Sir, — I have the honour to present herewith the forty-seventh annual report of this Department for the information of His Excellency the Governor-General, and to be laid before Parliament, in compliance with the Labour Department Act, 1908, and the Factories Act, 1921-22. The report covers the financial year Ist April, 1937, to 31st March, 1938. A separate report will be submitted regarding the Employment Division of the Department. I have, &c., J. S. Hunter, Secretary of Labour. The Hon. the Minister of Labour. EMPLOYMENT AND UNEMPLOYMENT. A separate report is submitted concerning activities in connection with the Employment Promotion Fund. Increased employment is reflected in several of the tables embodied in this report, notably in those relating to the number of factory workers and the number of apprentices employed. As mentioned in the section relating to shops, the figures given relating to the number of shops and the assistants employed are merely estimates, and regard should be had to this when considering the increases shown.

The figures as to the number of factories and workers employed therein do not purport to coincide with those of the Government Statistician (annual statistics of factory production), as his returns, which are drawn up purely for statistical purposes, do not cover various small establishments that are included as factories under the Factories Act. It might be explained that the above figures are those ascertained at registration-time (April in each year), except that in order to include factories in seasonal industries which might be closed in April any new establishments opened during the year are added. The figures shown for 1937-38, therefore, chiefly represent the numbers in April, 1937. The upward movement in the number of factories registered and in the number of factory workers, which commenced in April, 1934, was maintained during last year, there being large increases under both headings as compared with the previous year. Increases have again been •recorded in coach and motor-body building, clothing and white working, motor and cycle engineering, sawmilling, and other trades associated with the building industry and the furniture trade. As anticipated in the previous report, the latest figures in the above table relating to the number of factories and the number of factory workers established a new record level. An examination of the receipts by way of registration fees during April and May, 1938, indicates that the upward movement of factory employment is still being continued. Accidents. The statistics in regard to accidents to workers were not available up to the date of completion of the report, and arrangements are accordingly being made for their inclusion in the next report. The following particulars are given of the fatal accidents that occurred during the year A baker who had accidently caught his hand in a dough-mixing machine died in hospital as a result of a clot of blood from the wound becoming lodged in the tubes leading to the lungs. Sulphur-dust in an elevator shaft at a chemical-works became accidentally ignited, and, in endeavouring to escape, several workers were injured, while one was asphyxiated by sulphur-dioxide gas. A ground engineer at an aerodrome was cutting the top off an empty oil-drum with an oxyacetelyne torch when an explosion occurred, the worker being killed instantly. The worker apparently omitted to " steam out " the drum to remove any inflammable gases. A splinter of bone penetrated the finger of a freezing-worker while he was boning beef. Bloodpoisoning set in, and the worker died about a fortnight after the accident. A sawmill worker was attending to a circular saw when through some mistake the power was switched on. The resultant injuries to the worker proved fatal. A foreman who was supervising the slipping of a scow lay face downwards on a floating punt in order to see that the vessel was sitting correctly on the packing when it suddenly moved sideways, crushing his head against the punt. The injuries sustained by him subsequently proved fatal. A worker sustained fatal head injuries when an old petrol-tank which he was welding exploded. Apparently the tank contained petrol-vapour which ignited on the application of the welding-apparatus. A worker in a limeworks was found lying near a crusher with 'head injuries which later proved fatal. It is not known how the accident occurred, but it is surmised that some limestone fell from an adjacent receiving hopper and struck him on the head. In the following case the accident was to a person other than a " worker " within the meaning of that term as defined by the Workers' Compensation Act, 1922 A member of a firm of flax-mill owners was testing a scutcher when a side cheek casting broke and the arms of the scutcher struck him on the head, causing fatal injuries. Inspections, Etc. During the year visits of inspection to the number of 14,013 were made. Complaints were received respecting 1,801 alleged breaches of the Act, resulting in 45 prosecutions and 619 warnings. In 667 cases investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary. Sixty prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. Convictions were secured in 81 of the 105 prosecutions ; the fines totalled £95. No case calls for comment. There were 621 requisitions served to comply with various requirements of the Act, such as for lime washing ; safeguards for workers employed on machinery, &c. ; sanitary conveniences ; fire-escapes ; renovations and structural alterations ; heating-appliances ; ventilation ; spray-booths in duco work ; first-aid appliances ; and dining-rooms in the case of establishments employing over six women and girls and boys under sixteen ; also provision of drinking-water.

