MAGISTRATE’S COURT
SITTING AT HUNTLY. THEFT OF TOTARA POSTS (By Telegraph—Special to Times.) HUNTLY, Saturday. At the Huntly S.M. Court yesterday, before Mr F. 11. Levien, S.M., Timothy John, aged 35, a native, was charged with stealing 25 totara posts, the property of Sai .ucl Phair, a Te Hoc farmer. The circumstances were unique in that the posts were hewn years ago and left on a property which was bought by Samuel Phair and abutted on iiative land, and which was not fenced. Phair, a retired army field officer, well versed in surveying, distinctly showed the boundaries by a plan selfprepared, though his own area was not fenced.In ordering the defendant to paycosts only, the Magistrate gave him the benefit of the doubt, remarking: “Land is of little moment in Te Hoe., as the holders do not apparently know where the boundaries are.” The case created no little interest, and the Court was crowded. motoring Offences. Ernest Fouldes, of Rotowaro, was fined 30s, with 10s costs, for having no lights on his motor at Pukekapia. Leslie Yorch was ordered a similar penalty for his lorry being without the necessary night lights. William C. Bickley, described by the Main Highways Traffic Inspector (Mr W. Barrett) as a fast driver, was mulcted in £5, with 12s costs, for driving his lorry at a speed exceeding the limit. William Nicholson was ordered to pay costs for exceeding the usual limits, hut it was not deemed a serious case. maintenance Arrears. For maintenance arrears William Bishara was sentenced to one month’s hard labour.
