(Before Judge Haselden.) FAILING TO DELIVER GOODS. I The District Court sat at Ashburton f ? hl.s moving, Jud Se Haselden presid"Jg;, lhe only important case was that ! of, the Official .Assignee (Mr Buchanan) J v. Henry Stephenson (Mr Kennedy), ! a motion tor the delivery of certain articles, or claiming m lieu thereof till 9s sd. The case for the Official Assignee was that the defendant had taken possession of several articles of furniture and book debts, which formed part of the property of the bankrupt, •' Robert George Bright, second-hand! dealer, which should have been handed 1 over to the Deputy Official Assignee tor division among the creditors of the bankrupt. It was alleged that the defendant had, wrongfully taken and retained possession of the articles set' out m a schedule attached and the book-debts, and had refused and neglected to deliver the same to the Deputy Official Assignee. iThe defence was that the defendant hold a bill of sale over the articles m question, and that before Bright was declared bankrupt these articles had been taken possession of and sold under the bill of sale. His Honour, m giving judgment, said, it was clear that Stephenson had sold stock not included m the bill of sale, but how much he did not know.. 1 Equitably, as well as legally, £20 was, 1 as near as His Honour could, go m the 1 matter. He accordingly made an order that £20 should be paid to the Deputy Official Assignee by Stephenson, each party to pay its. own costs. DISCHARGE. Mr Buchanan, for William Percy Smith Elmslie, applied for a discharge from bankrupcy. The Deputy Official Assignee (Mr Davison) did not oppose the.applicaI tion, and an order of discharge was made.