Amendment of the Factories Act, 1921-22. By section 11 of the Statutes Amendment Act, 1937, an amendment was made to the provision introduced in 1936 requiring that for the purpose of determining the rate of payment to which any person is entitled under the Act there shall be taken into account all periods of that person's employment in any factory whatsoever. Under the amendment referred to it is provided that in respect of an apprentice employed in any factory there shall be taken into account only the period or periods of his employment in that factory or in any other factory in which similar work was carried on at the time of his employment therein. Pursuant to the powers contained in section 47 of the Finance Act, .1936, a modification order was issued in respect of the factory occupied by Smokeless Fuel and Briquettes (Canterbury), Ltd., and also an extension order adding fruit-packing and fruit-grading factories to the list of industries exempt from the statutory limits of working-hours, at the same time modifying in relation to this class of factory the sections relating to payment of wages for holidays and Sundays. The regulations under the Factories Act, 1921-22, were consolidated and reissued during the year. SHOPS AND OFFICES ACT. The Department has no accurate record as to the number of shops and the number of assistants employed therein, but from the information available it is estimated that there were during the year 30,263 shops throughout New Zealand, of which 15,133 (approximately one-half) were carried on without assistants. In the shops with assistants it is estimated there were employed 27,994 males and 25,263 females. During the year visits of inspection to the number of 20,193 were made. Prosecutions numbered 662 ; convictions were obtained in 593 cases. A number of cases were withdrawn; fines totalled £555 18s. Of the prosecutions, 384 were for offences regarding the closing-hours of shops in the evenings or on the statutory half-holiday. Complaints were received respecting 1,506 alleged breaches of the Act, resulting in 264 prosecutions and 644 warnings. In 457 cases investigations showed that no breach had been committed while in the remaining cases no action was considered necessary. Three hundred and ninety-eight prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. One hundred and seventy-seven requisitions were served on occupiers of shops to comply with various requirements of the Act, such as for sanitary conveniences ; heating-appliances ; fire-escapes ; lunch-room; seating or rest-room accommodation; lighting; ventilation; cleanliness; and partitions, including separate entrances. Amendment of the Shops and Offices Act, 1921-22. By an amendment to the Shops and Offices Act contained in section 29 of the Statutes Amendment Act, 1937, public accountants' offices have been placed in the same position as solicitors' offices and miners' union offices, and the only provisions of the Act now affecting such offices are those relating to wages. The following summary shows the minimum wage-rates as at 31st May, 1938, fixed by awards and agreements in a number of the principal industries : —

The Industrial Conciliation and Arbitration Amendment Act, 1936, provides for tie fixing in awards of maximum working-hours, exclusive of overtime, not exceeding forty per week except where the Court is satisfied that it would be impracticable to carry on efficiently any industry if the hours were so limited. A further provision is that where the Court fixes the maximum weekly hours at not more than forty Saturday work is to be eliminated where practicable. In respect of awards in operation at the date hereof the following tables set out the industries or occupations in which the hours are fixed at forty per week, also where the hours fixed exceed forty, and where Saturday work is permitted.

