DEPARTMENT OF LABOUR (REPORT OF THE).

Presented to both Houses of the General Assembly by Command of His Excellency.

REPORT.

The Secketaky, Department of Labour, to the Hon. the Ministeb of Labour. Sir, — Department of Labour, Wellington, 18th June, 1931. I have the honour to present herewith the fortieth annual report of this Department, for the information of His Excellency the Governor-General, and to be laid before Parliament, in compliance with the Labour Department Act, 1908, and the Factories Act, 1921-22. The report covers the financial year Ist April, 1930, to 31st March, 1931. Owing to the present need for economy, the report has been made as brief as possible. I have, &c., W. UNEMPLOYMENT. On the 31st- March, 1930, there were 3,130 applicants registered at the Department's employment offices throughout the Dominion. The number increased steadily from that date until the 22nd September, when a total of 6,099 was reached. The Unemployment Act was passed on the 11th October, 1930, and from that date registrations of unemployed males increased rapidly until on the 30th March, 1931, there were 38,028 applicants on the Department's registers. As mentioned in my report of last year, the second report of the Unemployment Committee was duly presented to Parliament, and as a result of the introduction of legislation, based to some extent on the recommendations of the Committee, the Unemployment Act, 1930, was passed. The administration of this Act is in the hands of the Unemployment Board, which was first set up on the 20th November, 1930. As will be apparent, a tremendous amount of additional work has been involved in registering the greatly increased number of unemployed, and also in placing the men in employment under the various schemes introduced by the Unemployment Board. As a consequence a number of the officers of the Department have had to devote practically their whole time to this work, and many have found it necessary to work a considerable amount of overtime to cope with the rush of applicants. The willingness with -which this has been done is an indication of the splendid spirit of the members of the staff, who have cheerfully sacrificed their own leisure in order that the Department's employment offices might function smoothly and expeditiously. In addition, it has been necessary to obtain a good deal of assistance from other Government Departments (principally the Post and Telegraph Department), and all the officers so detailed to assist in the unemployment work have rendered excellent service. I may mention that, where this Department has no office, provision is made for the unemployed to register at the nearest permanent post-office, and in many cases the accommodation at these offices has been severely taxed in coping with the position which has arisen. During the year 30,223 men were placed in employment, 12,586 on Government works, 9,245 with local bodies (of whom 3,428 were given employment at Christmas-time under the Unemployment Board's No. 3 Scheme), 7,320 in private employment, and 1,072 on temporary work immediately following the Hawke's Bay earthquake. In addition, 365 persons were assisted by advances of railway fares, while 421 received a cash payment equal to the value of two days' work, there being no opportunity of affording them employment under No. 3 Scheme already referred to. There were 68,449 persons dependent on the workers assisted to employment. (Figures for the previous year were : 14,537, Government works ; 4,319, local bodies ; 3,034, private employment —total, 21,890 : dependants, 40,086.) Of the 38,028 applicants at the 30th March, 1931, 24,941 were working under the Unemployment Board's Scheme No. 5, which provides for three weeks' (out of every four weeks) temporary employment up to four days each week, according to each man's circumstances. The men so employed are not regarded as " placements," and are not therefore included in the figure 30,223 (supra). At no time in the history of the country has unemployment assumed such large proportions as it has since the passing of the Unemployment Act. While a proportion of the increase in the number of unemployed is no doubt due to the fact that many applicants who previously did not consider it worth their while to register are now desirous of participating in any benefits the Act may confer, the main reason for the increase can be found only in the financial and economic condition of the country.

Many firms, by a system of rationing, have sought to tide over the period of depression without reducing their staffs. So far as can be ascertained, this has been done by agreement between the parties, including the unions concerned. The spirit in which these schemes have been adopted is very commendable, and, while a certain amount of sacrifice on the part of some of the workers has been entailed, there is 110 doubt that the rationing of the work has prevented many workers from being thrown into the ranks of the unemployed.

FACTORIES ACT.

