1913. NEW ZEALAND

NATIVE LAND COURTS AND MAORI LAND BOARDS (REPORT FROM THE UNDER-SECRETARY, NATIVE AFFAIRS, ON THE WORKING OF THE) FOR THE YEAR ENDING 31st MARCH, 1913.

The Hon. the Native Minister. Native Department, 18th May, 1913. I havk the honour to append hereunder a report upon the work of the various brunches affecting Native lands. Native Land Court. As is shown by the attached schedule, the Native Land Court has been doing good work and is kept busy. A total of 19,278 cases were scheduled for hearing, and the number of gazetted sittings totalled seventy. As remarked in previous reports, the system of circuits is working satisfactorily. During the period the Courts investigated the ownership of 52,253£ acres hitherto unclothed with titles, and dealt with 783 applications for partition, affecting an aggregate area of 383,642 acres. The Xative Appellate Court has been sitting regularly, 345 cases being scheduled for hearing. The revenue derived per medium of Court fees, <fee., payable to, received, and outstanding for the year ended 31st March. 1913, amounts to £6,281 ss. 9d. In connection herewith I may point out that the £943 IDs. id. outstanding amounts collected by the Registrar spells activity in settling old Native titles for purposes of alienation. The Registrar at Auckland, for the current year, collected the amount of £516 ss. Bd., onehalf of which comprises outstanding fees on Native Land Court orders of probably seven years' duration, whilst the other half is for orders beyond that date; and when the names of the Judges are given—viz., Judges Williams, Munro, Wilson, Heale, Fenton, Clarke, Mac Donald, O'Brien. Rogan, Puokey, Symond, Barton. Scannell, and Gudgeon—who made the orders on which these fees were collected, it is sufficient indication of the steps now being taken to bring these longoutstanding Native-land titles up to date. The majority of these titles or orders are without doubt uplifted for one purpose—alienation either by way of sale or lease. Table A attached hereto sets out in detail the operations of the Court. Maori Land Boards. In the administration of vested lands, and confirmation of private alienation, all the Boards have been fully occupied. The area of land administered by the Boards totals 974,189 acres; of this area, 1,389 leases have been issued, of a total area of 377,478 acres, and eighty-two transfers, comprising 63,959 acres. The remaining areas are being prepared for the market, and the preparatory work of cutting up is now receiving the consideration of the several Boards. 14,822 acres are now before the public for sale and lease, to be offered on the 21st instant, and another sale plan for 4,432 acres is notified fdr the 6th proximo. The placing of vested lands on the market for public competition by Maori Land Boards is somewhat retarded by the fact that there appears to be a dearth of surveyors, the Lands and Survey Department being unable to cope with the eurveys as quickly as the Departmeni would like. The book-keeping and accounting of each Board have increased considerably, owing to the number of small accounts. This amount is considerably less than last year, owing mainly no doubt to the restricted transfers by way of sale, which to a large extent is owing to the stringency of financial operations, and also to the want of road access to Native blocks, due to the survey and reading schemes not being able to get ahead of past settlement. Table B herewith sets out in detail the operations of the Boards, together with their statements of receipts and disbursements, which total a sum of £514.007 10s. od. The table as prepared is in continuation of that contained in my report of last year. The revenue derived through Maori Land Boards from fees payable under section 81, for the financial period ended 31st March last, amounted to £4,963 9*. 6d., and other revenue by commission on sales, &c, to £2,990 3s. 7d., making a total of £7,954 13s. Id. The expenditure for the year was £5,356 Is. 6d. 1 would suggest that the commission received should be paid—similar to fees under section 81 —into the Consolidated Fund. Whilst commenting hereon, I might suggest that action be taken to obtain permanent offices for the working of the Native Land Court and Maori Land Boards, more especially at Auckland, Gisborne, and Rotorua, as the offices now in use are not conducive to satisfactory working. If the two branches were in direct touch with each other, the carrying-out of their duties would be greatly facilitated. Native Land Purchase. The Native Land Purchase Board held seven meetings during the year. Numerous offers were received and considered by the Board. The actual purchases totalled an area of 31,035 acres, and negotiations are pending affecting a number of blocks. Table C shows in detail the operations of the Native Land Purchase Board. In connection with the purchase of Native land by the Crown under Part XVIII of the Native Land Act, 1909, I would like to make some general remarks. It is reported that persons acting as proxies have attended meetings solely for the purpose of endeavouring to defeat a sale to the Crown. Although no actual proof can be brought to bear, it is assumed that in some cases a proxy represents the lessee of the land or would-be purchaser or speculator, besides acting for the Native owners, and his knowledge and ability are brought to bear by the use of arguments that will appeal to the Natives' imagination, and so defeat the motion .before the meeting. I am of the opinion that it would be preferable for the Board to decide, under the provisions of Rule 49 of the regulations, that the appointment of proxies be limited to other owners of the block, so that outsiders could take no part in the meeting. It is further desirable, in the larger blocks, where a number of owners are concerned, and a motion to sell has been defeated by a not fully representative meeting, that provision should exist for the Crown to acquire individual interests. In respect of individual negotiations, where land is held by ten owners or less, and same has been prohibited under section 363 of the Native Land Act, 1909, private individuals, land agents, and others make it their business to ascertain the owners and interview them with the object of being appointed the Natives' agents to negotiate the sale to the Crown. I would state that there is no need for the introduction of a third party in the matter at all, except where the vendor actually requires independent advice. All negotiations for the purchase of Native land have to be carried out in accordance with the Act, and the price is to be not less than the valuation ascertained by certificate from the Valuer-General; therefore all that is necessary is for the Natives to approach the President of the District Maori Land Board, or the Land Purchase Department direct, when the matter would be explained to them, and if they were agreeable to sell at the Government valuation they could execute a transfer and receive the purchase-money.