Amendments or the Industrial Conciliation and Arbitration Act. A decision of the Court of Appeal given last year limited the meaning of the term " industry " in the Industrial Conciliation and Arbitration Act, 1925, to a business or undertaking, &c., common to both employers and workers. Prior to this decision the term " industry " had always been regarded by the Court of Arbitration and others as meaning not only a business or undertaking, &c., in which employers and the workers employed by those employers are engaged, but also any employment or occupation, &c., of workers themselves irrespective of the nature of the businesses of the employers of those workers. An amendment of the Act passed during 1937 extended the definition of the term " industry " in the principal Act in the direction already indicated, and by retrospective application of the amended definition of " industry " validated all unions and awards and industrial agreements affected by the Court of Appeal decision. An amendment was also passed to make it clear that an industrial union of employers or workers may, by amending its rules and changing its name, extend the area in respect of which it is registered or extend its scope to admit persons engaged or employed in related industries and that the Registrar in issuing a new certificate of registration and recording such amendments to the rules is not acting beyond his powers. The practice referred to had been permitted by the Registrar of Industrial Unions for many years, following legal advice obtained by him, but as this advice was by no means specific as to the legality of the procedure adopted the position was placed beyond doubt and what had been done in the past was validated. It may be mentioned that if this procedure were not permitted any union desirous of extending its area or covering related industries would have to cancel its registration for the purpose of obtaining registration of a new union, with the result that any award or industrial agreement in force to which the union was a party would cease to operate on the expiration of its currency or on the date of cancellation of registration, whichever was the later. An industrial association may also extend its scope and change its name in the same way as an industrial union. The principal Act provided that an under-rate worker's permit shall not be granted to any person who is not usually employed in the industry to which the award applies, but the Minister in special cases is now empowered to authorize the issue of such a permit to a person not usually employed in the industry. Provision was also made for the temporary appointment of an additional Court of Arbitration to relieve the pressure of work upon the existing Court, and, in addition, for the delegation by the Court of certain of its functions to Stipendiary Magistrates. The additional Court was constituted upon the same basis as the original Court —-i.e., three members ; a Judge, and two nominated members appointed on the recommendation of the industrial unions of employers and the industrial unions of workers, one each. The Court commenced to function in November, 1937. Simplification of the procedure in citing parties to an industrial dispute was also introduced. It is now sufficient if the industrial union or association of employers is named as respondent. If there is no union or association of employers so named there need be cited in an application merely a number of representative employers to the satisfaction of the Conciliation Commissioner. All employers who are engaged in the industrial district m any industry to which the dispute relates shall also be deemed to be respondents, except that in respect of any branch of the farming industry it is necessary that — (a) Every industrial association comprising any industrial union of employers whose members or any of whose members are engaged in the industrial district in that branch of the said industry is named in the application as a respondent; and (b) Every union of employers (not being a member of an industrial association) whose members or any of whose members are engaged in the industrial district in that branch of the said industry is named in the application as a respondent. Another amendment enables unions to amalgamate irrespective of whether they are within the same industrial district or not, this being merely consequential upon the legislation of 1936 empowering the registration of unions to cover more than one industrial district. Provision was also made to bring chartered clubs, racing clubs, trotting clubs, and hunt clubs within the operation of awards and industrial agreements. Inspections, Etc. During the year 8,816 complaints of alleged breaches of the Act and of awards and industrial agreements, &c., were received, but it was found on investigation that in 3,160 cases no breach had been committed. In 469 cases proceedings were taken, and in 3,878 warnings were given. No action was considered necessary in the remaining cases. Apart from the complaints mentioned above, a large proportion of the inspections of factories, shops, &c., included an inspection to ascertain whether the awards and agreements were being complied with in respect of wages, ovetime, &c., and as a result of these inspections 153 prosecutions were taken and warnings were given in other cases. Of the 622 prosecutions, 566 were against employers and 56 against workers : 464 convictions were recorded, 422 against employers and 42 against workers. Total penalties, £617 18s. 4d. In addition to the above, the Department's Inspectors investigated 271 complaints involving the provisions of the Finance Act, 1936, while 60 cases were discovered by the Inspectors themselves. Nineteen prosecutions were taken in respect of these cases, convictions being recorded in six cases and fines amounting to £29 were imposed.