The figures as to the number of factories and workers employed therein do not purport to coincide with those of the Government Statistician (Census of Industrial Manufactures), as his returns, which are drawn up purely for statistical purposes, do not cover various small establishments that are included as factories under the Factories Act. It will be noted that, considering the large number of unemployed workers, the figures do not show any marked decrease in the number of workers employed in factories. It might be explained, however, that the above figures are those ascertained at registration-time (April in each year), except that in order to include factories in seasonal industries which might be closed in April any new establishments opened during the year are added ; the figures shown for 1930-31 therefore chiefly represent the numbers in April, 1930. Accidents. As mentioned previously, in order that the accident statistics may be comparable with the statistics of other countries, as urged by the International Conference of Labour Statisticians in 1923, the figures cover the calendar year instead of the financial year. The total number of reported accidents to workers in factories is 2,644 (2,535 males and 109 females). Of the total number, 68 of the accidents occurred to workers under sixteen years of age, 449 to those between sixteen and twenty, and the remaining 2,127 to those above that age. Of the 10 fatal accidents, 3 were caused by or were due to machinery. Of the total accidents, 517 were caused by or were due to machinery. The other principal causes of accidents were found to be as follows : Falls of persons (from stairs, ladders, platforms, &c.), 250 ; stepping on or striking against fixed objects, 142 ; faulty handling of tools, 683 ; handling of other objects (viz., objects dropped or tipped over, objects falling, or strain due to handling), 643 ; handling of poisonous, hot, and corrosive substances, 106 ; others (miscellaneous), 303 : total 2,644. Disability caused : Temporary disability, 2,496 ; permanent partial disability, 138. Fatalities, 10. The following particulars are given of the fatal accidents that occurred during the year : — (1) A foreman was inspecting some machinery when part of his clothing became entangled and he was drawn roulid a shaft, receiving fatal injuries. The machinery was adequately guarded, and the place where the worker was injured could be reached only by passing the obstructing guards. (2) A worker whilst draining benzine from the tank of a motor-car availed himself of the opportunity of filling his automatic cigarette-lighter. Before replacing the lighter in his pocket he unthinkingly lit it, and sustained fatal burns as a result of the explosion that followed. (3) A dairy-factory worker slipped and fell backwards into a tub of boiling water, death occurring as the result of toxaemia following the scalding. (4) A coachworker whilst working on a stage which had been erected round the body of a motor-bus slipped and fell backwards a distance of 6 ft. to the floor, sustaining head injuries, from which he subsequently died. (5) A young woman employed in a cardboard-box-making factory was struck by a falling stack of large cardboard sheets and received fatal injuries to her head. (6) A worker who was whitewashing from a platform which he had moved from its normal position was strangled by his neckcloth catching in an unprotected shaft. The worker had been instructed not to do any whitewashing in close proximity to moving machinery. (7) A labourer at a chemical-manure-manufacturing works while working in a hopper containing ground phosphate was buried by a fall of the phosphate and suffocated. (8) A woodworking machinist while adjusting from a ladder the belt or pulley of a shaft fell on to the concrete floor, sustaining fatal head injuries. (9) A cleaner employed in a furniture-factory slipped while clearing rubbish away from a dovetailing-machine. To preserve his balance he stretched out his hand, which came into contact with the knives of the machine. Tetanus supervened. (10) A sawmill employee, wearing loose clothing, climbed up on a staging to place a belt on a pulley whilst the machine was in motion. His clothing was caught and he was drawn round the shaft, sustaining fatal injuries.

Inspections, etc. Inspectors paid 11,883 visits of inspection to the factories of the Dominion (numbering in all 17,019) during the year. Prosecutions numbered 33, in 32 of which convictions were obtained ; the fines totalled £100 4s. ; no case calls for comment. Complaints were received respecting 193 alleged breaches of the Act, resulting in 14 prosecutions and 96 warnings. In 72 cases investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary. Nineteen prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. There were 803 requisitions served to comply with various requirements of the Act, such as for limewashing ; safeguards for workers employed on machinery, &c. ; sanitary conveniences ; fireescapes ; renovations and structural alterations; heating-appliances; ventilation; lighting; firstaid appliances ; washing-water ; and dining-rooms in the case of establishments employing over six women and girls and boys under sixteen.

