A RE-HEARING GRANTED. INFORMATION DISMISSED. At the Magistrate’s Court at Hamilton a fo/tnight ago a jockey named George Carmont was convicted and lined £lO for cruelly to a horse, which he was alleged to have used the spur on to an excessive degree. Carmont had ridden the animal, which had been engaged in a hunt at Tamahere, from Hamilton East and while going through Frankton the police had their attention called to the condition of the horse and the. charge was subsequently laid. When the case was first heard, Carmont did not appear, but subsequently he made application and was granted a re-hearing. This was taken before Mr H. A. Young, S.M., yesterday, 'when Mr N. Rawson appeared for defendant. The police brought fresh ■ evidence which, with that produced by the defendant and his witnesses, showed that the horse was of a stubborn disposition and of vicious habits. When engaged at the hunt It had dislodged Its rider at tb-e first fence. ,The evidence further showed that the horse had refused duty at various points along the route to and from the meet, and again when the defendant was riding it from Hamilton East to Frankton. His Worship said that from.• the evidence he could not hold tha’l defendant had wilfully ill-treated the horse to a greater degree than was warranted, and accordingly dismissed tile information.