Registration op Industrial Associations and Unions. Further advantage has been taken of the legislation passed in 1936 permitting the registration of unions covering the whole. Dominion, the whole of the North or South Island, or any group of two or more industrial districts. Up to the 30tli April. 1938, thirty-six organizations have been registered under these provisions (sixteen employers' and twenty workers" unions). In twenty-four cases (employers eleven, workers thirteen) registration covers the whole Dominion. The usual statutory return (to 31st December, 1937) of the associations and unions on the register, with membership as at that date, is appended hereto. Comparison with the previous year shows that employers unions have increased by 38 (from 201 to 239), with an additional total membership of 1,999 (from 6,442 to 8,441), while workers' unions have increased by 14 (from 487 to 501), with a total increase in membership of 47,459 (from 185,527 to 232,986). Although the increase in the number of workers' unions is only fourteen, actually fifty-two were registered during the year while thirty-eight were cancelled, all but three cancellations being due to the registration of unions covering two or more industrial districts, thereby absorbing the existing unions. Industrial Disturbances during the Year. There were sixty-three industrial disturbances during the year, as compared with forty-two last year. Of these disturbances, twenty were in connection with waterside work and sixteen were in the coal-mining industry. No case calls for particular comment, but it is interesting to note that onlv in thirteen cases did the matter in dispute relate to wages or hours of wotk. LABOUR DISPUTES INVESTIGATION ACT, 1913. During the year sixteen agreements were filed pursuant to section 8 (1), the agreement in each case being reached without recourse to a conference under the Act or to a Labour Disputes Committee. These agreements were as follows James State Coal-mines' employees. Liverpool State Coal-mines' employees. Westland State Coal-mines' engine-drivers. Auckland Electric-power Board's shift engineers. Auckland marine engineers. Gisborne Freezing Co.'s shift engineers. New Zealand Airways Co.'s engineers and attendants. Wellington oxygen and acetylene-gas workers. Canterbury oxygen and acetylene-gas workers. Union Steamship Co.'s steam-tug masters and engineers. Wellington and Taranaki cool-store workers. Southland cool-store workers. Otago Dairy Producers' cool-store workers. Wanganui Harbour Board's cool-store workers. Kauri Timber Co.'s tow-boat employees. New Zealand photo-engravers. Arising out of the disputes filed under the Act since its inception only nine ballots have been necessary, and in no case did a strike take place in pursuance of such a ballot. Seventeen agreements were in force on 31st March, 1938, in the following industries :— Cool-storage workers (4). Colliery employees (3). Electric-power Board employees (3). Engineers (airways) (1). Engineers (marine) (1). Oxygen and acetylene-gas workers (2). Photo-engravers (1). Tow-boat employees (1). Tug-masters and engineers (1). APPRENTICES ACT. This Act, which was passed in 1923, places the regulation of apprenticeships in the control of the Court of Arbitration. It also provides for the establishment of Committees representative of employers and workers ; these have such powers as may be delegated to them by the Court. The Committees, of which there are ninety-four functioning, are chiefly to be found in the main towns, and there is usually one for each industry. The Department has again made available to Committees the services of some of its experienced officers, who undertake inquiry work and in many cases act in a secretarial capacity. These officers made one hundred special inspections under this Act during 1937-38. In addition, inspections were carried out in the course of ordinary inspection and investigation work and while visiting factories, &c.., in connection with other duties. Complaints were received regarding 275 alleged breaches of the Act, while 270 other breaches were discovered by the Department's Inspectors, 315 warnings being issued.

There were eighteen prosecutions during the year for various breaches of the Act and the orders made thereunder, convictions being entered in sixteen of the cases, and penalties amounting to £24 16s. Bd. being imposed. With three exceptions the prosecutions were against employers. The following table gives the approximate number of apprentices in the trades to which the Act applies. The estimated number of apprentices that may be employed without exceeding the proportion allowed under the various orders of the Court is 14,370. A reluctance on the part of employers to take on apprentices was evident from 1931 onwards, and it is of considerable interest, therefore, to note that in 1937-38 there were 3,235 contracts registered, as compared with 2,328 in 1936-37, while the number of apprentices employed increased from 5,231 to 7,916. Attention was also drawn to the provisions of section 7 of the Statutes Amendment Act, 1936, under which the Minister of Labour is empowered to approve of special contracts of apprenticeship in the case of youths of eighteen years of age and over. Five hundred and twelve contracts have been registered in terms of this legislation. From the above it is apparent that there is still scope for greater employment of apprentices, particularly in the building industry, as will be seen from the following table, which shows the number of apprentices employed in various branches of that industry during each of the past five years as compared with the number employed in 1928 : —

