NATIVE LAND AMENDMENT AND NATIVE LAND CLAIMS ADJUSTMENT ACT, 1921-22. REPORT AND RECOMMENDATION ON PETITION No. 161/1920, RELATIVE TO SUCCESSION TO MAKA TARAPIKO IN KAIAUA, SECTIONS 12 AND 13, SQUARE 92.

Native Department, Wellington, 13th July, 1922. Re Kaiaua, Sections 12 and 13, Square 92, Croixelles. — Petition No. 161 of 1920. Pursuant to section 35 of the Native Land Claims Adjustment and Native Land Amendment Act, 1921-22, the report of the Native Land Court is forwarded herewith. 1 think it advisable to add a few more particulars. The land in question was granted to Maka Tarapiko by grant dated 19th July, .1866. By an agreement executed in the presence of Commissioner Alexander Mackay, Maka Tarapiko and, another agreed to sell the land to Thomas Askew for £100, and apparently the purchaser must have entered into possession, for in 1885 it was brought under the Land Transfer Act in the name of Reubena Askew—Rewi Maaka, the appointed successor, consenting. On the 13th June, 1890, it was transferred to James Stuart, who in 1915 transferred it to Elsie Stuart, and she in turn transferred it, on the Ist March, 1919, to the present proprietor, Cyril Charles Saxton Pike. With so many registrations it would be hopeless to attempt to get the land back, but, in addition, Maka Tarapiko, the original owner, has evidently been a party to the sale. In the Native Land Court of New Zealand, South Island District. —In the matter of section 35 of the Native Land Claims Adjustment and Native Land Amendment Act, 1921-22; and in the matter of Kaiaua, Sections 12 and 13, Square 92, Croixelles, containing 476 acres. To the Chief Judge, Native Land Court, Wellington. I have to report that the Native Land Court sitting at Picton on the 28th March, 1922, made inquiries respecting tins claim and found that a grant of the land had been made to Maka Tarapiko, who died, and a succession order was made to Rewi Maaka. The land was sold by the Maakas to one William Stuart, who transferred to one Pike, who has now a certificate of title, Vol. 39, folio 234, Nelson Registry, for the said land. M. Gilpedder, Judge.
