SHIP'S COOK'S ACTION.
ALLEGED CONSPIRACY,
JUDGMENT FOB DEFENDANT

WELLINGTON, Saturday
His Honour Hie Chief Justice gave judgment to-day in the case in which John James Stuart, a ship's cook, claimed £nG7 from William Thomas Young, union secretary, and the Wellington Seamen's Union, alleging that as a result of Hie conspiracy of the defendants with the crew of the steamer Tees he lost his employment. In order for the plaintiff to succeed, said His Honour, it must be shown that Young or the union had conspired with Ihe crew lo have terminated the cook's contract with Lhe owners, and lhal, defendants had aider! and abetted the crew in an unlawful strike Willi the same object. After discussing the evidence, the Judge, said it was proper for him lo point out that Young owed no legal duly to the plaintiff to be helpful in this dispute; there was a duly he owed lo the union, bul the sole duty he owed to plaintiff was to abstain from any active steps in inciting others lo secure plaintiff's dismissal. He was unable lo find any trace of any such incitement. Judgment was given for defendants, with costs.
