By the operation of this Act, which, by Proclamation of His Excellency the Governor, of 17th September, 1860, was declared should come into force on the 6th October, 1870, the Province of Southland reverted back, and became again merged in the Province of Otago, of which it originally formed a part, bringing vf ith it, however, as an adjunct, Stewart's Island, which was annexed to the said Provinco of Southland by Act of Assembly, 1863, No. 1, passed on the 3rd December, 1863. The boundary of the Province of Otago towards the North having been fixed by Act of Assembly, 1861, No. 2, passed 15th July, 1861, the other boundaries of that Province now arc the same as they were originally defined in Sir George Grey's Proclamation of 28th February, 1853 ; excepting that Stewart's Island, which was specially excluded from the Provinco by the said Proclamation, is now annexed to the Province ; but the other islands, viz., Sclandcr's Island and Euapuke, which also were similarly excluded in the Proclamation, still continuo so excluded from the Province. The Province of Southland, established under the provisions of " The New Provinces Act, 1858," was created by Order in Council, 27th March, 1861, to come into force on 1st April, 1861; and the boundaries of the Province were set out in that Order in Council. Care must be taken not to lose sight of these boundaries, as so defined (vide New Zealand Gazette, No. 18, of 27th March, 1861), because the said boundaries are being constantly cited as the boundaries of particular districts, established within such Province for various purposes under different Acts of Assembly. Hence, though the Province of Southland be abolished, its original boundaries continue as permanent landmarks. The other Provinces established under " The New Provinces Act, 1858," were the Province of Hawke's Bay, by Order in Council, created 1st November, 1858 ; the Province of Marlborough, by Order in Council, created 1st November, 1859. The County of Westland, on the other hand, was established, and its boundaries defined, by a special Act of the Assembly, 1867, No. 25, passed the 10th October, 1867, for the purpose. By Proclamation of his Excellency theGovernor, of the 26th November, 1867, the said Act was brought into force on the 1st January, 1868; which is therefore the birthday of the Baid County. Doubts being entertained, in respect of this Act, whether the General Assembly had the power to withdraw from any Province any part of the territory comprised therein, except for the purpose of including the same within the limits of some such other Province ; the Imperial Statute 31° and 32° Viet., c. 92, was passed 31st July, 1868, to set these doubts at reBt, declaring the General Assembly to be deemed to have had such power ; validating thereby the establishment of the County of Westland as created by the Act of Assembly, 1867, No. 25.