ARREARS OF WAGES. Amounts totalling £36,044 2s. (last year £33,854 19s. 5d.) were collected by the Department's officers on behalf of workers who had been underpaid the wages prescribed by awards and the various Acts, while further amounts of such arrears, totalling £8,613 10s. 2d. (last year £36,865 15s. 7d.) were paid by employers, at the instance of the Inspectors, directly to the workers concerned : total £44,657 12s. 2d. (last year £70,720 155.). The high total for last year was due to the operation of the Finance Act, 1936, and adjustments consequent upon the increased minima provided for workers in factories, shops, &c. A decrease for this year was anticipated, as the bulk of the adjustments had been effected. WORKERS' COMPENSATION ACT. During the year sixty-five cases were heard and determined by the Court of Arbitration (previous year fifty-eight). The more important decisions, with a digest thereof, are published in " New Zealand Workers' Compensation Cases," which is issued annually by the Department. Workers' Compensation Amendment Act, 1936. As mentioned last year, provision was made in the above Act to prevent the discontinuance of weekly payments of compensation to workers except, inter alia, where a medical committee certifies that the worker is fit for work or where the worker without sufficient justification refuses or neglects to submit himself for examination by such committee. During the year medical committees were appointed in thirteen districts, and regulations were issued prescribing the procedure to be adopted in connection with the examination of injured workers by such committees. SHEARERS' ACCOMMODATION ACT, 1919, AND AGRICULTURAL WORKERS ACT, 1936. Accommodation. Remuneration and Conditions of Employment on Dairy-farms, Orchards, and Farms and Stations. The Agricultural Workers Act, 1936, fixed minimum wages based on age for employees on dairyfarms and provided for revision following alteration of the guaranteed price for dairy-produce. Upon the determination of the guaranteed price for the 1937-38 season the wages-rates were reviewed, and amended rates were prescribed by the Agricultural Workers' Wage Fixation Order, 1937 (Serial Number 273/1937), which operated from the Ist November, 1937. An increase of 2s. 6d. a week (to £2 55.) was provided for workers of the age of twenty-one years and upwards, with smaller increases for workers below that age. The new rates were automatically applicable to the extension orders applying to agricultural workers on farms and stations used for the commercial production of wool, meat, and/or grain (including seed). Section 20 of the Act gave power to extend the provisions relating to remuneration and conditions of employment on dairy-farms with modifications where necessary, subject to such proposed extensions being first submitted to the organizations (if any) of workers affected and their employers. As some organizations had agreed upon certain clauses that related to matters not provided for in the Act and were desirous of having such clauses included in an extension order, the Agricultural Workers Amendment Act, 1937, was passed, empowering the inclusion of any terms agreed to by the organizations of workers and their employers. Following the passing of the amending Act, effect was given to an agreement arrived at in respect of orchard workers, the Order in Council being issued as the Agricultural Workers Extension Order, 1938 (Serial Number 1938/22), which replaced the Agricultural Workers Extension Order, 1937 (Serial Number 130/1937). During April, 1938, an extension order was issued covering agricultural workers in market gardens (including market gardens where soft fruit is produced), but this is limited in its application to the Wellington and Nelson Industrial Districts (Serial Number 1938/53.) A further amendment of the Act was effected by section 3 of the Statutes Amendment Act, 1937. This provides that any agricultural worker employed on a dairy-farm may agree with his employer to be allowed leave from work between milkings on one day in each week of his employment instead of being allowed a half-holiday from noon for the remainder of the day, and if such leave is allowed it shall be deemed to be equivalent to a half-holiday.

