NapierFebruary 7th. 1872 My dear Sir, I send by this mail Dft. Rules under the Frauds Act. I have aimed throughout at making the Rules general in their nature and such as will work well I hope in practice. It would have been better if other rules could be made instead of some of the rules submitted; but they would have ultra vires and consequently objected to by the Law Officers. In preparing the rules I have contemplated that Commrs. reside in the chief towns - should they be locomotive officers other rules could easily be substituted - which would occasion less delay in obtaining certificates than exist at present. The Rules regulating appeals can be easily prepared from the Rules submitted, and do not call for any special remark from me. The Regulations for the guidance of Trust Commrs. are virtually instructions. There are many points on which no regulation is made; and it is well that it should be so as a great deal must be left to the discretion of the Commr. I ought to mention to you that in a late conversation I had here with the Judge about the Frauds Act he said that he understood the Government intended to ask him to prepare the Rules. However as the Rules have to be approved of by him my Dft. Rules and notes will be of service. I hope to be able to send you the minutes of my proceedings for the last six months by an early mail. The copier is busily engaged. Every thing is quiet here at present. Shareholders are talking of winding up "The Telegraph!! but it is believed that the paper will be brought by some of the shareholders and carried on again. I am Sir, Yours obediently, Hanson Turton.
