GAMING ACT COMMISSION. REPORT OF COMMISSION APPOINTED UNDER SECTION 6 OF THE GAMING AMENDMENT ACT, 1910.

To His Excellency the Right Hon. John Poynder Dickson-Poynder, Baron Islington, Governor and Commander-in-Chief in and over His Majesty's Dominion of New Zealand and its Dependencies. May it please Your Excellency,— We respectfully submit to Your Excellency the report of the Commission appointed under section 6 of the Gaming Amendment Act, 1910, with its schedules, adjusted to meet objections raised by the Law Officers of the Crown to the report as originally presented. We do not, however, concur in the validity of such objections, but it is unnecessary to discuss this point, as the decisions of your Commission on the matters submitted to it are not affected thereby. In amending the report for the purpose of avoiding the inconvenience of further delay, we have altered the " conditions " imposed upon some clubs to simple ,: recommendations." We lay stress upon the fact that most of these conditions or recommendations are intended to secure the safety and comfort of the spectators or of the riders, and the observance of the decencies of life in the management of a sport conducted under the license of the State for the entertainment and recreation of the public. The conditions or recommendations are the outcome of an exhaustive inspection of the racecourses of the Dominion, and we strongly and unanimously urge their enforcement in all important points within a reasonable period. We make the additional recommendation that where a club desires to alter the number of its totalizator licenses for the utilization of the allotted days of racing or trotting it should, as a rule, be permitted to do so. May it please Your Excellency,— We, the Commissioners appointed by Your Excellency on the Bth day of February, 1911, have the honour to report that after careful consideration and a personal inspection of nearly all the racecourses we have, in accordance with the

terms of our commission, allocated, as set forth in the schedules numbered 1 and 3 appended hereto, the statutory number of days on which the totalizator may be used. For this purpose we have been obliged to reduce the days of racing by fortythree and the days of trotting by eleven, being the proportionate reduction required by the Gaming Act from the number allotted in 1910-11 for meetings at which the totalizator was used. We would premise that we have fulfilled the duty imposed upon us with regret, as we are unanimous in the opinion that some measure of redistribution would have been preferable, and that with the exceptions which could have been thus remedied, and considering the consequential diminution of registered clubs caused by the restrictions imposed by the Gaming Act, the days of racing are not excessive to supply the requirements of so scattered a population. We have recognized as a principle that the larger cities cater not only for the recreation of their own residents, but that their greater resources enable them to provide efficiently for a periodic influx from neighbouring districts. We have also regarded the less accessible communities as entitled to special consideration wherever they have shown any active desire for racing by the provision of needful equipments. We have throughout borne in mind that any approach to the proprietary principle in the ownership of racecourses, and any personal interest in the profits derived therefrom, are strongly to be deprecated. It is obvious that where courses are held on a leasehold tenure from companies or individuals there is danger, if not certainty, that sooner or later a more or less disguised form of profit-sharing must ensue. We therefore recommend that in all such cases there shall be required the acquisition of the freehold or of a right to race in perpetuity, at a fixed rental. In order to guard against any possible accrual of personal profit, we consider that in the event of the dissolution after the 31st day of December, 1911, of any racing or trotting club, or of the cessation of any such club to carry on the business of racing or trotting, the surplus (if any) of assets over liabilities shall be devoted to the funds of the nearest hospital or hospitals. In cases where neighbouring clubs amalgamate, any such surplus or surpluses may be considered as part of the assets of the club formed by such amalgamation. As a general rule, we consider that no license should be issued to any racing club unprovided with a racecourse of about one mile in circumference, fenced on the inside of the racing-track with a fence of an approved pattern, or to any trotting club unprovided wth a trotting-track similarly fenced. The pattern shown in Schedule No. 10 attached hereto is strongly recommended. There are certain cases', as in the Westland district, where courses free from the danger of sharp turns are not procurable, but we would desire to place on record our conviction that no new licenses should be granted except upon the conditions aforesaid. In every case in which the provision for the fit carrying-on of the sport or for the safety of riders or of the public is deficient, or in which the sanitary arrangements are unsatisfactory, we have called attention to the deficiencies, and we suggest that if within one or two years, according to the magnitude of the needed alterations, such deficiencies are not completely remedied, the license should be permanently withdrawn from the negligent club. As a further record we have added schedules calling attention to the needs and imperfections which we consider are capable of being supplied or amended before racing or trotting can be satisfactorily conducted on the courses therein named. We desire to point out that the peculiar concentration of trotting has been caused by the exceptional growth of the sport in a few centres, and this unequal distribution cannot be immediately remedied. In view of the lessened number of race meetings, we would suggest that increased attention should be paid by the Railway Department for supplying facilities to the public—especially within a radius of, say, twenty miles—for attending races. At such centres as Dunedin and Wellington the train journey of twelve or seventeen miles respectively to new courses has not decreased attendance, and with an attrac-

