OFFENDING MOTORISTS.
NEARING RAILWAY CROSSINGS. FINES IMPOSED. The excuse offered by James Ferdinand Stuart, when he appeared be-fore-Mr Wyvern Wilson, S.M., in the Hamilton Magitsrate’s Court this morning on a charge of approaching a railway crossing and failing to keep a proper look-out when the line was not clear, did not have the desired effect. He was fined 20s, with costs 10s. Defendant told His Worship that on account of the stormy nature' of the night he could not see the cross-ing-keeper in Victoria Street, nor hear the warning bell ringing. •Mr Wilson did not consider that the excuse helped defendant to any extent, as he should have exercised more caution on a stormy night. Cecil John Brooke, charged with a similar offence at the Commerce Street railway crossing, was fined 40s, with costs 10s. It was shown that an attendant was in charge of the -crossing at the time, and defendant had pulled up on the line. He had endeavoured to back his car, but the engine had stalled and the car was struck by the train. The car was only slightly damaged. Defendant pleaded that he did not notice the crossing-keeper until he was practically over the crossing.