Surveys. In my former reports I have repeatedly drawn attention to the fact that the survey and reading of Native lands are the crux of the whole position. For years past the Native I.and Courts have had to subdivide Native lands to enable the Native owners to obtain individual titles. In making these subdivisions cases have occurred where the land has been further subdivided upon the original sketch-map of the block before completion of the original survey; then when an owner applies to have his interest surveyed, so as to obtain a Land Transfer title, the block is surveyed as a whole and then the subdivisional partition surveys are made, and it is found that in a number of cases a shortage of area occurs, witli the result that a pro rata deduction has to be made throughout, causing delay to the purchaser or lessee in receiving his title. Then when the survey is completed it is found that quite a number of the sections have no means of access, which leads to further complications. Under the 1909 Act, however, provision was made to obviate this (see section 117 of the Native Land Act. 1909, and Rule 29). Under this rule the Registrar is enjoined to forward all applications for partition or subdivision to the Chief Surveyor of the land district wherein the land the subject of the application is situated, so as to allow the Chief Surveyor to report where and what road-lines are required to be laid off on the land for settlement generally, and the estimated cost of surveying such road-lines. Theoretically this procedure looks simple enough, but it has been found in actual practice that it is a somewhat arduous and complicated procedure, owing to the Chief Surveyor, when not having sufficient information at hand from a local officer, requiring a survey in connection with roading by a special officer before he will furnish a report. This procedure, at application stage. is inadvisable on account of the expense, unless steps are taken for the Native owners to deposit the cost, or a fair proportion, of the survey prior to the work proceeding, as in the event of roadlines not suiting the partition scheme in the mind of the Native owners, they would probably decline to proceed. The difference between the Department's and the Native owners' view is that the Department holds that the partition scheme should be attempted to be carried out on the general configuration of the country, whereas the Native owners desire a partition according to family " takes " and occupation rights. This is a difficult problem to overcome, although no doubt the subdivision for individualization of the owners' interests would be, for settlement and beneficial working purposes, far more advantageous to them. The obtaining of Land Transfer titles should be the aim of an owner of Native freehold land. Once he obtained this title, the troubles and vexatious delays, &c, would practically be things of the past. With regard to lands administered by the various Maori Land Boards, there again the delay in placing the lands on the market for public competition is on account of the scarcity of surveyors. In commenting on surveys I wish it to be clearly understood that I am not in any way deprecating the Survey Department, or trying to belittle their efforts on our behalf. The whole trouble, so it is stated, is an insufficiency of surveyors to carry out the work. Another fact which has to be borne in mind is that, although there may be a large block of Native land suitable for settlement, it may be owned by a large number of Natives, either by a tribe or liapu, and the individual interests are so small in the majority of cases that it would cost more than the land was worth to survey each individual interest to enable the issue of titles in severalty. However, T think, as far as vested lands in the Maori Land Board districts are concerned, the Board should take full control of these subdivisional surveys and roading for settlement purposes. In the past this procedure lias always worked satisfactorily by the Board and the surveyors making direct agreements and under contract system, which is mostly based on schedule rates. Whilst remarking on vested lands I might point out that any one coming within the category of "land-seekers" can obtain information as to lands open for selection on application at the respective offices of the Maori Land Boards. On the 31st March last there were open for application some thirty-five subdivisions under leasing, disposal of freehold tenure, and timber-cutting rights. Maori Councils. I have to draw attention to my previous remarks in the reports of the two previous years hereon. Native Interpreters. During the period twenty-four persons sat for examination, with the following result : Twenty passed first-grade and four passed second-grade examinations, licenses for which were issued accordingly. The total amount of fees earned under this head is £87 12s. During the year one first-grade and one second-grade interpreter's license was revoked owing to irregularities. General Summary. Those who will take the trouble to study the previous reports together with this will naturally come to the conclusion that, proceeding on the lines of the past three years, it will be only a question of a few more years when the Maoris (who some seventy years ago owned all the land) will, as the result of the activity displayed by alienations effected during the past three years, for which period an average of 500,000 acres per annum have been alienated, be left with a limited area for occupation.

A number of alienations are made by way of lease, for the reason that the Native owners, although desirous of working their land, find that, after attempting this course, difficulties arise in the way of finance, which is necessary to assist them in working the land. Therefore they accept the rental as a means towards their subsistence. This is owing to the want of capital, as it is a fact that very few Natives are able to raise a loan or a mortgage on their land except at over the average rate of interest, except in the case of State loan Departments, where there must be collateral security in the way of other lands under lease, rentals for which have to be assigned. Since the coming into operation of the 1909 Act, 1,483,048 acres have been alienated, of which 723,122 acres have been alienated by way of the fee-simple, thereby becoming Crown or European land, and so loses the Native freehold title. The Department's expenditure for the past year has been £21,950 145., while the amount paid into the Treasury and fees received from stamps, coTiimission, &0., amounts to £14,2.35 18s. 10d. Thos. W.
