance with the regulations have been received during the year, and no cases of suspected lead poisoning were reported. TAILORING TRADE REGULATIONS. These regulations were gazetted in 1925 to prevent the misuse of such expressions as "tailormade " and " hand-made " as applied to garments made to measure, some of which are made partly by machine process. A number of complaints were received during the year, but in only three instances where factory-made garments were incorrectly described in advertisements was it found that a breach of the regulations had been committed. In all cases the advertisements were immediately withdrawn.
