INTOXICATED DRIVER.
“ [VIOMENTAnY LAPSE” . FINE OF £'s IMPOSED. “ You have made a plea for yourself as good as any lawyer could make. 1 shall take the circumstances into consideration and regard this as a momentary lapse," observed Mr S. L. Paterson, S.M., in the Magistrate’s Court, Hamilton, this morning, to J 7 L. Y. Martyn, a farmer, of the Raglan district, who pleaded guilty to a charge of driving a car while in _a state of intoxication, on Monday.
Sergeant G. Anniss said defendant was involved in a collision with a truck on the Whatawhata Road. When Sergeant Moriarty, of Frank ton, arrived on the scene Afartyn was under the influence of liquor and was unfit to drive a car.
Addressing the Bench, defendant said he had been engaged In strenuous baymaking and as it was Christmastide he had come into town and had had a few drinks. 'He admitted that be bad not given the truck-driver sufficient room to pass, but considered the latter was also at fault in driving round a corner at 45 miles per hour. The Magistrate convicted and fined the defendant £'s and ordered his driver’s license to be endorsed.