The Department has again dealt with numerous inquiries from farmers and workers in regard to the provisions of the Act and regulations. Complaints were received respecting 1,180 alleged breaches of the Act, and these resulted in 19 prosecutions and 485 warnings. Fines imposed amounted to £13 15s. Apart from the above, 1,024 inspections of dairy-farms and 192 inspections of farms and stations were made, it being necessary in 521 instances to draw attention to failure to observe the statutory provisions. SHARE-MILKING AGREEMENTS ACT, 1937. The object of the Act is to provide minimum standard terms and conditions for inclusion in sharemilking agreements between share-milkers and farm-owners. Minimum standard terms and conditions which had been agreed to on behalf of the New Zealand Farmers' Union and the New Zealand Workers' Industrial Union of Workers are set out in the Schedule to, the Act, but these are applicable only in those cases where the farm-owner provides the herd. Provision is made, however, for extending the provisions of the Act to other classes of share-milking agreements —for example, where the share-milker provides the herd —if standard terms and conditions have been agreed to by representative organizations of farm-owners and share-milkers. The provisions in the Schedule may be revoked, varied, or added to by the Governor-General in Council by agreement of the organizations concerned. In the case of every share-milking agreement made between a farm-owner and a share-milker where the herd is owned or provided by the farm-owner, the agreement shall on and after the Ist day of August, 1938, operate not less favourably for the share-milker in any respect than if the terms and conditions specified in the Schedule to the Act were incorporated in the agreement on that date, and any terms and conditions in the agreement that are inconsistent with the terms and conditions of the Schedule shall, on and after the Ist day of August, 1938, or the date of the agreement, whichever is the later, be deemed to be null and void in so far as they would operate to the disadvantage of the share-milker. Without limiting any other remedies that a share-milker may have against the farm-owner, any Inspector under the Agricultural Workers Act, 1936, may, acting in the name and on behalf of the share-milker, take proceedings for the enforcement of the rights of the share-milker under any sharemilking agreement to which the Act applies. SCAFFOLDING AND EXCAVATION ACT. During the year 5,594 notices of intention to erect buildings and scaffoldings and to commence excavations were received (previous year 5,475), and 10,240 inspections were made. There were thirty-one prosecutions, convictions being recorded in twenty-nine cases, and fines amounting to £60 being imposed. The number of accidents to workers during the year ended 31st December, 1937, was 250 (of which 8 were fatal). It should be mentioned that the total includes not only accidents to workers on scaffolding or in connection with gear or excavations, but also all other accidents occurring in connection with building operations. Taking into consideration the hazardous nature of the work, the greatly increased activity in the building industry, and the number of workers involved, the number of accidents due to falls from scaffolds, ladders, or roofs is small —viz., 63. The number of accidents according to occupations were: labourers, 150 ; carpenters, 68 ; painters, 6 ; plasterers, 5 ; unclassified, 21. Information as to time lost and compensation paid shows in regard to the cases in which details are available that a total of 5,179 days were lost and compensation to the amount of £8,750 os. 4d. was paid. The following are particulars of the fatal accidents reported : — A labourer employed on demolition work was operating a hand-winch mounted on a platform. The platform collapsed under the strain applied, and the worker fell to the ground, sustaining fatal head injuries. Notice of intention to commence this work had not been given to the Department. A carpenter working on a ladder some 6 ft. from the ground fell and sustained fatal injuries as a result of the ladder slipping when he leaned sideways to drive in a nail. Two workmen employed on the construction of a temporary bridge for the driving of piles for the main bridge were thrown into the river, apparently as a result of the vibrations caused by a large wooden beam being dropped into position. Both men could swim, and had almost reached the bank when they were caught in a current and were drowned. A workman had mounted a 17 ft. ladder for the purpose of dusting some interior paintwork when he overbalanced and fell on to the floor, sustaining fatal injuries to his head and chest. A painter working on a fire-escape overbalanced and fell 20 ft. to the ground, sustaining fatal injuries. During a high wind a portion of a chute broke away from a portable concrete-hoist tower and struck a labourer on the head, causing injuries which later proved fatal. A foreman carpenter working on a scaffold fell a distance of 14 ft. to the ground, sustaining fatal head injuries. It is not known how the accident occurred, but it appears to have been in no way due to any defect in the scaffolding. In the following case the accident was to a person who was not a " worker " within the meaning assigned to that term by the Workers' Compensation Act, 1922 : — A bridge-building contractor was manceuvring a concrete pile into position when the knot in the rope around the pile became unfastened. The contractor was crushed beneath the pile, and subsequently died in hospital.

