TENEMENT CASE
ORDER FOR POSSESSION MADE. At .the Magistrate's Court, yesterday, before Mr H. A. Young, S.M., G. B. Marr (Mr J. P. Strang) sought to recover' from F. B. McDonnell (MiBell) the possession of a tenement, situated in Seddon Boad. ['Yankton Junction. McDonnell, giving evidence, slated that lie was a, married man with a child of two years. The wife had been under the doctor's care ever since the birth of the child. Defendant was a railway employee, and had written in several limes to the Department for a house. The Department bad' been unable to supply him, but it, was still building, and doubtless defendant would gel a house. Defendant and his wife bad also consulted practically every land agent in the town, and advertised in the papers in a search for a house. Questionctl by Mr Strang, defendant denied a Mr Mayes offering him the use of his (Mayes) house. Mr Mayes, defendant admitted, however, had offered defendant the use of Iwo rooms in bis house. Witness denied having promised plaintiff on a certain dale lo vacate within three weeks. For plaintiff, it was stated that he was a single man with a mother and various oilier dependents totally and partially dependent upon him. All eight people dwelt in a four-roomed house. On account of defendant's promises to quit, plaintiff had kept .■(laying action. His mother was in delicate health, and altogether it was essential that he should have the occupancy ,of his house now occupied by plaintiff. His Worship made an order for possession, and allowed costs In plaintiff.