SHOPS AND OFFICES ACT. The records show 26,621 shops throughout New Zealand, of which 13,387 (approximately onehalf) were carried on without assistants. In the shops with assistants there were employed 20,946 males and 19,827 females. Visits of inspection to the number of 18,768 were made during the year. Prosecutions numbered 372, in which 350 convictions were obtained ; fines, £391 16s. Complaints were received respecting 552 alleged breaches of the Act, resulting in 109 prosecutions and 227 warnings. In 171 cases investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary ; 263 prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. Of the 372 prosecutions taken under this Act, 165 were in connection with the sale of cigarettes by shopkeepers other than tobacconists ; there were 13 prosecutions against tobacconists : total, 178. Ninety-six requisitions were served on occupiers of shops to comply with various requirements of the Act, such as for sanitary conveniences, heating-appliances, sitting-accommodation for females, lighting, ventilation, and drinking-water. Registration of Industrial Associations and Unions. Tlie usual statutory return (to the 31st December, 1930) of the associations and unions registered under the Act, with their membership at that date, is published herewith as an appendix. Comparison with the previous year shows that the total number of workers' unions has increased by one (to 416) and the total membership has decreased by 1,130 (from 102,646 to 101,516). Inspections, etc. During the year 3,810 complaints of alleged breaches of the Act and of awards and industrial agreements, &c., were received, but it was found on investigation that in 1,172 cases no breach had been committed ; in 252 cases proceedings were taken, and in 2,013 warnings were given. No action was considered necessary in the remaining cases. Apart from the complaints mentioned above, a large proportion of the general inspections of factories, shops, &c., totalling 30,651, included an inspection to ascertain whether the awards and agreements were being complied with in respect of wages, overtime, &c., and as a result of these inspections 169 prosecutions were taken and warnings were given in other cases. Of the 421 prosecutions, 310 were against employers and 111 against workers ; 371 convictions were recorded, 263 against employers and 108 against workers. Of the prosecutions against workers 12 wêre against the employees of one firm for signing an incorrect record in the holiday book, 53 were under the strike provisions of the Act (freezing industry), while the remainder were principally for accepting less than award rates of wages. Total penalties, £614. Industrial Disturbances during the Year. There were in all thirty-five industrial disturbances during the year. The following is a summary of the larger disturbances : — Slaughtermen (Otago).—A strike of slaughtermen and their assistants occurred in a freezing-works owing to the management's refusal to employ a certain worker. After a few days the management engaged sufficient volunteer labour to replace the strikers. Proceedings were taken against fifty-three of the strikers under the Industrial Conciliation and Arbitration Act and penalties totalling £145 were inflicted. The men employed in several other freezing-works adopted a " go-slow " policy in sympathy with the above strikers, but after a few days normal work was resumed. Coal-miners (Stockton). —The proprietors of a coal-mine had agreed to share the available work amongst all the members of the union. After this arrangement had been in operation for a month, however, the company found it impossible to carry on and requested a reversion to the previous methods of working. The men refused, and ceased work, but both sides later agreed to abide by the ruling of an independent chairman, who decided in favour of the company. The number of men involved was 290, and the stoppage extended over twenty-four working-days. Coal-miners (Blackball). —The management of the mine desired, owing to slackness of trade, to dispense with a number of men and to work one shift only. The union objected, and requested that the available work be shared amongst all the existing employees. No agreement was arrived at, and after six weeks the management decided that, as the mine had been working for several years at a loss, it be closed down. The number of men employed at this mine was approximately 270. Coal-miners (Glen Afton). —The miners ceased work with the object of compelling the management to employ members of the union in preference to non-unionists. The mine, which employs 523 men, was idle for ten days. The men's demands were not conceded. LABOUR DISPUTES INVESTIGATION ACT, 1913. The following information shows the extent to which the workers have preferred the method provided by the above Act for the settlement of their disputes to the procedure to be followed if they register under the Industrial Conciliation and Arbitration Act :■ —•