SERVANTS' REGISTRY OFFICES ACT. There are 92 offices registered in New Zealand (last year 110). The offices appear to be satisfactorily conducted. It may be mentioned that the number of offices registered is now on approximately the same level as in the years prior to 1930. FAIR RENTS ACT, 1936. This Act, the currency of which was extended by the Fair Rents Amendment Act, 1937 to 30th September, 1938, applies to dwellinghouses that are let at a rental not exceeding £156 a year The Act (as amended by the Amendment Act, 1937), which binds the Crown and which does not apply to any dwellinghouse first let after the passing of the legislation, 11th June, 1936, or to premises forming part of a building originally designed and constructed for the purpose of being let as more than two separate flats or apartments, prevents any increase in a tenant's rent during the tenancy except where a fair rent is determined in accordance with the Act. Any such increase can be enforced only pursuant to a Magistrate's order or pursuant to an agreement in writing between the landlord and the tenant and approved by the Inspector of Factories. A Magistrate may determine a fair rent for any dwellinghouse on the application of either the landlord or the tenant. The fair rent is to be such rent as in the opinion of the Magistrate it is fair and equitable for the particular tenant to pay, having regard to any hardship likely to be inflicted on the tenant or the landlord and to all other relevant considerations. The fair rent is not to be higher than the rent paid by the tenant on 27th November, 1935 (the date of the last general election) or any lower rent that has been payable since that date, unless the landlord proves that that rent is in the circumstances, too low. Regulations may be made providing for the filing of the fair rent at' an amount equal to a percentage of the capital value of the dwellinghouse (not less than 4 per cent nor more than 6 per cent, per annum), together with the outgoings for rates, insurance, and repairs' and the amounts (if any) to be allowed for depreciation and as rent of furniture. Such regulations' may apply generally or m respect of specified parts of New Zealand or specified classes of dwellinghouses No such regulations have been issued to date. The fair rent may be altered from time to time, and applies only so long as the tenancy lasts but a new fair rent may be determined for any subsequent tenancy. Other provisions empower the Court to order a refund of what it considers to be excessive rent paid during the six months immediately before a fair rent is determined, declare any rent in excess of the fair rent to be irrecoverable, enable a tenant to recover (or deduct from future rent) any rent that he has paid m excess of that payable under the Act, and prohibit the charging of fines or premiums for letting houses to which the Act applies. It is required that fourteen days notice be given to the tenant before proceedings for possession are commenced, while the grounds on which possession of a dwellinghouse may be obtained are restricted, and the Court is authorized to refuse an order for possession where it is not satisfied that the landlord would suffer greater hardship from the refusal of an order than the tenant would suffer by reason of the grant of an order. Section 63 of the Finance Act, 1937, contained special provisions relating to ejectment, and provided that the Court shall not make an order for ejectment where possession is sought on the grounds that an agreement for sale has been entered into, the purchaser reasonably requiring the premises for his own occupation as a dwellinghouse, unless the Court is satisfied that suitable alternative accommodation is available for the tenant or will be available when the or der takes effect; also that the Court shall not make an order where the premises are reasonably required by the landlord for his own occupation as a dwellinghouse or for occupation as a dwellinghouse by any person m the regular employment of the landlord unless it is satisfied that alternative accommodation is available as above or the hardship caused to the landlord or any other person by the refusal of the Court to make an order for possession or ejectment would exceed the hardship caused to the tenant by the making of such an order. The Court also has discretionary power to suspend any proceedings for as long as it thinks fit, with or without imposing conditions The of the landlord to distrain for rent is also restricted. The Inspector of Factories is empowered to act on behalf of any tenant in proceedings under the Act, and the following table indicates the extent to which tenants have availed themselves of the services of the Department's Inspectors.

The Department investigated eighteen alleged breaches of section 15 of the Act, which imposes certain restrictions on the letting or selling of a dwellinghouse where the landlord has recovered possession on the grounds that the premises are required for his own occupation. Proceedings were taken in nine instances and penalties amounting to £18 were imposed. In the remaining cases it was considered that the circumstances did not justify proceedings. FOOTWEAR REGULATION ACT. During the year 304 establishments and 1,867 shipments were inspected under this Act, the latter in pursuance of the arrangement made with the Customs Department whereby all imported footwear is examined in the Customs shed before release. WEIGHTS AND MEASURES ACT. The regulations under the Act provide for the reverification of weights, measures, and weighing and measuring instruments, in use for trade purposes. In addition to the reverification work referred to, the Department has carried out surprise tests of appliances on the owner's premises, the net-weight and standard-weight provisions of the regulations also receiving attention. There were thirty-six prosecutions for various breaches under this Act, convictions being obtained in thirty-five cases, and fines amounting to £52 ss. being imposed. Verification fees earned totalled £9,761 ss. lid. (previous year £8,655 19s. 4d.). Inspections were again made during the year to ensure that |the provisions of the Sale of Food and Drugs Act relating to the weight of bread and the provisions of the Weights and Measures Regulations relating to the sale of coal, coke, and firewood were being complied with, eleven of the prosecutions referred to above being in connection with the weight of bread and nine relating to the sale of coal. INTERNATIONAL LABOUR OFFICE. The twenty-third session of the International Labour Conference met on the 3rd June, 1937, New Zealand being represented by a delegation consisting of two Government representatives, one employers' representative, and one workers' representative. The Draft Conventions and Recommendations adopted, also reports by members of the New Zealand delegation, were presented to the Legislature last session. The twenty-fourth session opens on the 2nd June, 1938, the following being the items on the agenda : — (i) Technical and vocational education and apprenticeship. (ii) Regulation of contracts of employment of indigenous workers. (iii) Recruiting, placing, and conditions of labour (equality of treatment) of migrant workers. (iv) Regulation of hours of work and rest periods of professional drivers (and their assistants) of vehicles engaged in road transport. (v) Generalization of the reduction of hours of work. (vi) Statistics of hours and wages in the principal mining and manufacturing industries, including building and construction, and in agriculture. New Zealand is again represented by a delegation of four.

