NATIVE LAND COURTS AND MAORI LAND BOARDS (REPORT FROM THE UNDER-SECRETARY, NATIVE AFFAIRS, ON THE WORKING OF THE) FOR THE YEAR ENDING 31st MARCH, 1911.

The Hon. the Native Minister. Native Department, 31st May, 1912. I have the honour to append hereunder a report upon the work of the various branches affecting Native lands. Native Land Court. The amount of work put through by the Native Land Court shows a decided increase in comparison with the average of former periods. A total of 19,042 cases were scheduled for hearing. The number of gazetted sittings totalled 75. Although the number of cases advertised shows a decrease as compared with the previous year, it must be borne in mind that what are known as " old claims " were not scheduled. The system of circuits now in vogue has worked satisfactorily, the procedure being that early in March of each year a notice is published in the Gazette in schedule form, giving dates and places when and where the sitting will be held for the year. During the period the Courts investigated the ownership of a total area of 58,572 acres hitherto unclothed with a title, and dealt with 980 partitions affecting an aggregate area of 431,166 acres. The Native Appellate Court has also been active, having had to deal with 1.48 cases. The revenue derived per medium of Court fees, &c, payable to, received, and outstanding for the year ended the 31st March, 1912, constitutes another record, in all amounting to £6,626 12s. Bd. Table* A attached hereto sets out in detail the operations of the Courts. Maori Land Boards. The Boards have been very active in the administration of trust lands and the revision and confirmation of private alienations. During the period some 469 leases were approved, of a total area of 183,315 acres; 1,220 transfers, comprising 122,869 acres, were consented to ; 27 mortgages, covering an area of 7,729 acres, were confirmed. The area of lands administered by the Boards totals 966,335 acres. Of this area, 1,338 leases have been issued, of a total area of 353,584 acres ; and 71 transfers comprising 38,780 acres. Schemes for cutting up, roading, surveying, &c, of the remaining areas are under consideration, and the land will be placed on the market at the first opportunity. Settlement is hung up for want of completion of surveys, which is necessary to comply with the provisions of the statute before the lands can be placed on the market. A word here as to the effect of the provisions of Part XVIII of the Native Land Act, 1909, upon settlement would not be out of place. Under this Part of the Act alienations can be effected per medium of meetings of assembled owners by the simple process of passing a resolution and receiving the confirmation of the Board. As intimated in last year's report, I anticipated that, as soon as the advantages of the provision were known, the alienations per that medium would be trebled. A reference to the tables will show thai estimate Ims been exceeded.

The book-keeping and accounting of each Board has increased greatly, and, as an indication of the amounts handled by the Boards, I have only to draw attention to the balance-sheets attached hereto. Table B herewith sets out in detail the operations of the Boards, together with their statements of receipts and disbursements, which total a sum of £591,511 Bs. lid., being fully three times the amount shown in previous year. The table as prepared for this report shows all the transactions, and includes all the information contained in parliamentary papers G.-6a and G.-10a, and will thus obviate the necessity of preparing the said returns in future. The revenue derived from fees for the financial period ended the 31st March, 1912, amounts to £4,506 95., almost one-third in excess of the amount for last year. Native-land Purchases. The purchase of Native lands has been pushed ahead. Numerous offers have been received and considered by the Board. During the year the Board held eleven meetings. An area of 91,495 acres has been acquired, and negotiations are pending affecting an area of 187,051 acres. Table C shows in detail the operations of the Native Land Purchase Board. Surveys. As previously pointed out in former reports, survey and roading are the crux of the whole position. If these could be kept abreast of demands, the Native Department would, as far as Native lands are concerned, satisfy the most pessimistic, as in a very short time there would be no such thing as " unoccupied Native land " that could be considered of a productive nature. Native Interpreters. During the period eight first-grade and three second-grade licenses were issued. I regret having to record that one person holding a second-grade certificate had to be proceeded against for acting as, and signing himself, a first-grade interpreter. The total fees collected under this head and for Kahiti translations for the financial period ended 31st March, 1912, amounted to £75 13s. ' ' Maori Councils. In last year's report I drew attention to the necessity for bringing Maori Councils (Health) Act into a more satisfactory position. I can only reiterate my previous remarks on the subject. General Summary. The settlement of Native land still appears to be : a vexed question, although it is admitted an improvement has taken place since the Native Land Act, 1909, came into operation. To make the position clear, take the end of the financial year 1910-11. The return set out in parliamentary paper G.-9, 1911 (page 4), gives 231,375 acres as the area alienated by way of lease or sale, and in addition thereto the Native Land Purchase Board had acquired 75,437 acres, making a total of 306,812 acres. Of this area, 194,844 acres were passed by way of private alienation, being transactions between the Native owners and the parties acquiring, and which were duly approved by the Maori Land Boards. Of that area, 116,499 acres were disposed of by way of lease to 435 applicants, and 78,346 acres by way of sale to 660 applicants, comprising an average holding by way of lease of 267 acres and by way of sale of 199 acres.

Taking this (31/3/12) return, it will be found that 527,758 acres were alienated by way of lease or sale. In addition thereto, the Native Land Purchase Board has acquired 75,162 acres (by way of assembled owners' meetings under Part XVIII), and 17,733 acres have been purchased from individual Native owners, making a total of 620,653 acres for the year. Of that area; 437,672 acres were disposed of by private alienation as between the Native owners and the alienees, with the approval of the Maori Land Boards, comprised as follows : 278,654 acres by way of lease to 571 applicants, and 159,018 acres by way of sale to 1,300 applicants, making an average holding of 488 acres by way of lease and 122 acres by way of sale* In addition to the foregoing, the Crown Lands Department; during the two years under review, completed the purchase of interests in blocks which were under negotiation prior to the Native Land Act, 1909. The area thus acquired to 31st March last is shown as 33,025 acres, principally in the Moerangi and adjoining land, which is now before the Court to define by partition. Interests in the Urewera Reserve blocks, of an estimated area of 41,506 acres, have been acquired during the aforesaid term, making a total of 74,531 acres purchased by that Department. Summarizing the foregoing, it shows that an area of 1,001,996 acres has been alienated, of which 509,873 acres have actually passed from the hands of the Native owners by way of transfer of the feesimple. From the above it is obvious that, under the 1909 Act, alienation of Native land has made far heavier strides than in previous years. Parliamentary paper 8.-2 shows the expenditure in connection with the Department to be for the year 1910-11, £21,662 ; and for the year 1911-12, £21,128 : making a total of £42,794. The Department has received by way of revenue from stamps on applications and general fees the sum of £10,395 for 1911 and £11,208 for 1912, totalling £21,603, showing the receipts of this Department to be over one-half of the expenditure incurred. Included in the above expenditure is the cost of administration in connection with the purchase of Native land, as carried out by the Native Department. The charges as shown in the Native Land Settlement Account (6.-12) are all incurred by the Crown Lands Department in connection with the completion of old purchases. Thos. W.