Arising out of the disputes filed under the Act since its inception to date, only six ballots have been necessary, and in none of these cases did a strike take place in pursuance of such a ballot. There are ten agreements in force under this Act, in the following industries :— Coal-mining. Marine engineers and shift engineers in freezing-works and power-houses. Gas-manufacture (including clerical and showroom employees). Glass-manufacture. Tramway and omnibus services (including coach and car building). Meat-preserving. Managers in dairy factories. APPRENTICES ACT. This Act, which was passed in 1923, places the regulation of apprenticeships in the control of the Court of Arbitration. It also provides for the establishment of committees representative of employers and workers ; these have such powers as may be delegated to them by the Court. Since the Act came into operation 143 committees have been set up, but of these at least nine are not now functioning. As may be expected, the committees are chiefly to be found in the main towns, and there is usually one for each industry. The Department has again made available to committees the services of some of its experienced officers, who undertake inquiry work and in many cases act in a secretarial capacity. These officers made 2,955 inspections under this Act during 1930-31, the inspections being carried out chiefly in the course of ordinary inspection and investigation work and while visiting factories, &c., in connection with other duties. Complaints were received regarding 363 breaches of the Act, while 241 other breaches were discovered by the Department's Inspectors, 341 warnings being issued. There were 50 prosecutions during the year for various breaches of the Act and the orders made thereunder, convictions being entered in 36 of the cases, and penalties amounting to £44 Is. being imposed. Of the prosecutions, 27 were against employers and 23 against apprentices. The following tabk gives the approximate number of apprentices in the trades to which the Act applies. This information is based mainly on contracts of apprenticeship as registered with the Department. Chemists' apprentices are omitted this year because the Act does not now apply (1930 amendment).

Amendment of Act. The Act was amended last year to give effect to a number of the recommendations contained in the report of the Conference of Apprenticeship Committees held in 1929. ARREARS OF WAGES. Amounts totalling £6,188 16s. lOd. were collected by the Department's officers on behalf of workers who had been underpaid the wages prescribed by awards and the various Acts, while further amounts of such arrears, totalling £4,538 15s. 4d., were paid by employers, at the instance of the Inspectors, directly to the workers concerned ; total, £10,727 12s. 2d. WORKERS' COMPENSATION ACT. The following cases have been heard and determined by the Court of Arbitration during the last five years : 1926, 60; 1927, 99 ; 1928, 99 ; 1929, 101 ; 1930, 123. A summary of the more important cases is contained in New Zealand Workers' Compensation Cases," which is published annually by the Department.

AGRICULTURAL LABOURERS' ACCOMMODATION ACT (ACCOMMODATION FOR FLAXMILL AND SAWMILL WORKERS, ETC.). A total of 122 inspections were made under this Act at sawmills, flax-mills, &c., and 35 owners were required to carry out improvements to buildings, to provide new or to improve existing conveniences, to provide first-aid outfits, bathing-facilities, or to comply with other provisions of the regulations. SHEARERS' ACCOMMODATION ACT. The Inspectors of the Agriculture Department again carried out all necessary inspections under this Act. Owing to the financial position, it was deemed inadvisable to incur the expense of visiting some premises where the conditions were known to be good. However, a considerable number of inspections were made, and, where necessary, requisitions for improvements were served. Where only small improvements were necessary written requisitions were dispensed with, as verbal requests had the desired results. One prosecution was instituted. SCAFFOLDING AND EXCAVATION ACT. During the year 5,181 notices of intention to erect buildings and scaffoldings and to commence excavations were received, and 19,879 inspections were made. There were 15 prosecutions for breaches of the Act and regulations : Convictions, 14 ; fines, £19. The number of accidents that occurred during the year ending 31st December, 1930, is 393 (of which 5 were fatal). Of the 393 accidents, 374 were of a minor nature. It should be mentioned that the total includes not only accidents to workers on scaffolding or in connection with gear or excavations, but also all other accidents occurring in connection with building operations. Taking into consideration the hazardous nature of the work and the large number of workers involved, the number of accidents due to falls from scaffolds, ladders, or roofs is small—viz., 43. The numbers according to occupations are : Labourers, 163 ; carpenters, 128 ; painters, 19 ; steelworkers, 14 ; plasterers, 11 ; bricklayers, 9 ; plumbers, 5 ; unclassified, 44. The following are particulars of the fatal accidents reported : — (1) A worker was engaged assisting to shift a pile-driving derrick when one of the guy-wires he was holding came in contact with an 11,000-volt power line. (2) A contractor working on a scaffolding inside a garage fell a distance of 32 ft. on to the concrete floor, sustaining fatal injuries. It is thought that deceased was overcome by fumes from the exhausts of motor-cars. (3) A carpenter cut his thumb with his saw while ripping a piece of timber. Tetanus supervened. (4) A builder's labourer stepped upon the head of a 3 in. nail which protruded a quarter of an inch from a plank. As the sole of his boot was very worn,' the head of the nail pierced his foot. The worker died of tetanus. (5) A worker was engaged in erecting concrete-boxing on a set-off of a tower on the top of a building when a gust of wind caught the shutter. He overbalanced, and fell a distance of over 100 ft. to the street below. SERVANTS' REGISTRY OFFICES ACT. There are eighty-eight offices registered in New Zealand. Inspections are made from time to time to see that the Act is generally observed. RENT RESTRICTION. There were 120 applications received from tenants for inquiry (previous year, 170). The following table shows the results of the investigations (the figures in parentheses are those for the previous year) : —

