I Emilie Polini, tiie well-known actI fess, whose death occurred in America some time ago, left a will which came before the New South Wales Courts for interpretation. The testatrix excluded the widower, who is an Australian, from the will, and left all her money to her four-year-old daughter Patricia on condition that she was taken from her father and reared by an uncle (Owen Nares, the English actor) and aunt in England, hut should the father decline to agree to this arrangement then the child’s inheritance should be substantially reduced. The Court held that the testatrix’s condition was opposed to public policy, and was likely to deter the father from performing iiis parental duty, which was sacred, just as were his rights, therefore the gift to Patricia was absolute. Under this condition the child will inherit ’the whole estate, totalling about £20,000, when she is 21 years old.