tive train service any local hardship caused by the suppression of meetings would be partially rectified, while the Department would benefit by the traffic and the public by the probable improvement in the sport. SCHEDULE No. U. RACING CLUBS.—RECOMMENDATIONS. Bay of Plenty J.C. —We recommend railing the inside of racing-track, erection of suitable stand, and all other necessary appointments, sanitary and otherwise. Ohinemuri J.C. ; (Waihi J.C.) —We allot one license and two days to Ohinemuri, with which Waihi should coalesce to race at Paeroa. We recommend improvement in sanitary and other arrangements. Rotorua J.C. —We recommend railing the inside of the racing-track, erection of grandstand and other necessary appliances. Present state of appointments a disgrace to a tourist resort. South Auckland R.C. —Tenure of course from Agricultural and Pastoral Association should be permanently fixed, and appointments and sanitary arrangements improved. Strongly recommend amalgamation for racing purposes South Auckland R.C, Waikato H.C., and neighbouring non-totalizator clubs, and alteration of date to the spring to suit this combination. Te Aroha J.C—We recommend railing inside of racing-track. Takapuna J.C. —lt is promised that the course will be extended shortly to not less than one mile in circumference. Te Kuiti R.C. —We recommend obtaining freehold of course or permanent right to race at fixed rental, and also railing the inside of racing-track, erection of suitable stand and other necessary appointments, sanitary and otherwise. Thames J.C. —We recommend extension of track to at least 7 furlongs, and proper railing inside of racing-track. Whangarei R.C. —We recommend erection of proper appointments, including railing the inside of racing-track, and securing freehold tenure or permanent right to race at a fixed rental. Dannevirke R.C. —We recommend acquisition of freehold of property and provision of suitable appliances, sanitary and otherwise. We were dissatisfied with the manner in which the buildings were maintained on the course. Porangahau R.C. —We recommend acquisition of freehold of course or permanent right to race at a fixed rental, and railing the inside of racing-track, and provision of proper sanitary and other accommodation. In regard to this meeting, consideration has been given to its isolation. Tolaga Bay J.C. —We recommend acquisition of freehold tenure or permanent right to race at a fixed rental, and railing the inside of racing-track. In regard to this meeting consideration has been given to its isolation. Waipukurau J.C. ; (Waipawa County R.C.) —We allot one license and one day to Waipukurau with which Waipawa should coalesce to race at Waipukurau, and we recommend improved sanitary accommodation for men at Waipukurau. Wairoa County R.C. —We recommend acquisition of freehold tenure or a permanent right to race at a fixed rental, and railing the inside of racing-track. In regard to this meeting consideration has been given to its isolation. Woodville D.J.C.; (Pahiatua R.C.) —We allot two licenses and four days' racing to Woodville, with which Pahiatua should coalesce to race at Woodville. Opunake R.C. —We recommend erection of proper appointments, including alterations of seven-furlong start and fitting proper sanitary accommodation, &c. Stratford R.C. —Promise given to carry out plans as submitted to the Gaming Act Commission, including proper sanitary accommodation and avoidance of dangerous turns in close proximity to starting-posts. Foxton .R.C. —We suggest that appliances, sanitary and otherwise, be put in <iood order. Mtiifon, J.C. ; (Rangitikei R.C.)— We allot two licenses and four days' racing to Marton, and suggest amalgamation under the name of " Rangitikei-Marton " Racing Club, to race on Marton course. In arriving at this decision we are influenced largely by the facilities for railway communication.