It is noteworthy that on no occasion was it necessary to refer an application to the Court. In 33 cases out of the total of 120 the rents were reduced 011 the intervention of the Department, while in 74 others no action was taken. In the remaining 13 cases the landlord was considered entitled to the rent demanded. From the following table it will be noticed that during recent years there has been a considerable reduction in the number of applications received from tenants for inquiry :— Year. Number of Applications. 1926-27 . . .. .. .. .. 551 1927-28 .. .. .. .. .. 345 1928-29 .. .. .. 270 1929-30 .. .. .. . 170 1930-31 .. .. .. .. .. ..120 From the Ist May, 1928, the Rent Restriction Continuance Act, 1927, provided (1) that the standard rent shall be determined on the basis of 7 per cent, on the capital value of the dwellinghouse as at the date of such determination (instead of on the 1914 value), exclusive of rates, insurance, repairs, and depreciation (as before) ; (2) that the Act shall cease to operate except where, on the application of the tenant, a Magistrate otherwise orders ; in deciding the question the Magistrate shall have regard to the greater hardship that may be caused to either party concerned. By thejKent Restriction Act, 1930, the provisions were, further continued until the Ist August, 1931. These provisions will then expire unless further extended. FOOTWEAR REGULATION ACT. There were 3,052 general inspections made throughout the Dominion under this Act, and stocks of footwear were carefully examined. By arrangement, made with the Customs Department all imported footwear is promptly examined in the Customs-shed before being released. WEIGHTS AND MEASURES ACT. The regulations under the Act provide for the reverification of weights, measures, and weighing and measuring instruments in use for trade purposes. This work was again carried out during the year, and the articles so dealt with, together with new weights, &c., verified, are summarized hereunder :—

In addition to the reverification work referred to, the Department has carried out surprise tests of appliances on the owner's premises, 11,381 visits being made to business premises in this connection. The net-Weight and standard-weight provisions of the regulations also received attention, 1,954 visits of inspection being made. There were 31 prosecutions for various breaches under this Act, convictions being obtained in 30 cases, and fines amounting to £41 being imposed. Verification fees earned totalled £8,935 6d. lid. The Department is in touch with other countries with a view to preventing appliances possessing objectionable features, and which may have been rejected in other countries, from being dumped into the Dominion.

LEAD PROCESS REGULATIONS. Inspections of premises where lead processes are carried on were again made during the year, and care was taken to see that the safeguards provided for workers operating paint-spraying apparatus in coach-painting and other factories were satisfactory. A. worker at a motor-body-building factory was found to be suffering from lead colic and was immediately placed under treatment. Two cases of death from lead poisoning were reported during the year. In the first case deceased, a master painter, had been treated nineteen years previously for lead poisoning, and had left the trade for health reasons some two and a half years before his death, which was notified as being due to chronic lead poisoning. In the second case deceased, whose death was due to acute lead poisoning and heart-trouble, had been employed for many years as a lead-burner. TAILORING TRADE REGULATIONS. These regulations were gazetted in 1925 to prevent the misuse of such expressions as " tailormade " and " hand-made " as applied to garments made to measure, some of which are made partly by machine process. During the year one complaint of an alleged breach of the regulations was received, but owing to lack of evidence no action could be taken.
