REGULATIONS UNDER THE EXPLOSIVES ACT.

Laid before both Houses of the General Assembly in accordance with Section 18 of the Explosives Act, 1882.

PLUNKET, Governor. ORDER IN COUNCIL. At the Government Buildings, at Wellington, this fourth day of February, 1908. Present: The Right Honourable Sik J. G. Ward, K.C.M.G., presiding in Council. In exercise of the powers conferred upon him by " The Explosives Act, 1882," " The Explosives Act Amendment Act, 1897," and " The Sale of Explosives Act, 1906," and of all other powers and authorities enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order that, on and after the first day of March, one thousand nine hundred and eight, the following regulation shall take effect: — Regulation. Magazine Charges for Explosives in Government Magazines in New Zealand. On delivery of explosives into a magazine for storage there shall be paid for each package of s. d. 251b. or less ... ... ... ... ... ... ... 0 3 Over 25 Ib. and not exceeding 501b. ... ... ... ...0 6 Over 501b. ... ... ... ... ... ... ... 1 0 These sums shall include receiving and storage for a minimum period of four weeks. Copy of cash-book, with bank receipts in support of entries, must be furnished to the Treasury every four weeks, along with a return of the quantity of explosives remaining in the magazine. In exercise of the powers conferred upon him by " The Explosives Act, 1882," " The Explosives Act Amendment Act, 1907," and "The Sale of Explosives Act, 1906" (hereinafter termed "the said Acts"), and of all other powers and authorities enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the regulation following, that is to say,— Regulation. 1. (1.) Every person shall be liable to a penalty not exceeding fifty pounds who smokes, strikes matches, or carries a light not approved by an Inspector of Explosives while engaged or employed in the landing, transhipment, carriage, removal, or handling of any explosives other than those of the sixth (ammunition) class. (2.) Every person not so engaged or employed ,as aforesaid, being in the immediate vicinity of any explosives which are being landed, transhipped, carried, removed, or handled, shall be liable to a penalty not exceeding fifty pounds if he continues to smoke, strike matches, or to carry a light .not approved by an Inspector of Explosives after being warned not to do so by anj' officer appointed under the said Acts, or by any carrier licensed under the said Acts, or by any person engaged or employed in handling explosives.