Waverley- Waitotara R.C.; (Patea R.C.) —We allot one license and one day's racing to Waverley-Waitotara, with which Patea should coalesce to race at Waverley. We recommend stand at Waverley being moved back according to proposals submitted. Masterton R.C. ; Taratahi-Carterton R.C. —We allot two licenses and three days' of racing to Masterton, and one license and one day to Taratahi-Carterton ; but we recommend that these clubs should coalesce to race on Masterton course. We recommend that the improvements at Opaki, as submitted to the Gaming Act Commission, be immediately effected. In arriving at this recommendation we are guided by the geographical distribution of racecourses. Wairarapa R.C. ; (Lower Valley J.C.) —We allot two licenses and four days' racing to Wairarapa R.C.. with which Lower Valley should coalesce to race at Tauherenikau. Wellington R.C. —We recommend reducing winter meeting by one day. Akaroa County R.C. —We recommend tenure being altered to freehold or permanent right to race at a fixed rental, or, failing this, a suitable arrangement to race on the recreation-reserve at Motukarara. We advise railing the inside of racingtrack, and providing proper sanitary and other accommodation. Amberley Steep. C; (North Canterbury J.C), (Ohoka and Eyreton J.C.) —We recommend railing the inside of racing-track, the erection of grandstand and all other usual appurtenances and sanitary arrangements. The course is at present equipped with very unsuitable buildings, and it is recommended that no license shall issue until satisfactory assurances have been made of the carrying-out of the needed improvements. Failing that we suggest that the same offer be made to North Canterbury J.C. These three clubs should coalesce. Ashburton County R.C. —We recommend railing the inside of racing-track. Hororata R.C. —We recommend railing the inside of racing-track and removing trees of central clump. Kumara R.C. —This course as at present laid out is too narrow to accommodate large fields with safety. The tenure of the club from the Borough Council should be made permanent. Nelson J.C. —We recommend railing the inside of racing-track. Tenure of course from Agricultural and Pastoral Association should be permanently fixed. Reefton J.C. —W r e recommend lengthening the course as far as possible. Tuapeka C.J.C. ; Beaumont J.C. —The position of these two clubs requires special comment. The Tuapeka (Lawrence) course is, in our opinion, unfit for racing and incapable of being sufficiently improved. The Beaumont course is well fitted for the purpose, but is held on a leasehold tenure and is at present isolated. This isolation will, however, cease when the Big Hill Tunnel, now under construction, is completed, as the Beaumont course will then be easily accessible by rail to the inhabitants of Tuapeka. We therefore allot one license and one day to Tuapeka and one license and one day to Beaumont. On the completion of the tunnel we suggest that these two clubs should amalgamate to run a two-days' meeting at Beaumont. We also suggest that the freehold of the Beaumont course should be acquired, and that the two clubs make immediate arrangements for ultimately carrying out the proposal indicated, after which all requisite appliances should be provided. We suggest that unless these recommendations are fulfilled no license shall be issued to either the Beaumont or Tuapeka Clubs. Cromwell J.C—We recommend railing the inside of racing-track, erection of new grandstand and other necessary appointments, sanitary and otherwise. Lake County J.C (Frankton Racecourse). —We advise meeting being held on Frankton Racecourse Reserve, and proper equipments and repairs, including the railing of inside of racing-track. North Otago J.C—We recommend erection of improved railing in the straight. Tapunui R.C —We recommend railing the inside of racing-track. Vincent J.C—We recommend railing the inside of racing-track, erection of suitable grandstand and all other necessary appointments, sanitary and otherwise.

Waikouaiti R.C. ; (Palmerston R.C.) —We allot one license and one day's racing to Waikouaiti R.C. and suggest amalgamation, to race at Waikouaiti, where it is promised that the course shall be extended to about one mile in circumference, with other improvements, including erection of grandstand and proper sanitary arrangements. We suggest that no racing be permitted until the course is enlarged as aforesaid and approved : at present it is very unsafe. Wairio J.C —We recommend acquisition of freehold or permanent right to race at a fixed rental, and railing the inside of racing-track. Wyndham R.C. —We recommend railing the inside of racing-track.
