TRIAL OF GERMAN ARMY LEADER
COURT’S JURISDICTION QUESTION ED BERLIN, August 23. Field-Marshal von Manstejn failed to-day in an .attempt to be tried by a court-martial instead of a British military court on war crimes charges. The military court refused a sub mission by von Manstein’s counsel (Mr Reginald Paget, K.C.) that it had no jurisdiction to try him. Sir Arthur Comyns Carr, the prosecutor, submitted -that von Manstein -had lost his status as a prisoner of war. lie added that tiie ordinary rules of evidence were not applicable in this case because the alleged crimes were of such magnitude. After the first charge in the 39-page indictment had been read, Mr Paget objected to the form of the charge. The bearing was ndjourneil until tomorrow. .
