1890. NEW ZEALAND.

WEST COAST SETTLEMENT RESERVES DISTRICT LEASES (RETURN OF).

Beturn to an Order of the House of Representatives, dated 24th July, 1890. Ordered, " That there be laid before this House—(l) a return showing the names of lessees under confirmed leases in the West Coast Settlement Reserves District, the area held by each lessee, the rent under the confirmed leases, and the rents under the arbitration awards, and renewal of the said leases; (2) a return showing the area of each lease granted by the Public Trustee other than confirmed leases, the rents reserved by such leases, the reductions in such rents, and the periods for which the same are reduced ; (3) a return of all rents in arrear in respect of any of the lands in the said reserves, whether confirmed or original leases, the period for which such rent has been in arrear, and proceedings taken to enforce payment of each of such arrears: and that such returns be printed."— (Mr. Taipua.)

Probably a test case will be necessary to decide this and similar cases where original survey is inaccurate. Lessee claims to have paid in full. Lessees held that they had paid up. They were sued, and they tendered an amount, which was accepted as a payment on account. Lessees paid costs. Lessee claims to have paid in full under award. 8* 21 0 0 From 1st April, 1890, to 1st October, 1890 9* A few Natives, four in number, having given unstamped orders on lessee for a whole year's rent, payable to a Mr. Foreman, of Manutahi, the Public Trustee was asked by the lessee to recognise these orders ; but, as there were eighty-seven grantees, some of whom protested against a small minority having the benefit of the money, the orders were not allowed, and lessee was so informed; but he said he had paid the orders, although warned not to do so. As the Public Trustee declined to recognise any deductions from rent due, and lessee (D. McGregor) refused to pay, he was proceeded against in the Supreme Court, when it was found that he had been insolvent, and that the lease had been transferred to lessee's brother (J.