Ratification of International Labour Office Conventions. During last session the following were formally ratified by the Government with the assent of both Houses of the Legislature : — List of Conventions ratified by New Zealand. (а) Convention limiting the hours of work in industrial undertakings to eight in the day and forty-eight in the week ; (б) Convention concerning unemployment—adopted by the International Labour Conference at its first session (Washington, 29th October to 29th November, 1919) ; (c) Convention for establishing facilities for finding employment for seamen—adopted by the International Labour Conference at its second session (Genoa, 15th June to 10th July, 1920) ; (d) Convention concerning the rights of association and combination of agricultural workers ; •(e) Convention concerning workmen's compensation in agriculture ; (/) Convention concerning the application of the weekly rest industrial undertakingsadopted by the International Labour Conference at its third session (Geneva, 25th October to 19th November, 1921) ; (g) Convention concerning workmen's compensation for accidents —adopted by the International Labour Conference at its seventh session (Geneva, 19th May to 10th June, 1925) ; (.h) Convention concerning the simplification of the inspection of emigrants on board ship— adopted by the International Labour Conference at its eighth session (Geneva, 26th May to sth June, 1926); (i) Convention concerning seamen's articles of agreement —adopted by the International Labour Conference at its ninth session (Geneva, 7th to 24th June, 1926) ; (j) Convention concerning the creation of minimum-wage-fixing machinery—adopted by the International Labour Conference at its eleventh session (Geneva, 30th May to 16th June, 1928) ; (k) Convention concerning forced or compulsory labour ; (I) Convention concerning the regulation of hours of work in commerce and offices —adopted by the International Labour Conference at its fourteenth session (Geneva, 10th to 28th June, 1930); (:m) Convention concerning the protection against accidents of workers employed in loading or unloading ships (revised 1932)— adopted by the International Labour Conference at its sixteenth session (Geneva, 12th to 30th April, 1932) ; (n) Convention concerning employment of women during the night (revised 1934) ; (o) Convention concerning workmen's compensation for occupational diseases (revised 1934); (p) Convention ensuring benefit or allowances to the involuntarily unemployed —adopted by the International Labour Conference at its eighteenth session (Geneva, 4th to 23rd June, 1934); (q) Convention concerning the employment of women on underground work in mines of all kinds ; (r) Convention concerning the reduction of hours of work to forty a week; (s) Convention concerning the reduction of hours of work in glass-bottle works —adopted by the International Labour Conference at its nineteenth session (Geneva, 4th to 25tli June, 1935) ; (t) Convention concerning the reduction of hours of work on public works—adopted by the International Labour Conference at its twentieth session (Geneva, 4th to 24th June, 1936) ; (u) Convention concerning the minimum requirement of professional capacity for masters and officers on board merchant ships —adopted by the Internationa] Labour Conference at its twenty-first session (Geneva, 6th to 24th October, 1936); {v) Convention concerning the reduction of hours of work in the textile industry—adopted by the International Labour Conference at its twenty-third session (Geneva, 3rd to 23rd June, 1937). Che ratification of these draft conventions introduces an obligation on the part of the Government to make annual reports thereon to the International Labour Office in terms of Article 408 of the Treaty of Versailles, which reads as follows : — Bach of the Members agrees to make an annual report to the International Labour Office of the measures which it has taken to give effect to the provisions of conventions to which it is a party ..." ASSISTED IMMIGRATION. There has been no change in the position since the last report. During the year assisted passages were granted to ten migrants (previous year eleven). As explained in last year's report, the cases approved of in recent years have been those where a portion of a family has been previously in receipt of assisted passages and there was a promise implied that applications in respect of other members of the family would receive consideration later.
